TX. Man Fined For Feeding Feral Cats

TEXAS – Galveston, Tx. bridge worker John Newland, who has been in the news after one of his cats was shot by a local ornithologist, will be fined for feeding a colony of feral felines.

Following the courtroom debacle that resulted in a deadlocked jury after a local ornithologist shot a cat near the bridge, Newland was cited on misdemeanor charges for having too many cats.

He says the cats have been around for years, longer than he's been at the bridge. He's been caring for them for about five years. Newland says no one told him it was illegal to feed a hungry animal.

But the city of Galveston disagrees with that notion. According to a city ordinance, no person may care for more than four cats or dogs. Under that ordinance, feeding the 15 to 20 felines that frequent the underside of the bridge means Newland is responsible for them – and that he's committing a crime.

Galveston Police Lt. Mike Riedel says that even though Newland thinks he's helping the animals, he's really just making things worse. That's because they're not castrated – so their numbers are increasing.

A Trap-Neuter-Return program could easily solve that problem. But instead, Mr. Newland is being fined.

One person expressed contentment over the push to fine Newland – that was the ornithologist's lawyer, Tad Nelson. Nelson said Mr. Newland is naïve to think he's helping the animals – the same sentiment that was expressed by local law enforcement.

Newland faces up to $500 in fines for the misdemeanor.

Becky Robinson of Alley Cat Allies, the nation's most seasoned feral cat organization, says it is a common misconception to think that people who feed feral cats aren't helping them. And according to a survey recently taken by the group, an overwhelming majority of Americans would opt to leave the animals alone before having them trapped and potentially euthanized.

But perception, it seems, will remain reality - at least in Galveston, Tx.

There's no word on whether any local animal welfare groups will offer to put the colony through a Trap-Neuter-Return program. But for more information, go to alleycat.org/anticruelty/index.html.

I understand both sides of the feral argument but the facts are that just killing them does not work. So just watch them starve??

Remind me not to move to Gavelston! Where does the money collected in that fine go??? In California some shelters feed the feral cats down near the rocky beaches. The cats still catch mice, which is a big help.

Similar situation in my hometown. Fortunately we have very progressive city leaders and it became legal to care for feral colonies here in RR on Nov20,2007.

What's next fining people who feed ducks and geese? Why not go after the people who don't alter their pets, or people who dump them after they aren't cute little kitties anymore.

I think to fine the man is ridiculous. The feral cats are the result of humans not being responsible and having their cats neutered. It is not the cats fault that it is feral. Alot of organizations trap feral cats, neutered them and then release them back into their environment.

I got in trouble once for feeding the birds (from my backyard) because neighbors complained. There is a big dispute about feeding feral cats, but I think it is better to feed them, gain some trust, trap them for a spay or neuter, and them allow them to live their lives as nature intended. So one should be fined for showing some humanity. Unless you are feeding bears, that is.

Are they serious? Fine a man for feeding hungry animals? Is that really a crime? I'm glad I don't live in Texas. I have an idea for Texas-get a spay/neuter van and fix the cats rather than fining the man for feeding them!

What is it with Texas? I never read anything good about that state. Instead of trying to spay/neuter the colony to reduce numbers they find the man who in the kindess of his heart was trying to care for these animals. I guess it's better to just let them keep reproducing and starving to death, or shooting them...yep, gotta let those gun totin' texans have their target practice.

TNR is the answer to the feral cat overpopulation problem. Until such time as all cats are spayed/neutered, we need to care for them in some way.

Use the $500 fine for a TNR program. And get educated you fool judge and lawyer. There is so much ignorance demonstrated by otherwise educated people, it's maddening.

it is unfortunate that someone did not offer to TNR prior to this getting blown out of proportion. I wold hope that the legal system would be willing to compromise and offer fit punishment for this gentleman who thought he was doing a kind act. Maybe have him handle the TNR and pay for some of the costs would be more appropriate?

This is a tricky one. Feeding the cats helps make the problem bigger. But you dont want them dying either.

Personally, if your ONLY feeding them, your part of the problem. You should also make it a point to do TNR if your feeding them. If your not willing to do that, dont feed them.

Why doesnt the city of Galveston take the money it is going to cost them to go after this poor soul and use it to spay and neuter these cats instead of wasting it in persecuting this kind man.

What a backward community!!! They play banjos in that there town??? When can we all just on board to TNR?? How can a man be be punished for kindness??? I hope to see an update on this, telling me that soemone came forward, after all, to alter these cats and let them live their lives(with food) from a kindly soul

He should not be fined. He is helping homeless living things. It is not there fault that their owner put them on the street or their parents. He is trying to help feed the hungry. Would you rather have starved to death cats laying around the neighborhood. If they fine him it should go to neutoring the cats.

Okay so let me get this right, if you feed wild animals, food that is good and healty for them, you automatically become thier provider and can be fined if there are to many? Well that say's alot about local laws!

I've never heard of being fined for feeding animals. Surely some program can help with spaying and neutering the cats and the problems will cure themselves.

Why are they not being spayed or neutered? I agree he is making the problem worse if the animals are not spayed and neutered, but I think he can't stand not to. If these cats were spayed and neutered the problem would not be worse.

Rather than fining this individual the community should be figuring out a way to fund their trap/neuter/return program. Unfortunate that he is penalized for attempting to help these cats.

I do know that there is a law in most stated about Feeding Feral Cats but yet nothing seems to be done to help stop the these cats from breeding.
