'Ranchers' Right' to Shoot Dogs Sparks Debate

ORLANDO, Fla. -- The shootings of two huskies roaming a cattle field has sparked international outrage, prompting calls from the Animal Legal Defense Fund and the Humane Society of the United States for the shooter to face charges.

"When we first pulled up there was a large gentleman walking towards the dogs," said witness Patrick Miller, describing the May 19 shootings of Hoochie and Raley, owned by Chris Butler.

"Chris (Butler) went running out there with a leash in hand, yelling at the guy who had just pulled out a gun and started shooting the dogs. He was just firing into them -- I was screaming 'No, no, no!' "

Miller's screaming attempt to intervene was captured by a tourist, who later posted the video on the Internet.

According to Butler, the two dogs were off their leashes when they took off running from a pond during a nightly walk. The dogs wandered almost two miles from their home, into a field with cattle.

While Butler searched for his dogs, a crowd began to gather at the corner of a field and highway, watching cattle owner Christopher Comins observe the loose dogs intermingle with the cattle.

Miller, who is also Butler's neighbor, was among the crowd and recognized the dogs. Miller raced to Butler's home to inform Butler that his dogs had been found

Yet as Butler and Miller returned to the scene, Comins was already armed and in the field.

In the video, Miller is heard screaming "No, no, no!" while Butler is seen running into the field with leashes in hand. Simultaneously, Comins fires nine shots at the dogs. Both were wearing collars, witnesses say.

One bullet shattered Hoochie's leg and another took out his eye. Raley still has a bullet in his back, but has fully recovered.

According to a police incident report, Comins told the Orange County Sheriff's Office that the dogs appeared to be preparing to attack and were attempting to harm a calf.

Under Florida law, property owners can shoot dogs if the canines harass and attack cattle, or act aggressively.

However, the incident report also notes that no injuries were found to the cattle.

A sheriff's office investigation concluded Comins acted within the law by protecting cattle from a possible attack.

Now the ALDF, HSUS, Butler, his attorney and close to 5,000 people from around the world, have signed an online petition, saying the incident is a case of animal cruelty.

Collectively they want the state attorney's office to charge Comins with a felony.

Comins and his attorney declined to comment, as the legal action is pending and two-fold: a civil suit filed by Butler and a defamation suit, which Comins filed against Butler.

Comins' supporters have set up a blog, which displays letters from the land and cattle owner.

But while the cases hang in the balance of the justice system, Butler is the only person, so far, who has faced legal action. He received two citations for having his dogs off their leashes and was made to pay $107 for each dog.

"Just to add insult to injury, I had to pay $10 for writing the citation," Butler said.

In Butler's civil suit, animal law attorney Jennifer Dietz has filed to recover the cost of Hoochie and Raley's medical bills and physical suffering. They're seeking $15,000.

"The owner was there, calling the dogs, when the man was shooting the dogs," Dietz said. "If he's there running and jumping the fence to get his dogs and one dog was shot and running towards his owner, it goes beyond what a normal person would do. It's not reasonable."

The state attorney's office said its investigation continues, while the ALDF stands behind its offer to assist the state attorney's office with the case.

a loose dog can create a huge problem without being aggressive. Cattle, horses and sheep (especially those that have had bad experiences) can panic at the sight of a strange animal - when a couple of dozen half ton cattle panic, nothing and nobody can stop them. The farmer HAS to stop that BEFORE it happens, even if it means killing your pet. .
Many pregnant animals abort from the stress. Your loose dog could cost the farmer a fortune without misbehaving at all.

I guess you never looked at the Video? There were about 60 people on site with Video Camera. The owner of the dogs was running through the pasture and Comins was shooting the dogs, it could have been the people watching or Chris that was shot. Comins DID NOT OWN THE LAND, COMINS DID NOT OWN THE COWS he lived in the area and is a gun lover and has been arrested for holding a gun to a mans head. He is a nut case. Please get your facts straight.

There are many other options available such as calling animal control or the police rather than shooting the dogs. It is very obvious in the video the two dogs were not acting threatening toward the cows or the farmer. More so, it appears the two dogs were approaching the farmer in a very friendly manner. It is my opinion the farmer over reacted. How would the farmer feel if his cow got out, wandered onto someone else's property, and was shot.

sorry to hear the animals were shot. but they were on another mans land. the cattle seem to be the mans living and he was protecting his. the dogs were in the wrong, but i also think it was wrong to shoot them, a warning shot into the air might have done the trick??? my neighbors dog comes into our yard, but i dont shoot it.

Shooting loose dogs is common in rural areas as well as inner-city areas. I feel bad for pets and strays in those areas. It's amazing that we live in the same country when comparing the behaviors.

How awful. Unfortunatly, working at a shelter, we have seen this before. Thankfully the dog that came to our shelter, who is now named "Liberty" survived this terrible ordeal and is living a wonderful life in a wonderful home! She did lose a leg, but you would never be able to tell. Still, the fact that the owner was running, leashes in hand, just kills me. I don't think I could ever witness my own dogs being murdered right in front of me. Uugh. My heart goes out....

Are you serious, that shooter is waaaaaay out of line, I think he has a problem with the world so he takes it out on harmless animals. I'm sure he has some anger issues, jerk! A warning shot would've scared them away.

He fired nine shots, I sure if he had fired a warning shot it would have scared the dogs away. These were domestic dogs, not wolves. I feel he should be charged with cruelty. This was uncalled for, especially since the cattle were not harmed.

This is unbelievably shocking.

The article does not describe the dogs as "harrassing or harming" the cattle and it sounds as though the rancher was just trigger happy.

I hope the suit is successful.

this trigger happy man is lucky a bullet didn't hit someone in the crowd or some of the cattle. he's a man with very poor judgement when using a gun. --which makes him dangerous too.

btw/ does anyone know if this was the only gun he had on him when this all came down? just curious.

I'm so glad the dogs are alive, but the pain they were in should be paid for. This guy is obviously crazy who shot them and if he can do this without care to an animal he is probably an aggressive person to begin with. His obvious lies about the dogs harassing his cattle should get him jail time alone.

Sounds to me that this was intentional! He was a neighbor so he knew who the dogs belong to and he could have shot warning shots to scare them instead of point blank shooting the dogs!

The is terrible! I feel sorry for the owner having to watch his dogs being shot.
What's the matter with the gunman? Sounds like the dogs were not attacking the cattle. It was the gunman "attacking" the dogs.

What a sad story... Seems like the man that owned the cattle just wanted to kill something.. I mean the owner was THERE trying to get this dogs... They would have arrested me for fighting with the cattle owner... The shooter should face cruelty charges.

This is extremely sad. I feel for the dogs owners and as a someone who lives in the country I understand wanting to protect your cattle. But a domesticated animal who is not snarling and growling and who's owner is yelling is not the same as a wild dog that's came along.

very sad! But I also understand as I have seen the damage huskies (and other dogs)have done to farm animals. However farmers need to assess the situation and not just use it as an excuse to shoot a dog!

Sounds like Florida should change it's laws regarding the shooting of animals in regards to protecting property. If the dogs were wearing I.D. then the farmer would have a way to track down the owner and address his grievances/property damage. People in Florida should contact their local/state lawmakers and talk to them about this issue.

How could the cattle owner act without thinking. The dogs' owner was there and calling the dogs to come back to him. This is clearly a case of animal cruelty. The cattle owner could have fired in the air first.

What ever happened to neighbors talking over problems? Why are guns drawn as the first resort, in stead of the last? I am thankful both dogs made it through the ordeal. The man needs to build higher fences to contain the dogs. Next time the dogs might not be so lucky.

I love dogs and that is why I have a fenced yards and know where my dogs are every day. They dont go out without me and they dont go for walks without me.
This guy was wrong to shot the dogs.

There is a difference between what may be legally correct and what most of the zootoo participants see as morally wrong. For those who live in urban/surburban areas, many farmers and ranchers have a different view of animals and how they should be treated. I also think there is more to this than what the story reports.

I feel that neither the guardian of the dogs nor the cattle rancher who shot them are responsible people. The dogs need the lawyer, they are the ones who got hurt !

Listen -- no one has the right to kill or injure anyone else, unless properly justified -- The ranch owner was too quick to judge, thus, too quick to shoot -- in this case, the ranch owner made a mistake and should pay for it -- this includes acknowledging and apologizing for his mistake of shooting -- also, this includes paying for any bills associated with his shooting these dogs. Next time, think before you shoot, if you need to shoot at all -- there are other ways to protect what is yours without bringing harm or injury to all involved -- everyone's life is precious, remember that!

Absolutely ridiculous, just shows why many people really shouldn't be allowed such access to guns. The owner is just lucky that both his dogs lived, they looked like up close shots, i feel soory for the dogs.

Like many of you I agree that these dogs should not have been wandering off their leash, but I don't think that gave this guy the right to shoot them. It doesn't sound from this story like it was an 'attack' on his animals, or himself. I agree with the right to keep and bear arms as well, but we need to be responsible about it or we are going to lose it, and the more people like this who hide behind the second amendment when they misuse their guns the more likely it is to happen.

Sometimes animals get loose, I don't care who you are or how diligent you are about keeping your animal(s) on a leash; sometimes it happens. I don't think they should have been shot for their curiosity. They didn't seem aggressive at all. This is ridiculous. I can't believe how cruel people can be.

I was thinking the same thing. Sadly there are occasions when my dogs have gotten loose and I would have just totally freaked if anyone had shot them. Clearly the shooter must have some violent tendencies.

this has nothing to do with gun control laws, guys. there are laws about keeping your dogs on a leash too, so it's just as much the dog owner's fault as it is the rancher's determination to shoot the dogs. i agree that it seems the rancher should have stopped if he noticed the owner calling his dogs, but they shouldn't have been on his property.

I am a gun enthusiast (but not a hunter) as well as an animal advocate. I agree that it has nothing to do with gun control laws. In fact, the individual who shot the dogs appears to be trying to shield his actions under the guise of a law that permits ranchers to shoot dogs that attack cattle (although an attack by the dogs doesn't appear to be the case based on testimony by witnesses).

Saying that it is “just as much the dog owner's fault as it is the rancher's” in my opinion is a bit heavy handed. I agree that the dogs shouldn’t have been off leash and that the dog owner bears some responsibility, but I wouldn’t say the responsibility is equal. If I had an elderly parent who had Alzheimer’s and they wandered into someone else’s house and the homeowner shot them for trespassing, I wouldn’t be a very happy camper.

Just as dog owners need to be responsible, gun owners need to be responsible as well. Let me reiterate that I am a big fan of the second amendment and believe that it should actually be the first amendment. Regardless, it’s irresponsible and unjustified actions like these that give gun owners a bad name and fuel the fire for gun control.

you're totally right. if anyone is more at fault it's the rancher, but i just wanted to point out that it can't possibly be *all* his fault, as there shouldn't have been dogs out like that. :)

Again I seem to have more questions than answers. I agree the dogs should not have been loose however they were. This is not a perfect world.
It does not say that Comins owned THIS cattle. It merely says he is a cattle owner and I think this is a little misleading and downplaying his actions possibly. He ALLEGES they were preparing to attack a calf yet no evidence of that is present. Reading that he shot 9 times even as Miller was shouting "No" just makes me wonder how innocent his actions truly were especially since I can find nothing in this story that states the cattle were his - or the property for that matter.

christopher comins is NOT a rancher, he does NOT own the land NOR does he own the cattle. He is an Orlando businessman with a previous conviction for a gun violation.
His wealthy friends who own the land also do NOT own the cattle!!! Geaux figure.
