
Poop Issue Strikes Again, Ruins Family Outing

SECAUCUS, N.J. – A New York family’s outing to the Maritime Aquarium in Norwalk, Conn., was allegedly ruined by their one-year-old child stepping in dog feces.
The mother, Kelly DeBrocky of Mahopac, N.Y., filed a claim against the city for $100 to replace the toddler’s $54 shoes, as well as for the price of parking and admission to the aquarium on April 5.
The claim is the latest in poop issues that cities across the nation are facing. While City attorney M. Jeffry Spahr said the Norwalk’s official response is denying the claim, he also said “poop happens.”
But it’s exactly the stink that’s been plaguing lawmakers: what to do after “it happens.”
A bill is currently before New York state legislators that would increase fines for not picking up after pets by 150%. It is the first time in 20 years the fine would increase from $100 to $250.
Previously reported by Pet Pulse, city governments in Alaska and Wyoming are debating the issue by banning canines to enter public sporting fields, to reduce the risk of children contracting diseases.
In Anchorage, the issue came after numerous complaints of children stepping and falling in feces during sporting events. While the city already carries a $150 fine for offenders, it has launched a “Poop Patrol,” comprised of volunteers to prevent “poop abandonment.”
The city hopes the patrol will nip the issue in the bud before the Anchorage assembly meets next spring.
Cheyenne City, Wyo., council members considered a similar proposal that altogether banned canines from community fields. However, members determined education was key to stopping irresponsible pet owners from leaving behind dog messes.
City council members hope a misdemeanor charge will discourage wanton poop offenders.

There's no way to know if the dog who left the family-outing-ruining pile was someone's pet or a stray. if it was a stray, then the city ordinance of having to pick up after your pet would not have stopped it from happening anyway, though the city may still be considered "at fault" because then it was a stray dog and animal control should have been alerted. Either way, I think this is a frivolous lawsuit and should be thrown out.

A 1 year old walked into a pile of poop ruining her shoes. Here is my question on that, "where was mom and dad". As I am sure with most 1 year olds, they are very wobbly when walking so mom and/or dad should have been paying attention.
Secondly, yes, folks need to pick up their dogs poo. There is no excuse.
But how is a city really going to enforce this law.
And lastly, sueing the City is not the answer here. The city gov might be full of it "so to say" but they usually don't leave it for folks to step in.

Still no reason to get sue-happy, but just a thought to consider. The bigger the pile the angrier the people?
It's not fun to pick up dog poop, but it's not fun to step in it either. Responsible pet parents clean up after their pets - period.

On Monday my toddler got sick and we went to the doctor, but she threw up a lot on herself in the car on the way. Good thing I was prepared in the car, and after returning home, I cleaned up the carseat and washed the cover, etc. Having a kid makes you have to deal with these kinds of gross things and it really is no big deal. I can't imagine what this foolish mother would do if that ever happens.

She's a fool for spending that much on shoes that the toddler will outgrow in several months.
Still, a bad mother for not watching her child and helping to avoid stepping on the poop in the first place. My 2 yr old knows what poop is and avoids it, especially our two GSD's poop. Perhaps she should better educate her child about these kinds of things.
I also get annoyed at people who don't pick up after their dogs. I can understand if you just didn't pay attention and didn't see it happen, but those that intentionally leave the pile for someone else to pick up, those are the ones that really need to be fined.
