Pa. Puppy Mill Closed, 96 Dogs Need New Homes

EPHRATA, Pa. -- On the eve of the Hanukkah and Christmas holidays, 96 canine wishes were granted when authorities closed a Lancaster County puppy mill on Saturday.

Pennsylvania dog wardens came to an Ephrata kennel this weekend to enforce a Dec. 6 injunction, which ordered owner Ervin S. Zimmerman to close the facility within 14 days.

"We've had four or five injunctions this year, but this was the first time that we actually had to go in and remove the dogs because someone was not actually following the order," said state Agriculture Department spokesman Chris Ryder.

"In the past there were significant issues," said Ryder of the kennel's conditions historically.

A judge granted the injunction to the Department of Agriculture's Bureau of Dog Law Enforcement after an unannounced Nov. 25 inspection, which led to Zimmerman receiving citations for six violations of the dog law. Wardens also ordered veterinary checks for five dogs.

"And because of all the unsatisfactory inspections, his license was revoked," Ryder said of Zimmerman's kennel license status in 2007.

Out of the state's 4,413 commercial kennels registered in 2007, "21 licenses were revoked or refused, similar to Mr. Zimmerman's situation," said Ryder.

"Then it was denied in 2008, and he was appealing it, which is why he was able to operate the kennel until now. We weren't able to shut him down for good until we got that [injunction] from the judge."

On Saturday, staff of the Humane League of Lancaster worked with authorities to remove the dogs ranging from puppies to adults of various breeds, including Yorkshire terriers, poodles, Cocker Spaniels, Schnauzers, Jack Russell terriers, Malteses and Shih Tzus.

The Humane League was not able to be reached for comment, as of press time, yet it reportedly is caring for more than 60 of the puppy mill dogs, while a shelter in a neighboring county houses the remainder.

Of the 31 adult dogs that the Humane Society of Berks County shelter has taken in to help the Humane League, the dogs "require some basic medical attention, nothing too extensive," said Dyan Heckart, the field service coordinator for the Humane Society of Berks County.

"They [the dogs] are actually not in that typical condition where you find them with large, distended mammary glands, so they don't really appear too much worse for wear," Heckart said.

While the dogs are being sterilized and readied for adoption, the shelter is accepting pre-screening applications so the dogs can find new homes just after Christmas.

But the community is already pining away.

"When the story hit the local Fox 29 news in Philadelphia at 10, I was receiving phone calls on my emergency line at 10:20 from people interested in adopting the animals," Heckart said of the instant response the story generated Sunday evening.

"When there is a tragic history, people tend to come out of the woodwork because people want to help these dogs," Heckart said. "And that is a good motivator, but we have dogs everyday that need help, not just these guys."

Ryder said six misdemeanor charges were filed against Zimmerman by the Agriculture Department.

He will also face charges of operating a kennel without a license from July 25 through Dec. 19. Fines associated with the charges will be determined by Lancaster County Court at a future hearing, reported Lancaster Online.

I think the public is more aware of puppy mill practices. News like this just helps the cause. Eventually it will be much less feasible for puppy mills to run unethically. Us good guys just need to keep on hammering down on them!

I wish people would come out of wood work all year long at our local shelters. A nd people would come out of the wood work and have their pets spay and neuter. This would be a blessing for all pets across the world. I'm glad this guy is out of business. If he treated animals that way what did he treat people like. Hope all the dogs find forever homes!!!

Another one bites the dust, thank goodness, too bad its not more than one and too bad the animals are the ones that suffer the most. I hope he gets what he truly deserves and doesn't go out and try it again. God bless all the dogs, hope they find good deserving homes!

I am so happy this place was closed down, now what about the rest of the hell holes?? This is a major problem and I don't understand why it has been so hard to shut these places down.

All these small dogs will find homes quickly and that's a good thing, but that demand for small dogs is what keeps these puppy mill guys in business.

Thank goodness, but why does action always have to take so long??? People coming out of the woodwork is no surprise, but they come out all year long.

Thankfully those dogs will find homes soon. I only wish that people would show that level of compassion all year to the thousands of animals in shelters. Even if you can't adopt, volunteer your time. Not only will you enrich the life of a shelter animal, you'll enrich your own, too.

I am glad that this was shut down. I only hope he doesn't move somewhere else and start this all over again. It is too bad that the shelters can't have a "store front" and get more people adopting. Maybe the rules for these puppy mills should be looked at closer too. I can't imagine having more than 20 dogs at a time in one place and doing any of them justice!! And yet these facilities have over 100. Wow

AWESOME....another VICTORY and one less puppy mill. > 4,400 kennels in PA....it just frustrates me to think of this when our shelters are full of perfectly adoptable animals everyday that need a good home. I'm glad there is plenty of interest from the public to adopt these dogs....but we need that kind of interest EVERYDAY...not just in a crisis.....if so, maybe our shelters wouldn't be so crowded.

GOOD! Yet another Puppy Mill has been busted and is going down.A definite step towards the better.
The thing that drives me crazy,is the part where the Public goes crazy and wants to adopt all these poor abused dogs over night.I would love for people a) to not make rash decisions based on the" heat of the moment",and b)to realize that there are many,many animals in the shelters all ready,who have had horrible past lives and need the love of a happy adoption too. Not every dog's story makes the head lines.People need to see that this happens every day and not just when a News Story breaks.

well for once some news that there are people doing their jobs. the only bummer of it is that these puppy mill freaks are actually allowed to appeal just so that they can drag it all out and keep their "business" running that much longer. ah well it's nice to hear that the community responded. yes i know that there's so many other good animals that need this kind of repsonse as well, but at least the 90 or so puppies added to this statistic will find good homes quickly and after it's all said and done no one will be worse for the ware. also, it's good to know that there was some acutal punishment being dealt.

I am glad that they are finally closing puppy mills. If they close them one at a time, it will eventually get them out of business. I know there are a lot of them still out there and people who buy pets from pet stores keep them in business, but someday, people will learn the horrible conditions that these people keep their dogs in and will stop buying dogs from them.

"Kill the demand". Yesssss, Nelson this is the only way to stop puppymillls. But how? I feel certain that puppymills have had lots of exposure (thank you Oprah) and still people are buying. I have to believe that they just don't care.

That's true, but sad for all the adult dogs out there needing homes. Everyone seems to want small puppies. It would be nice if a story went out about a shelter with older, large dogs needs homes and the shelter gets overwhelmed by people wanting them.

I am so glad they were able to shut this mill down. Now if we can get this done to all of them my life will be complete. I feel for what they are going through as our shelter just got 48 from the most horrible mill I have ever seen!!! My blessings are with them and the dogs and wishes for great forever homes to each and every dog!

I know all of these dogs are going to find homes rather quickly. I wish that people would be running to the shelters to adopt dogs at all times, not just when there is a big news story about it. Each dog at the shelter has their own tragic story that needs to be shared.

I couldn't agree more! It is a shame that it takes a story like this or a story about a fire or something to capture people's attention about the plight of some of the animals in the shelter. I guess some of that is our fault for not being able to market our animals better. Or maybe the stereotype of the local "pound" is being perpetuated by us making it unappealing for the public to visit us.....

I wish all puppy mills would be closed down. I hope all these pups find good homes, but I agree with the person who said that when there is a tragic story, people come out of the woodwork to help the animals, but there are dogs and cats everyday that need homes. Spay/Neuter laws should be manditory to stop the greatest form of animal cruelty, too many animals and not enough homes to care for them.
