Court: Helmsley Fortune Goes to More than Dogs

NEW YORK -- The late Leona Helmsley's billion dollar fortune can now go to more than her beloved dog, Trouble, and other canines, a New York judge ruled yesterday.

When the real estate baroness and New York socialite died in August 2007, it was widely reported that her trust, estimated to fall between $5 and $8 billion, was intended to provide solely for dog-related charity organizations.

Her 9-year-old Maltese, Trouble, was initially left $12 million in Helmsley's will; that amount was later reduced to $2 million.

Now, Manhattan Surrogate Court Judge Troy Webber has ruled that the trustees of the Leona M. and Harry B. Helmsley Charitable Trust can decide which charities -- animal-focused or not -- the money should go toward.

Howard Rubenstein, the spokesman for the trustees, said they will announce their first grant in March.

"In hopes that this would be the court's decision, the trustees have been diligently working to identity potential grantees so the trust's funds would be put to optimal use as soon as possible, in such areas as health care, medical research, human services, education and various other areas,"Rubenstein said.

Rubenstein did not specify if dog-related charities would receive funds from the trust.

Helmsley, who was sometimes called "The Queen of Mean," also earned herself a reputation as a serious dog-lover following her death and announcement of her trust.

The Humane Society of the United States said it hopes that some of the trust will still go to causes like combating dogfighting and puppy mills.

"Her fortune has the potential to do so much good for the animals many consider to be our closest friends and companions," HSUS President Wayne Pacelle said in a statement, as reported by BusinessWeek.

Trouble's fortune was depleted to a mere $2 million after two of Helmsley's children, who were left out of the trust, appealed to the judge. They were later awarded $6 million each, still leaving enough for their mother's beloved pampered pooch to live the good life.

Entrusted in the care of one of Helmsley's former employees, Trouble began to receive death threats in 2007; now, she has a security detail costing the estate $100,000 a year.

The judge's ruling will not affect Trouble's rights to the fortune.

She made her wishes clear and the money was going towards animals, it should not be able to be altered because of greedy humans.

I don't like the fact that someone’s wishes can be attacked and changed. If Ms. Hemsley wanted the money to dog related charities, it should. Why do they have the right to change it? With all the money she had, leaving 12 million (out of billions) to her beloved Trouble probably seemed logical to her. I think it is arrogant and bounds have been overstepped to judge someone else’s dying wishes wrong. It should not have been done.

I think it is very sad that you have No say after you die what will happen with your $$.... Her children should be ashamed. I hope the trustees will do the RIGHT THING and honor her wishes.

That is a terrible thing to go and change her wishes if she had them in a legal will. She was a little wacky but if she loved her dog that much and wanted her money to go to help animals thats where it should go.

I personally believe that Leona Helmsley is a little bit wacky, but it is still her money to do with as she saw fit.

how ludicrous that a person no longer has a right to say what will happen to their money when they die. If she wanted those children to receive any money...she would not of purposely left them out of the will. And now the possibility that "...dog related charities WOULD receive funds from the trust"... nice society we live in.What does a person's life mean if we can not honor them through death?I don't care how mean they may have been.

I think this is all wrong! If the person wants the dog to have the money then thats what needs to happen. No not all the money but enough for the dog to have a very good life. The rest of the money should go to s.p.c.a.'s to help other animals.

I don't think Ms.Helmsley would turn over in her grave if the money was depersed in a manner that did in fact help any four legged creature. After all we are talking BILLIONS of dollars.I believe that if funds were available for spaying and neutering that it would, in the long run, relieve Animal rescues and Shelters of over population. Personel could then concentrate on the neglect and abuse
situations.

Yeah, I agree. What good is a will. But while giving it all to one animal is totally insane, why not distribute it to other worthwhile ANIMAL organizations!

I guess some people would think that not all of Helmsley's fortune should go to dog-related charities, but I don't think that it is right for the courts to disregard Helmsley's will and disburse the money to non dog-related charities. A will is a legal document and I don't think it is fair for the courts to do something that does not agree with Helmsley's will in regards to who should receive her money. I know that Helmsley was supposed to be pretty nasty but if I died and had millions of dollars (which will never happen) and put it in my will to go to my local shelter, I would not want it to go anywhere except where I specified. There are probably people who have died in the past and left millions of dollars to organizations that I did not agree with, but it was their money and their right to specify who should receive it when they die.

I don't understand why her wishes aren't being followed. It was her money. I think her kids are money-grubbing brats to challenge the bequest. I expect that my assets will be distributed as I spell out in my will (not that anyone will get rich on what I leave). Isn't that why we put a will in place? At the very least, I hope a significant portion winds up where it was supposed to go.

I am curious as to why the "Queen of Mean" left her children out of the will, yet left her beloved Trouble a fortune. Perhaps her children weren't around until she was dead.

Good for Leona, she can do what she wants with her money. At least that's the way it used to be before we had courts making law instead of interpreting it.

I'm not sure that Trouble needed quite as much as he was bequeathed but nevertheless - it always disgusts me when those who stand to profit from a family member's death feel the need to overturn dying wishes. I pray some of this money goes to the animal causes she cared about. It is not that often that the animals receive a benefit of such magnitude.

With so many charities having trouble with the economy I hope they choose many and spread the money around. Of course I wish the majority would go to animal causes.

I say divide the money between animal shelters and other pet related charities and people-based charities. There are so many organizations out there right now that need a helping hand!

I'm so happy to see other pets will benefit from this money. I hope the smaller rescue's get some grants from this, they struggle to help so many pets and function on such small budgets!

There was a will written and her wishes should have honored, as to her children not getting any inheritance, what did they do where she did not want to leave them anything at all? I beleive the judge was wrong to over rule her will. That is just my opinion though.

Wow. I can't imagine a dog inheriting 12 million. I do believe that was a bit much, BUT she obviously didn't leave her children money for her own reasoning. I dont agree at all with the judge's decision. I feel that if they are letting the trustees decide which charity they want it to go to, it should atleast be designated to animal welfare which is what she asked. Just goes to show how detailed you need to make your will so no questions are asked.
