Court: Helmsley Fortune Goes to More than Dogs

NEW YORK -- The late Leona Helmsley's billion dollar fortune can now go to more than her beloved dog, Trouble, and other canines, a New York judge ruled yesterday.

When the real estate baroness and New York socialite died in August 2007, it was widely reported that her trust, estimated to fall between $5 and $8 billion, was intended to provide solely for dog-related charity organizations.

Her 9-year-old Maltese, Trouble, was initially left $12 million in Helmsley's will; that amount was later reduced to $2 million.

Now, Manhattan Surrogate Court Judge Troy Webber has ruled that the trustees of the Leona M. and Harry B. Helmsley Charitable Trust can decide which charities -- animal-focused or not -- the money should go toward.

Howard Rubenstein, the spokesman for the trustees, said they will announce their first grant in March.

"In hopes that this would be the court's decision, the trustees have been diligently working to identity potential grantees so the trust's funds would be put to optimal use as soon as possible, in such areas as health care, medical research, human services, education and various other areas,"Rubenstein said.

Rubenstein did not specify if dog-related charities would receive funds from the trust.

Helmsley, who was sometimes called "The Queen of Mean," also earned herself a reputation as a serious dog-lover following her death and announcement of her trust.

The Humane Society of the United States said it hopes that some of the trust will still go to causes like combating dogfighting and puppy mills.

"Her fortune has the potential to do so much good for the animals many consider to be our closest friends and companions," HSUS President Wayne Pacelle said in a statement, as reported by BusinessWeek.

Trouble's fortune was depleted to a mere $2 million after two of Helmsley's children, who were left out of the trust, appealed to the judge. They were later awarded $6 million each, still leaving enough for their mother's beloved pampered pooch to live the good life.

Entrusted in the care of one of Helmsley's former employees, Trouble began to receive death threats in 2007; now, she has a security detail costing the estate $100,000 a year.

The judge's ruling will not affect Trouble's rights to the fortune.

EVEN I DEATH WE NEVER GET THE LAST WORD OR WISH. I THINK THAT THE MONEY SHOULD GO TO ALL ANIMALS. THOSE KIDS ARE ANYONE DOESN'T NEED THAT MUCH MONEY TO LIVE. GET TO THE BASIC PEOPLE!

This is a tough one but I believe if she wanted her money to go to her dog and to fund other dog related charities, then that's where her money should go. I believe she was of sound mind when she made this decision and obviously her children were not there for her. Why should they benefit from her wealth? I think the money should only benefit animal related funds. We need so much help in this area - all over the U.S.

If her family wasn't there for her and in the end only wanted her fortunate than it's too bad for Trouble. Trouble was always there for her but were her children? I hope the funds go to what Ms. Helmsley desired.

I think the courts should follow her wishes. She wanted the money to go to dog related charities - who are they to deny her final wish?

It's too much money to leave to one dog, but the courts should follow her wishes as closely as possible.

Probably because she completely left her family out of her will - it gave them a loophole to contest it? I don't know - I do know though that alot of families go their own way and never visit an older member - never send a b'day card or bring cookies over and sit with them or nothing..... so when that older member passes - they think they are entitled to anything or everything that person had - when really it was never theirs in the first place? She probably thought that she had supported them their entire lives - she had made them who they were and they could take care of themselves completely .... so she was going to give her money to the things that she loved and felt loved by. Lesson to be learned - don't leave people out of your will - leave them a pttance so you are making a statement and they can't contest your will?

Yes, this way they could not claim that the Will was a result of the mental state of the person writing the it that cause them to be "forgotten". Though I will say, there is a lot of money in contesting a Will, for the Lawyer that is!

they should really give dogs money because that was what she wished for. the money that should of been given to her dog, trouble, went to the kids.

It's amazing how you can go the correct route,with the lawyer,Last Will,etc.,and your dying wishes are still changed because someone greedy,didn't agree with them.
 
Per usual, so much money went to fighting the will when it could have benefited humans and animals. R.I.P. Ms. Hemsley

How could they just go against a woman's dying wishes?!?! Whether she wanted to have that money be put underground for noone to ever touch or to go towards caring for her dog and other dogs once she passed, I don't feel that that is up to the courts to alter the nature of her intentions clearly outlined in her will. If thats the case then why even bother writing up a will?! This infuriates me!

I thought that someone's will had to be followed to the letter. How can a judge start allowing changes like this?

I don't think they have to followed to the letter. Wills are made to be contested. My father used to say "Wherever there's a will....there's a lawsuit." :-)

Unless they could prove she was mentally incompetent, I don't think they should've changed the intention of their will. (I'm surprised they could, legally.)

that was a lot for a dog, but i do wish the remainder would have gone to animal charities or research for animal's diseases. but i am really bothered by the dog getting death threats. are you serious?

I still believe that her wishes should've been upheld. I can understand how the family may have felt, but her money should've been used to help animals not humanes. THAT IS WHAT SHE WANTED FOLKS.

I get the courts ruling that her children should have gotten some of the money. However, why in the world are the courts overruling where she wanted the rest of the money to go. That is just so very wrong. It, IMO, means that a will is worthless.

First of all - what a nut case. There, got that off of my chest.

So I think a will should be followed. And as much as I love animals, I just keep thinking about how many humans this wad of cash could help. It's a sticky situation, that's for sure.

I dont think its fair that someone's dying wish gets changed. Her money should go where she wanted it to go and since she was such a dog lover, most of that money should go to these type of charities like she would have wanted. Its not right that it gets changed after the person dies.

Having a will is the only way that Laywers can still make money off you even after you are dead! They can then help fight to make sure you last wishes are NOT granted!

I think the fortune should go strictly to animal-related charities. This is what Ms. Helmsley wanted, and God knows there is a huge need out there.

Why should a judge decide where the money should go? If she had in her will that her children are to be left out and her dog should get it, then that is the way it should be.

How hard would it be to put a dog in a witness protection program? NOT! It's the handlers that you have to worry about, with the mouths!!!Pay them to go away ... start over with a "make over" dog and a rescue story and no one would know the difference! Little Troubles would live happily ever after without all the attention and have a normal life! I read a story a while back that the care taker of Troubles was sueing because she bit her, (just wanted a piece of the pie....) Trouble will always live a good life, but how much steak can a Maltese eat, how many bathes, ear cleanings, groomings, nail cutting and vet vists or change of bandanas can one have? It's the "humans" that are making it difficult!

I agree. What's wrong with it only going to dog/animal related charities? If that is what she wanted, then that is how it should be. I can't believe there were actually death threats against the dog! That's crazy...Trouble and his caretakers should be able to live untroubled lives.
