Court: Helmsley Fortune Goes to More than Dogs

NEW YORK -- The late Leona Helmsley's billion dollar fortune can now go to more than her beloved dog, Trouble, and other canines, a New York judge ruled yesterday.

When the real estate baroness and New York socialite died in August 2007, it was widely reported that her trust, estimated to fall between $5 and $8 billion, was intended to provide solely for dog-related charity organizations.

Her 9-year-old Maltese, Trouble, was initially left $12 million in Helmsley's will; that amount was later reduced to $2 million.

Now, Manhattan Surrogate Court Judge Troy Webber has ruled that the trustees of the Leona M. and Harry B. Helmsley Charitable Trust can decide which charities -- animal-focused or not -- the money should go toward.

Howard Rubenstein, the spokesman for the trustees, said they will announce their first grant in March.

"In hopes that this would be the court's decision, the trustees have been diligently working to identity potential grantees so the trust's funds would be put to optimal use as soon as possible, in such areas as health care, medical research, human services, education and various other areas,"Rubenstein said.

Rubenstein did not specify if dog-related charities would receive funds from the trust.

Helmsley, who was sometimes called "The Queen of Mean," also earned herself a reputation as a serious dog-lover following her death and announcement of her trust.

The Humane Society of the United States said it hopes that some of the trust will still go to causes like combating dogfighting and puppy mills.

"Her fortune has the potential to do so much good for the animals many consider to be our closest friends and companions," HSUS President Wayne Pacelle said in a statement, as reported by BusinessWeek.

Trouble's fortune was depleted to a mere $2 million after two of Helmsley's children, who were left out of the trust, appealed to the judge. They were later awarded $6 million each, still leaving enough for their mother's beloved pampered pooch to live the good life.

Entrusted in the care of one of Helmsley's former employees, Trouble began to receive death threats in 2007; now, she has a security detail costing the estate $100,000 a year.

The judge's ruling will not affect Trouble's rights to the fortune.

What a crock of bull. The woman made a will, and some judge decides it is not to be done as her request states. The trustee's and the kids, but most of all the judge are guilty of abuse to a dead person. Judges should interpet the laws as they are written, not as they think it should be.

I would be fairly certain, due to a cynical outlook, that the judge and the trustees of the fortune will be getting bonuses or kickbacks from the non-animal related "charities" that will be getting money. I don't know why the courts think they have the right to change the last wishes of a deceased person.

Lots of money but most people have a sure reason why they leave what and to whom. If it seems "odd," does not mean the one writing the will is mean or crazy.

Why all the stink about it going to animal related charities?? What is the big deal? It isn't like she intended to fund criminal activity or terrorism or something. It was her money and is should go to what she wanted it to go to.

I don't understand, if it is your money, and you take the time to make arrangements for it to be spent the way YOU want it to after you die - why is it that people can get that changed????? If she wanted it to be spent on animal related charities that is exactly what should be done! Heaven knows there is certainly enough need.

Sure hope some of her estate goes to dog-related charities. I realize how much people need help but think she was entitled to her final decision to provide for her dog no matter how crazy that may seem. She couldn't have been all bad if she loved her dog!

What's the point of having a Will if it can be changed anyway? Isn't this suppose to be your voice when your no longer here? It's her money, she earned it and she should have it go to where she wants it to go. Even if others don't agree, suck it up and honor her wishes.

Although I am sure that there are many worthy causes that need this money, I wish they would have honored her request. Maybe, with this infusion of money, whole cities could have been helped (dog rescues, etc).

Her last wishes should be granted, why make a will if the courts can come in and change it? If she wanted the money for her dog and animal related things, then that is where it should go. Yes it would be nice to spread it around to other causes, but that wasn't her last wishes...........

The entire situation is bizarre. I do not agree with the government deciding that the money does not need to go to "dog related" charities per her wishes. What is the point of a will.

No, the point of the article is that it's NOT going to the dogs as she wished--the judge ruled it won't all be going where she asked for it to go.

this is so strange, the dog doesn't even know what's going on. as long as he is getting food, water, a bed and a toy, he doesn't care where the money came from that pays for it. the dog should be adopted/taken care of and that person should pay for the dog's stuff. the money should be given to a human that can use it and understand what its use means.

This is what happens when crazy people have too much money. I agree with the idea that it was her last wishes, but I also feel that animal would never need that much money in his lifetime--I'm sure the "handlers" will get their piece of the pie!

It's a sad thing when people can change the final wishes of the deseased to whatever they want to and the courts will back them up. Didn't know it was legal.

Yet again the wishes of the deceased are superceded by a judge. Whatever you think of Leona Helmsley, she knew where she wanted her money to go ... to the dogs. I don't think others should have the power to change her wishes. This has happened so often in the last few years -- museums which decide to sell collections willed to them for exhibit, a bequest of land for a bridle trail turned into a general recreation area by a town. Soon people will cease leaving trusts which could finance the beneficiaries for many years and just leave the money outright to a charity. I certainly won't have much to leave, but I want it to be distributed according to my wishes.

I always thought that this woman was pretty wacky, and in all honesty, I don't think it's right to leave a sum of money like that to any animal. Not that the animal isn't worth it, but who ends up getting the money--the executors of the estate! I just hope they spread the wealth, so to speak, with other animal groups.

If this is where she wanted her money to go, then this is where it should go. Why would the courts overturn her legal desire? Also, why wasn't at court ordered that at least a certain percentage would go to animals? As I read this article, it seems they can use it for anything at all - to the point of excluding animals. Not right!

If Trouble's owner had wanted the money to go to shelters, she would have done so. I would put in Trouble's will what he wants to do with his millions - not take it away from him now!

It would be nice if the money was divided amongst all of the shelters across the nation, giving every shelter an opportunity to help animals in their area. It could be an animal "stimulus check".
