Court: Helmsley Fortune Goes to More than Dogs

NEW YORK -- The late Leona Helmsley's billion dollar fortune can now go to more than her beloved dog, Trouble, and other canines, a New York judge ruled yesterday.

When the real estate baroness and New York socialite died in August 2007, it was widely reported that her trust, estimated to fall between $5 and $8 billion, was intended to provide solely for dog-related charity organizations.

Her 9-year-old Maltese, Trouble, was initially left $12 million in Helmsley's will; that amount was later reduced to $2 million.

Now, Manhattan Surrogate Court Judge Troy Webber has ruled that the trustees of the Leona M. and Harry B. Helmsley Charitable Trust can decide which charities -- animal-focused or not -- the money should go toward.

Howard Rubenstein, the spokesman for the trustees, said they will announce their first grant in March.

"In hopes that this would be the court's decision, the trustees have been diligently working to identity potential grantees so the trust's funds would be put to optimal use as soon as possible, in such areas as health care, medical research, human services, education and various other areas,"Rubenstein said.

Rubenstein did not specify if dog-related charities would receive funds from the trust.

Helmsley, who was sometimes called "The Queen of Mean," also earned herself a reputation as a serious dog-lover following her death and announcement of her trust.

The Humane Society of the United States said it hopes that some of the trust will still go to causes like combating dogfighting and puppy mills.

"Her fortune has the potential to do so much good for the animals many consider to be our closest friends and companions," HSUS President Wayne Pacelle said in a statement, as reported by BusinessWeek.

Trouble's fortune was depleted to a mere $2 million after two of Helmsley's children, who were left out of the trust, appealed to the judge. They were later awarded $6 million each, still leaving enough for their mother's beloved pampered pooch to live the good life.

Entrusted in the care of one of Helmsley's former employees, Trouble began to receive death threats in 2007; now, she has a security detail costing the estate $100,000 a year.

The judge's ruling will not affect Trouble's rights to the fortune.

Whats the pointof having a will- a legal document- if the court is just going to overrule it anyway! I hope she haunts them!

Ouch! Where does the Court come off changing the terms of the will. Animal charities should be the beneficiaries of the remainder of the estate, not the choices of the children she wanted to disinherit. They received part of the estate, let them donate that portion to the charities of their choice. Why should their choice be imposed to override her wishes?

It's unfortunate that the judge didn't see how important animal related charities are. If her dying wish was to support animals why should that be taken away now. She was probably in a sound mind when she made the will why is it being questioned so much. Is it inconceivable to think that someone would leave billions to their pets?

This is a huge fortune. I think it should be used as she intended. Trouble should be well taken care of and the rest of the money could be used to help other, less fortunate dogs. Often, people with this much money do not realize that a little money can go a long way. The interest alone would support several shelters. Just use it wisely and help a lot of dogs have a better life.

MONEY SHOULD HAVE BEEN EARMARKED FOR DOGS IN GENERAL, IE; DONATED TO NO KILL SHELTERS ACROSS THE COUNTRY.

I hope there will be another update on this. There was a reason why her kids were lefted out. I did notice that when it was listing other uses like healthcare, research etc.. there was nothing there involving animals.

there sure was enough money to take care of the dog for life and to make a difference to alot of animal shelters and rescues.

I didnt know that the court could change a persons will and decide who the money should go to ....I really hope they do give the money all to local shelters and to to help against dog fighting and puppy mills....even though she was given the name of being mean, Im glad she was able to love animals and give them all such a gift

It really is silly to leave a fortune to a dog, but not to earmark it for animal related causes. Why should that not be okay.

although I think this decision by the courts is medley in personal affairs, it is quite rediculious to give a dog 12 million. And security detail costing $100k a year- outta control.

Obviously the dogs do not have lobbyists in Albany NY to fight for them. The kids already received their share, fair or not. Typical judicial overreaching. Now they are going to rewrite contracts (re: mortgage crisis). Moral of this tale (or should I say "tail"): Your money is not your own. The Government will tell you how to spend it, even after you are dead!

How can you go against the wishes of the deceased? It was her money and she wanted it to help dogs/animals? Who made that decision and who oked it?
 
I'd never do that to my parents regardless of how i felt about what they decided to do with their money.Greedy kids,I guess.

I GUESS IF I WAS HER FAMILY...I WOULD BE A LITTLE UPSET TOO AND FOUGHT. BUT IF SHE WISHED TO HAVE THE MONEY TO GO HER DOG AND OTHER'S THAN SOME DOES STILL NEED TO GO TO THE INTENDED CHARITIES.

While that is a lot of money, I think it should be used as she wanted - which was to help animals. Someone needs to look out for them and that money would go a long way to help animals everywhere.

None of her last wishes were meet. That makes me so mad. She wanted her money to be used for animals and now a board of trustees gets to decide who gets it. I am glad I am poor so I don't have to worry about this. Death is sad enough and when someone dies all the vultures come out. Ugh!

I don't understand how they can go against her will! It's sad because the dogs would appreciate it more than her greedy kids. Makes me think that she should have just donated a big portion of her money before she died.

Pretty sad when your own wishes aren't carried out, I'm sure when she picked her trustees, they knew of her devotion to animals, they could take that money and open a spay/nueter clinic in her name, so many, many pets would be helped and the population kept down, especially in NYC where she had her hotels.

I think making the donation while she was alive would have been a good idea. She could then have seen the wonderful things her donation was doing for animals. I think it is very rewarding to see results from your charity. The "Queen of Mean" had a soft spot for dogs.

I think it's wrong that it's being given to her family members when she made it clear she didn't want to.
I can't comment on her as a person but it's obvious she only wanted it to go to her dog.
I would say this even if it were a child she adopted a week before she died and she left her kids out of the will. It was her will!

This is just sad, she should have put the money in a trust ahead of time so it would have a better chance of being kept for the dogs.

Security for 100k a year.The lady was trying to make a point and help animals.Looks like everyone had to dip into it first.
I hope some of it goes for the cause she showed.

They should have honored this woman's wishes. I think its ridiculous that the court was able to decide what to do with her money after she specified what she wanted to do with it. She wasn't there to fight it and so it wasn't a fair fight. Boooo!

Her wishes should have been respected. If she left her money grubby family members out of the will, there was probably a valid reason why. I hope all that money will go to the dogs... just like she requested. I also think is wonderful that she left so much to the one being in the world who gave her love and comfort. He should have been allowed to keep the full amount.

It is encouraging to see that people who are deemed to be non people persons contribute to the world through a love of animals. Although, I do feel for people who are not socially happy engaging with humans, she has done much good for canines.

I do believe that leaving $12 million for a dogs care is a little eccentric...but should be honored. I do hope that with the revision of the will...they will give a large portion to animal focused charities.

Leona Helmsley wasn't a very pleasant person, but isn't every sane competent person entitled to leave his/her estate to whomever or whatever cause or person is chosen? I don't like that courts can decide to change the wishes of the deceased.
