Court: Helmsley Fortune Goes to More than Dogs

NEW YORK -- The late Leona Helmsley's billion dollar fortune can now go to more than her beloved dog, Trouble, and other canines, a New York judge ruled yesterday.

When the real estate baroness and New York socialite died in August 2007, it was widely reported that her trust, estimated to fall between $5 and $8 billion, was intended to provide solely for dog-related charity organizations.

Her 9-year-old Maltese, Trouble, was initially left $12 million in Helmsley's will; that amount was later reduced to $2 million.

Now, Manhattan Surrogate Court Judge Troy Webber has ruled that the trustees of the Leona M. and Harry B. Helmsley Charitable Trust can decide which charities -- animal-focused or not -- the money should go toward.

Howard Rubenstein, the spokesman for the trustees, said they will announce their first grant in March.

"In hopes that this would be the court's decision, the trustees have been diligently working to identity potential grantees so the trust's funds would be put to optimal use as soon as possible, in such areas as health care, medical research, human services, education and various other areas,"Rubenstein said.

Rubenstein did not specify if dog-related charities would receive funds from the trust.

Helmsley, who was sometimes called "The Queen of Mean," also earned herself a reputation as a serious dog-lover following her death and announcement of her trust.

The Humane Society of the United States said it hopes that some of the trust will still go to causes like combating dogfighting and puppy mills.

"Her fortune has the potential to do so much good for the animals many consider to be our closest friends and companions," HSUS President Wayne Pacelle said in a statement, as reported by BusinessWeek.

Trouble's fortune was depleted to a mere $2 million after two of Helmsley's children, who were left out of the trust, appealed to the judge. They were later awarded $6 million each, still leaving enough for their mother's beloved pampered pooch to live the good life.

Entrusted in the care of one of Helmsley's former employees, Trouble began to receive death threats in 2007; now, she has a security detail costing the estate $100,000 a year.

The judge's ruling will not affect Trouble's rights to the fortune.

However a person has their will, that's how it should be. Why would somebody pay an attorney all that money to draw up a will or a trust, and then it dosn't mean anything anyway. That is not Leona's intent. Doesn't the law mean anything anymore?

My goodness, I can't believe that Trouble has had death threats?? I hope the charities chosen to receive support include animal organizations, and that any money chosed for charities is put to very good use.

Awful. Now people involved in the trust will be taking luxury vacations with the salary from the estate. She left the greedy out of her will and I am sorry the courts set aside her wishes.

Yeah, it makes you wonder about you own will. But then, I'm sure none of us on this list are in the bracket that she was, so our wills probably won't make the news.

I'm not sure how I feel about this. Apparently it doesn't mean a thing if you have a will. Granted, hers was a lot of money and she cut out her children, but what's the purpose of having a will if they rule against it. They could do that with anyone's will. Better off to give the money away while you still control it, just to make sure it goes where you want it to. (Maybe ZooToo Shelter Makeover ??)

One thing that's true with all wills: the lawyers will always get their money, even if the intended recipients don't.

There was probably a good reason that the kids were left out of the will. It's there for a reason. But I am glad that the majority of the money went to charity.

I would imagine that her children were only interested in her money. It was her money and she should be able to do with it as she pleased. What good is a will when it can be broken. The courts should be ashamed.

The courts and children had no right to fight her will. Maybe the dog loved her for who she was and not what she had. Let's just hope the remaining money will be spent as she desired.

You know, maybe that dog loved her more than any human, including her family. It was her money she earned so she should leave it as she see fit. I do hope that the money will all go towards dogs or animals in general.

If she had a will, how did they override it?? I thought the point of wills was to avoid situations like this, where other people decide what they think should be done with your money regardless of what you actually wanted.

Ok, I get the "give the kids something" bit, but I think it's atrocious that someone can not have a Will without a court later deciding what to do with your money. What's the purpose of a Will then? I do hope the Humane Societies and Rescues at least get a portion. It appears to be needed now more than ever.

What is the purpose of a will if a judge completely disregards it and trustees are allowed to determine where to direct the funds??? Unbelievable, none of her bequests were honored.

My guess would be that her kids didn't deserve her money or she would have put her kids in the will. I feel that the courts had no rights to change it. We all should be able to leave our money to whom ever or what ever we want, without the courts being involved!!

I think the courts overstepped their bounds and who is going to fight for these anonymous dog charities? I think the money should go to the types of charities she wanted it to and her executor/trustees could decide which specific ones. Sad to see human greed. I don't know if she felt her children had enough money already or they didn't get along. Why bother to write a will?

I think the greed for money is unfortunate. The fact that someone's will can be overturned by the courts makes one wonder why to bother at all.....Too bad our laws have so many loopholes.........I do hope some of the money can 'go to the dogs"...........

I didn't think it was possible to change a will once the person had died... particularly if its just because of someone else's wishes. Very odd.

I started to think about this sometime ago, and the thing is she didn't say "I want my money to go to Charity "X", she just said she wanted it to go to dog charities. That's not good enough. You have to be exact when you leave something in your will. Yes, if your executor wants to honour your wishes, that's one thing, but they don't have to if it's it not exact. For example, I could say in my will "It's my desire that my executor donate some of my money to a dog charity", that means the executor doesn't have to do it. You really have to spell things out in a will. I was really annoyed over this when I first saw it, but when I looked into her will a bit more I can see what happened. It's a good lesson to all of us when it comes to writing our wills.

I'm not sure I understand how the court can rule against the will in this case. Seems like she knew what she was doing, and it's her money. I may leave my fortune, albeit small, to my dog. My kids had better shape up!!
