NY Bans Gassing Animals

NEW YORK -- Shelter animals in New York may continue to be subject to untimely deaths, but a new state law ensures they can only be euthanized in the most humane of fashions, and not through carbon monoxide poisoning, or gassing.

Governor David Paterson signed S. 4962-B, a bill co-sponsored by Assemblywoman Amy Paulin and State Senator Suzi Oppenheimer, into law last week, establishing a symbolic precedent for animal shelters across the state, according to Debra Bresch, the ASPCA’s Legislative Liaison for New York.

Only one New York animal shelter was still known to have utilized gassing as a means of terminating shelter animals’ lives, according to Bresch. However, Bresch emphasized, that fact doesn't undermine the significance of the new law.

“The passing of this bill is extremely important and precedential for its value,” Bresch told Zootoo Pet News. “It’s important for us to be able to say, ‘If this is the way the tide is going to flow, you can’t treat these animals inhumanely.’ Gassing does just that.’”

The Act, which amends the state's Agriculture and Markets Law, also stipulates that a only certified euthanasia technician, a licensed veterinarian, or a licensed veterinary technician, can perform intra-cardiac euthanasia, and that intra-cardiac injections can only be performed on an animal if it is heavily sedated, anesthetized or comatose.

New York joins West Virginia and Georgia in having passed similar legislation in 2009. Now 16 states, including New York, have some sort of ban on carbon monoxide gas chambers.

“Some of the pieces of legislation are more explicit than others, but that is definitely the trend,” explained Stephan Otto of the Animal Legal Defense Fund. “This year alone there were more states that contemplated prohibitions to this, as well as leaning toward more humane methods of euthanasia. It’s just increasing recognition of how horrific carbon monoxide chambers are for animals.”

Gassing of animals often results in slow, painful deaths, Otto said. “Our position -- and we are increasingly seeing more states adopt a similar stance -- is that we owe it to America’s animals to use the most humane methods of euthanasia available, when that is called for."

Bresch noted that gassing animals isn’t always an absolute means of killing.

“Animals can suffer if this is not done properly, and they may not be gassed entirely the first time around and then it has to be done again,” she said. “This obviously has led us and a lot of other people to consider how humane this treatment is.”

It also can be dangerous for shelter employees, according to Bresch, in case some of the carbon monoxide leaks into work areas.

The ASPCA has been lobbying for this bill for more than three years, after it approached Assemblywoman Paulin and asked her to sponsor legislation of this nature. Her support followed the ASPCA’s findings that some animal shelters were permitting insufficiently trained individuals to euthanize animals via intra-cardiac injection.

“When my veterinarian told me that euthanasia was not always a gentle way for animals to die, in fact, that if applied incorrectly, it could lead to excruciating pain in their final minutes of life, I knew we had to do something to change the legislation,” Paulin said in a statement issued by her office.

The Act calls for any animal gas chambers located within the state to be dismantled within 90 days of enactment, which was signed into law Oct. 9. It also says that no animals should be left unattended between the time the euthanasia procedure begins and death is confirmed. Violation of this is punishable by a civil penalty of not more than $500.

“We really want to make sure that this never becomes an issue again,” said Debra Lagapa, press secretary for Senator Oppenheimer. “The senator was thrilled that this bill was able to get signed into law. We see this as a great victory for animals across the state. No one wants to see these innocent animals put down, but it is necessary at times, and in that case we want to see that it is done in the most humane of fashions.”

Animal advocates, Bresch said, have remarked on how gassing -- as opposed to injecting an individual animal one has to actually face and encounter -- makes it easier for shelter employees to put down animals.

With this bill pushed forward and signed off on, the ASPCA is now focusing on passing a piece of comprehensive puppy mill legislation during 2009, Bresch said.

Good news would be all pet stores being banned from selling live animals and only being allowed to work with agencies for adoptions. If they did this for 3 years, many animals would no longer have to be killed.

Great News! Doesn't it cost more to euthanize animals this way? I think that this is so disgusting to put animals down in this manner. I hope it becomes banned in the US asap!

Thank you to Gov. Paterson, Sen. Oppenheimer, and Assemblywoman Paulin for seeing this as an important piece of legislation in NY. We've had plenty of political controversy this year in the NY state government, but some are still getting the job done!

I wish we could get ALL states to do this. After I have read the horrors that employees see when the 'job' isn't done right it makes me sick. Gassing has to stop everywhere!

No animal should have to die in a gas chamber. They are all individuals and deserve to have someone facing them in their final moments. I hope any state that is still using gas chambers follows NY's example.

i also agree. I hope that all states follow suit. Gassing is such a horrible, cruel way to die and the people at shelters who have to do it must be evil to listen to them cry and feel nothing. I hope this is a trend that catches on with governments in all states and soon. Just reading the article and thinking about those poor little animals still being gassed just breaks my heart.

I agree with you all too....it's so cruel to gas them like that....but we also, had a vet here in Tenn., that was just jabbing the needle into many of the animals at a shelter here. He was caught, and lost his license...thank goodness....but the poor babies he jabbed like that, it broke my heart.

I live in Garland TX where we are currently fighting CITY HALL on this very issue!
We attend the City Council Meetings. We protest. We send letters, e-mails, phone calls. City Council Members seem to think that Gassing in NOT inhumane. Unfortunately almost every animal that comes to the shelter is labeled a "pit mix" whether they are truly a pit or not and as a result, most animals are put down and they are gassed! Have sen them letters telling them that Pits do not go "MEOW!".
SO GLAD that NY has passed this law. Working to get TX to follow suit!
PLEASE JOIN OUR CAUSE! We need all the support we can get!

Another zootoo member alerted us to your situation. It is horrible that Garland, TX is still gassing animals. Hopefully, this bit of news will give open their eyes. We are all hoping you get them to stop this awful practice. Good luck!

Good for New York state. The practice of gassing in other states is far more prevalent than most people realize, and is by no means a "humane" ending. The shelters that do utilize this procedure do so for the low cost and to supposedly reduce the mental cost on the human who performs the euthanasia. Any one with any human feeling would not consider ending the life of an otherwise healthy animal due to space constraints of a shelter and lack of a permanent home as "humane". It is an unfortunate truth that so many animals are euthanized daily in animal shelters because the one time "owner" didn't spay or neuter or want to keep the animal any longer.

exactly.. we will always need shelters and rescues but all no kill.. but the biggest obstacle is human greed and ignorance.. and that has been around a lot longer than anything.. I pray one day the people that want to make a difference outweigh those who don't care and we can have our no kill shelters and the rescue numbers would be down to a reasonable and manageable amount.. we have rescues having to turn away any new dogs and cats because of the lack of foster homes and funds and I am sure there are many more across the country

It amazes me to no end that it has taken this long to open peoples' eyes. It saddens me to think that ANY animal will be euthanized because it is 'unwanted'. Hopefully, this legislation will continue a trend toward more humane treatment of shelter animals.

We had to put our 15 year old dog down in August and the procedure was very gentle and humane. I'm so glad she didn't have to suffer the fate that 1000's of dogs have with gassing. The thought of them suffering in their final moments made me sick.

I wish North Carolina would catch up with this decade, there are still at least 2 high kill gassing facilities, because I cant call them shelters, here. Rescues are doing their best to pull out animals, but they would have to pull 20-30 animals per week to save them all.
This whole practice is just mind boggling to me, supposedly the one reason they do it is because its cheaper then buying euthanasia drugs and training their employees.

Just reading some parts of this news story made me sick to my stomach. How can people be so cruel? If only people were educated to have their animals fixed, there wouldn't be so many and they wouldn't have to kill perfectly healthy animals. At least it's a step in the right direction to treat them more humanely, but much more has to be done so that innocent animals don't have to die at all.

I dont even know what to say because just thinking about animals being gassed and suffering is making me tear up.
If I worked at the shelters that did that I would not let it happen. I would have every dog in my house. I dont care what it took I wouldnt let them gas any pets.
