Free Speech v. Animal Abuse Images: Supreme Court Decides

NEW YORK -- In what promises to be a landmark case, the Supreme Court began hearing arguments, today, challenging the constitutionality of a law that makes it illegal to traffic in depictions of animal cruelty.

The case, involving a producer of films on pit bulls engaged in illegal fighting, has the rapt attention of both animal lovers and lovers of free speech nationwide.

The Supreme Court has not considered a challenge of this kind to the First Amendment -- which protects free speech in this country -- in more than 25 years. At that time, the court declared depictions of children engaged in pornographic acts to be outside of the protective umbrella of Free Speech.

Ardent defenders of Free Speech maintain that if images of animal cruelty images are deemed to be as vile as child pornography and obscenity, the federal government would be able to ban images of any illegal or offensive behavior.

The U.S. Court of Appeals for the 3rd Circuit in Philadelphia has already struck down the law criminalizing videos of animal cruelty. Now, more than half the states in the country have filed "friends of the court" briefs with the federal government to uphold the law and the conviction of the first man to be sentenced under that law, Robert J. Stevens. Though convicted in 2005, the Virginian has not served any of his sentence.

There are arguments on both sides of the fence. U.S. Rep. Elton Gallegly, (R.), who first introduced the bill which later was signed into law by Pres. Clinton in 1999, claims that incidents of animal abuse have declined with the reduction of videos and other images of animal cruelty.

But Stevens' lawyer has argued that there is a redemptive aspect to pictures and documentaries which portray cruelty to animals. She argues that videos depicting the clubbing of baby seals, for instance, have spurred animals lovers to action and to help pass the laws that have ultimately protected them.

She also maintains her client's videos of dog-abuse did not rise to the level of vileness of child pornography.

It's a very sad, sick world for animals. So many more advocates are needed to speak up for those who have no voice.

Hmm. That's actually a tough call. I'm all for freedom of speech, but I don't think that applies here, in the same realm of videod child porn or the committing of a murder or rape. Not for distribution.

However, as much as I don't want to see that, I can see the value (possibly) of showing - to a degree - the abuse to raise awareness and instigate action by the public. Just a difficult call, here. I don't want those with a sadistic nature to get ideas, either, or believe they'll get some sort of publicity, their fifteen minutes of fame.

Perhaps if it was restricted to educational/PSA films, requiring approval before public display?

Good point. I think these videos are horrible, but they cab raise awareness. I think it should be illegal for someone to produce and sell them, but not illegal to use for education.

Boy this is tough one. I know some cases would not get prosecuted were it not for the documentation of cruelty. So in that sense it is worthwhile. But of course that opens the door to photograghing abuse for video and crowd appeal. Let's face it, there will always be that disgusting element that likes to see other creatures tortured (Michael Vick)whether animal or human. I have mixed feelings on this.

I suppose that I may be asking too much if I were to say people should use common sense and make a case by case judgment. If animal abuse is filmed to take legal action against an abuser then used to inform the public I believe that is fine. I also believe that filming it for solely personal use or just to make money should be illegal. Unfortunately I find that common sense is sometimes lacking where laws are concerned.

If the pictures or footage is taken by the ASPCA then it can be used for educational purposes but if people are abusing animals and then filming it, that is totally wrong, wrong, wrong!!! But I agree that people learn by seeing and if they can see the horrificness of animal cruelty they will be more apt to change it vs. not really knowing whats going on behind the curtains.

Sometimes free speech goes too far. Unfortunately some sick people see these types of videos and get the oh-so-brilliant idea to make something like that themselves and sell it.

Stock video footage, already existing, can be used for animal welfare campaigns. Footage (perhaps undercover/hidden camera) of breaking-up illegal dog-fighting, puppy mills, etc. can be used in current context -- as it is not the generation of something new, but the end (hopefully) of something already existing.

ANY animal cruelty is wrong.

I see where they would say its going against the first amendment, but its cruelty to animals and its illegal anyways. So what is the real difference by telling them no. Especially with the illegal fighting. If its wrong then its wrong and there for should have no "loop hole" where in the future others could use this as an excuse to the footage or participation in animal cruelty...

i think there is a sizable difference between entertainment and educational. although many people will agree that dog fighting or seal clubbing is horrific and should be banned, most of those people agree in theory only. it's only a small percentage that are educated in any given matter of animal welfare and it's a constant battle trying to raise awareness on these topics already. people are visually oriented and removing the visuals will encourage less people to get involved. if the supreme court were to add stipulations to this rule, i would agree w/it's worthiness to be debated. currently, it appears to be either blackbox it as a whole or not at all. documentaries and educational literature are extremely important tools needed to support animal rights and i feel it would be a devastating blow to lose those.

Allowing animal cruelty films to be made and distributed says we condone these actions. Lets compare these films to snuff films, now does that make it more on a level playing field? Abuse is a crime, so if abuse is being used in films, then it is a crime. Freedom of Speech is been misused for so long that its meaning has been lost. It never meant we could do and say anything, it was there to protect our opinions so we could be heard. It was there to protect our right to defend ourselves without repercussions. It was not meant for scum idiots to twist our rights to suit their crimes. Vulgarity was never considered part of freedom of speech, as people didn't talk the way our world does now when our rights were born on paper. There comes a point when freedom of speech crosses lines, and for animals to have to suffer is a crime.....Plain and simple.

abuse is abuse if it is a child or a dog and for them to hide behind this law is crazy if i sit and think about it I can come up with a loop hole for everything this scum just does not want to do his time well I think him and his lawyer should have to go to jail just for being dumb this is what scares me if some one drugged me and raped me on tape and sold it would he get away with it because it is freedom of speech how about if they want to okay this guy and his tapes the Gov. are not getting their taxes from the sale of the tapes if they looked at it like that I bet that scum bag would be under the jail but because it is what they say JUST A DOG he gets to walk free this is crazy

You're exactly right. No one should profit by filming an illegal (or disgusting) activity. And the HSUS has proven that this guy has been involved in SELLING DOGS to dogfighters for decades. And now he found a new way to make money after they shut him down from that. I think I'm going to throw up.

I'm a supporter of free speech, but it does create loopholes for real criminals. I feel that animal abuse videos should be viewed like child pornography-outside the realm of free speech! It is unfortunate that some need to see such cruelty to fully realize the horrors & to take action against it. I fully agree with N. Cathy S.!

I honestly feel that that videos and pictures of these crimes should be brought out into the public! But, not in the way they are! They should be brought out as a learning tool or training device to better educate people about what is really going on.

The next thing would be for the abusers/neglectors not to be protected! If anyone is going to video or take pictures of dispicable acts against animals then, they should be made to report what they have witnessed. End of discussion!!!!! The fact that animals are being abused in this way and videoed for profit, is only hiding the abusers who will continue to do these horrific things and making them the wiser to hide it more.

If anyone should benefit from the profits of these types of videos, it is the shelters across the globe that have so many animals in their care! This is the only way I feel these videos should make any profit whatsoever.

i think that there is a diff. between just showing photos or video of animal abuse and showing it to educate people to be aware of what is really going on in the world and even in their own back yards. lets face it we show sex parts and everything else on tv but when it comes to showing how sick humans can be to animals we try and cover it up

i do think to correlation between child pornography and animal abuse is a perfect comparison.
just about every mom has a photograph of their child in the bathtub, but when you see a vile one of a child your skin crawls. now, should every picture of a kid in a tub be call pornography? to me this is the same argument. so should you have a video in the stores depicting a scantily clad woman in high heel drop kicking a 6 week old kitten because it is free speech? not hardly, but the same exceptions should be made for the tub pictures, when it is icky it IS….. the rescue group that houses the undercover video of abuse should not be arrested for having contraban.
life is not that easily compartmentalized.

By allowing the Patriot Act to go into effect, the Supreme Court has already devalued Freedom of Speech along with the rest of the Bill of Rights. Citing Freedom of Speech as a reason to allow people to profit from images of animal cruelty is disingenuous.

i saw a part of this video on the news last night. i think it is wrong to allow. they could however use it when rehabing people convicted of this crime to educate them on what an awful thing that this is.

This is just one more way for greedy people to make money at the expense of animals who cannot protect themselves. This man has been and still is involved in exploiting them for his own profit. Show them in the courtroom, and nowhere else. Documentaries? I don't think so.

I believe if he had shown how he saved the animals in questions - rather than just film them being hurt, it would be different. It is one thing to say you are trying to expose abuse and actively doing something about it. We are a society that values violence and the consequences - just look where money is placed.

I believe you have crossed the line for your freedom of speech the minute you are causing harm, abuse and murder of animals or anyone for that matter. There should not be any laws protecting people nor should anyone be allowed to profit from cruel and inhumane acts.

I do not believe that videos that contain animal cruelty should be sold for profit. I can see some use in releasing case videos or pictures but only as an educational tool to rally support against animal cruelty and only those done by police, aspca, and other agencies that deal in animal cruelty cases. I don't think amateur videos of any kind should be sold because you can't verify where they got the content and they may be committing the acts themselves. But I do believe if done by the proper authorities that pictures and videos are a very important tool in furthering the education and helping to finally end animal cruelty. There are a lot of stories I have heard that I just couldn't believe someone was evil enough to do something like that to an animal, then I saw the pictures.......Some people need that visual stimulus to be spurred into action. It is a terrible thing, but if people don't "see" it it will just go unnoticed and be swept under the rug and be even easier for people to get away with the evil and demented things they do to animals of all kinds. I think this is a deep issue and needs a lot of special consideration. If you can't show people how wrong it is and how evil it is, what is to make them believe you?

The only possible use I could see for pictures or videos of animal abuse would be to prosecute the abuser. Any selling of such material is just wrong and should also be illegal.

Animal torture is not free speech. I've been following this story on the HSUS website. Their president, Wayne Pacelle is attending these hearings. This Stevens guy has been involved in promoting illegal dogfights for decades, and was trying to cash in on selling these videos by calling them "documentaries". Please.

diane i agree it was a different world when freedom of speech was given to us. children and aimals are the innocents of the world and should be protected. i was shocked when my local news showed part of this video. it was on the 11pm news. i am hopinf that it is not reshown on the noon news today when more children are more likely to see it. it is bad enough the news shows all the violence that goes on in the world but i think with the way the world is today the freedom of speech should be revisited

diane another that needs setteling is the right to bear arms. the world is different today we do not need guns to get out food. thisis a horrible thing. even though my news did not show the whole thing i am surprised at them for showing it at all. sometimes they just tell you without showing the clips which is what they should have done in this case. i did not see it again on my noon news today and hope not to see it again.

Any video that promotes dog fighting or any form of animal abuse should not be protected as free speech. I hope the Supreme Court does decide to uphold the law that makes trafficing this garbage illegal.

he is very much a scum bag and no amateur videos even under the guise of documentaries should ever be sold for profit. Nor should animal abuse be protected under free speech. But, if done by the proper authorities you cannot dispute the effectiveness of images to help rally support in helping to end animal cruelty. I think that this needs a lot of special attention, because everyone knows that this garbage should not be sold for any type of gain, but if completely outlawed it could really set back the attempts of many to gain momentum in stopping dog fighting and animal cruelty in general. I sincerely hope they can find a way to ban the selling of these materials while still allowing police and aspca to use the footage for educational purposes. The problem with freedom of speech as pertaining to cruelty videos is that if they outlaw it entirely we lose a valuable resource but if allowed to continue many more people could make these atrocious videos for money.
