Foam Covered Kittens Survive Entombment

LAS VEGAS -– Accusations and denials continue to fly in a bizarre case out of Las Vegas where nine kittens, hiding inside a brick wall near an apartment complex, were sealed inside the wall by urethane spray foam.

Northpointe Apartment Manager Sidney Oliveira says maintenance worker Richard Carter intentionally tried to harm the kittens by filling in holes in the wall with the hardening, expanding foam. However, Carter claims it was a tragic accident.

But no one is disputing that the kittens were sealed into the wall on Friday, June 1, and were discovered that Sunday after an anonymous tip to Happy Home Animal Sanctuary, an animal rescue organization.

After arriving on the scene, Happy Home volunteers discovered the life and death severity of the situation and alerted the apartment staff.

“They were trying to cut away the foam, which took hours, because they couldn’t get through it,” said Oliveira, who responded instantly to the volunteers’ phone call. “And then I just started going crazy and sledge hammering the wall to get them out because I could hear them crying.”

Efforts to coax the kittens out through other holes in the wall failed. But it was not because the kittens did not want to come, rather because they could not.

“It wasn’t a case where their feet were in foam and they could run around with foam on their feet and it was really bad,” said Ginger Mundry of Happy Home Animal Sanctuary, who is now fostering eight of the nine trapped cats. “It was a case of the cats (were) literally stuck in foam and the foam was stuck to the ground.”

The foam, in turn, was hardened inside the wall.

Once the kittens were rescued, they were rushed into emergency surgery, with their health and survival in serious jeopardy.

“I don’t think that if we had gotten there on Sunday that they wouldn’t have been able to survive another day,” volunteer Kristina Wood said. “I don’t know how long a five-week-old kitten would have been able to live without food, water or going to the bathroom because the vet actually had to remove (foam) from there because it was all foamed up.”

While the kittens were saved from continued depravation, intestinal and bladder pain from not being able to eat, drink, urinate or defecate for three days, the rescue came in the nick of time for a miracle.

Mundry said it took more than 55 hours of delicate cutting to free eight kittens from being encased in the hardened foam. But for one little kitten, no amount of cutting could have saved it. The ninth kitten’s body was 100 percent covered in the foam and it had to be euthanized.

The survivors, according to Mundry, have fully recovered from the ordeal and are bouncing around her home like happy, normal kittens. While some of the kittens have been slow to pick up weight, all are healthy.

Those who will be first up for adoption around July 20 are Ranger, Floyd, Grace, Victoria and Twitch, who got his name because his tail would always twitch as Mundry and her husband cut away his foam.

But their siblings, Butterfly, Lucky, Sierra and Feebie, who are weighing in at about two pounds, will need more time before adoption.

The story has outraged many in the Las Vegas area, including Richard Carter’s former boss at the apartment complex.

“I know he did it on purpose. I know for a fact that he’s been complaining about those cats forever to me and he was saying he was going to put down a pesticide, broken glass, rat traps, etc. He’s been talking about it forever, and he finally did it.”

Carter, for his part, went on the local NBC newscast to proclaim his innocence.

He also blogged a denial on RichardLeeCarter.com, were he wrote, “I want you to understand that this incident was in no way intentional … This accusation has entirely turned my life upside down in a matter of days. And thanks to the lack of hearing my side of the story … everyone pictures me as this monster-like, cat hating type of guy and it’s unbearable … Again, I am truly, deeply sorry this happened to those poor kittens.”

He added that it would never have been an issue if apartment management had been willing to spend money to replace the wall.

“Due to the company’s lack of willingness to spend the amount necessary to properly and efficiently fix the wall, this was my way of doing this without spending large amounts of money.”

Oliveira says the wall didn’t need filling in. She read the blog and called it “a bunch of crap.” She also said she had driven him to a mental health professional in the past, and labeled him “unstable.”

Others close to the case wouldn’t comment, citing the continuing investigation.

Carter will make his first court appearance this month to be arraigned for five counts of animal cruelty. If convicted, he faces up to two and a half years in jail.

What a deeply disturbing story. If Richard Carter is indeed guilty of this heinous act--and my gut tells me he is--a cat hater and at the very least unstable--he should be found guilty on all counts (why only five I wonder) and sentenced to the maximum and then some! One happy note, the eight surviving kittens are up for adoption and hopefully will have loving homes forever.

First of all, using that kind of foam to seal up a wall is wrong. That is not the proper way. Second, you always check on to see if anything might be in there before sealing up anything.

This guy is so wrong on many levels. He needs to be charge with anything and everything he can be. And the judge needs to give the max sentence. I am just sick of folks who think they should get away with stuff.

This is absolutely APPALLING to me that someone could do this to these innocent kittens!! If they bothered him SO MUCH to the point of complaining about what he wanted to do to them to the residents, why didn't he call animal control to come get them?!?!?>!?! I hope he gets what he deserves and more!!!!!!!!! How can you POSSIBLY justify an action like this?!

That creep! He could have taken the kittens the the local shelter, he didn't have to seal them up in a wall. I think someone should seal him up in a wall and see how he likes it. I hope he gets jail time.

these poor kittens as the person below me said we can't help that kittens are born into the world as they are...........i just hope people are willing to help the less fortunate with their abitlity's and not make them suffer........because not all animals born into an outdoor world are abused i know i have outdoor cats because my mom is allergic and we live on a farm but all my cats are living happy lives.....sure they are not spoiled rotten but not all humans are either like some of us come from rich high society family's other's middle class and some on the poorer side but that goes the same for animals as well and we jst need to help out the world and make it as nice a place to live as we would like it

This guy is totally guilty- the only reason he is denying it is so he won't get in legal trouble. Most guilty people still deny their crime. He should have heard their cries or seen them or something- there is no way he is innocent.

This is horrible, no doubt about it. Unfortunately, feral kittens are sometimes (often?) born into terrible circumstances, their mothers "dropping" them wherever.

If she is the apartment manager, and he is a maintenance worker, why was he allowed to proceed with filling in a wall that she said "didn't need filling in..."? If Carter was so unstable, why was he still employed at the apartment complex and not undergoing treatment for his instability? I don't know if she was his boss or not, but whoever his boss was, if they knew of his mental instability, what was he doing working in what was apparently an unsupervised manner? If he had been making threats and "... talking about it forever," what in the world was he doing working there?

. A friend of mine in Oregon was having considerable repair and remodeling done to three different structures (with the usual noise, dirt, coming and going of work crews and equipment). The workers didn't hear anything, but they were used to noise for years and hard of hearing due to not wearing ear protection. My friend heard something IN THE WALL. They were just getting ready to apply the same insulation. My friend stopped them and a few kittens were extricated (I don't recall how many). Had it not been for my friend's better hearing, the same fate would have awaited those kittens.

Thank God the kittens were rescued (except the one that was too covered by the foam; I pray it didn't suffer long) and that now they will lead much better lives than those they'd have had if this had not happened. At least, to find a silver lining in this dark cloud, here's one litter of kittens whose lives are assured, complete with great homes!

Poor kittens!! That is so cruel! How do accidently do that to 9 kittens? That guy needs some help in the head.Well I hope the 8 kittens find a good home. It is very sad that the 9th kitten had to be put to sleep. Hopefully that monster will be put away for alot more than possibly 2 and a half years. That is basically a slap on the hand. No wonder there are so many cases. Animal abusers don't get punished and are allowed to go out into the world and kill more innocent animals. The justice system needs to change for animal murders.

This is horrible. I hate to be too quick to assume the man is guilty, but it's hard to argue that it would have been an accident. I can't imagine he had no clue they were there, and the end result is sickening.

I'm really having a hard time with this one. It's such a horrible act and I don't think it was accidental. It's amazing they survived and I only wish they could talk so they could tell what happened. I'll never understand the need some people have to be cruel to animals. I just don't get it and this one just makes my blood boil and my heart ache.

I had a cat my brother rescued when it was yowling in a neighbor's garage. No way on this good-green earth did he not hear them.
Even if he were charged with anything, it would be a slap on the wrist for him. It sickens me that this sort of behavior isn't punished more harshly.

How can you "accidentally" seal 5 kittens in a wall!? You would have had to heard them meowing or running around! Especially when the foam went in there! this was no accident he did this on purpose! Put him in jail forever!

I don't understand how this could possibly be accidental, that is alot of kittens to accidently do that to. I am so happy someone told about the kittens and got them help. It came just in time for them. I am so sad for the little one who could not make it. Some people are so sick. Those who mistreat animals can't be an angel to humans, I believe they are cruel to people as well. God Bless the people who saved these little kitties.

I'm tellin' ya what, if this loser did this on purpose, then that is the sickest, most inhumane and cruel thing to do to these poor poor precious kittens, who by the way are innocent, unlike this loser. Wonder where the mother went to, poor girl. How about just catch the mother and get her fixed? Wow, this is a super disturbing story, and except for the one poor sweetie, a happy ending for these wonderful kittens. I would love to put this guy in a wall and do the same to him... maybe not rescue him though....

I completely agree - whatever this guys punishment is, I bet it wont be harsh enough! In another article about this same subject - I also said the same thing - put this guy in a hollow wall and fill it with the same insolation foam and that would be justice for me and the rest of the animal lovers around - I will give you a helping hand in doing this, no problem as many other pet lovers would!

I am an animal lover but do NOT agree with your idea of "justice". There apparently are TWO groups of animal lovers: one that justifies their own cruelty toward animal abusers/neglecters and one that desires a true and rational sense of justice for the offenders. I belong in the latter group and have no desire to be associated with the former.

I agree! Two wrongs don't make a right. Honestly, part of me would love to punch the guys lights out, but I know that would just bring me down to his level. Its too bad he will only receive a maximum sentence of 2.5 years in prison though! I think the punishment should be more than that! Its disappointing how small the sentences are that animal-abusers have to serve.

it's mostly stills like the ones accompanying the article. You can see what some of the other kittens look like. But they also show the poor kitten who got completely sealed in. Poor little thing. I don't know how he lived long enough to be euthanized.

Sure, he didn't know those kittens where there. I'm sure they weren't crying at the top of their lungs as they were being entombed alive by foam. Whatever, I know that the law forbids cruel and unusual punishment for people, but I say we cover this guy with that foam for a couple of days and see how he feels about it. The fact that he saw this as a solution in dealing with some stray kittens is sick, wouldn't it have been less work for him to just call animal control? It really baffles me that there are all these people in the world that would do horrible things to creatures, just because these poor animals don't have a voice and they think they won't get caught. What else are these people capable of, what else have these people done and gotten away with up to that point, it is scary. I'm glad that these kittens found a voice in concerned residents and have finally found some happiness in their short little lives, hopefully they will find loving forever families and will never again know the horror that some people are capable of!

I agree that forhis punishment this guy needs to be put into a room that is partially filled with foam, just enough to keep him from moving without suffocating him and leave him there for a couple of days.

What type of human being could ever do something like this? Those poor innocent kittens were brutally trapped. It makes me sick that people have such unawareness about living things. I hope that this was really an accident because knowing that people exist out there with no compassion or conscience seriously makes me question humanity.

My opinion, if it were an accident he would have been the one to save them. I cant imagine that the kittens would NOT having been crying out as the foam stared to get on them especially to the point that they were unable to move!

Words cannot even describe how I feel about this horrendous act! I am SO glad that they were able to save those babies and sad that the ninth one had to be pts. This is disgusting! I hope the guilty party is punished to the fullest extent of the law!

Poor little baby tuxedos. It's so sad that one died from being sealed up like that. They need to throw the book at this jerk before he can do any more harm.

An anonymous tip was better than nothing, but why didn't the "tipster" take more drastic measures him- or herself to help save the kittens? The fact that someone was aware of the predicament the kittens were in strongly suggests that s/he knew it was deliberate--there would be no need to remain anonymous IF it were an accident. I'm glad most of the kittens survived and, hopefully, will recover from this irrational and insensitive act.

Even IF we give him the benefit of the doubt and assume that he did not know the kittens were there from the onset, he surely knew within seconds of spraying the foam and as he proceeded to seal the wall. His actions show a callous disregard for the kittens' lives. He can TRY to "save face", but he defaced himself. Accident my @$$!!!!!!!
