Foam Covered Kittens Survive Entombment

LAS VEGAS -– Accusations and denials continue to fly in a bizarre case out of Las Vegas where nine kittens, hiding inside a brick wall near an apartment complex, were sealed inside the wall by urethane spray foam.

Northpointe Apartment Manager Sidney Oliveira says maintenance worker Richard Carter intentionally tried to harm the kittens by filling in holes in the wall with the hardening, expanding foam. However, Carter claims it was a tragic accident.

But no one is disputing that the kittens were sealed into the wall on Friday, June 1, and were discovered that Sunday after an anonymous tip to Happy Home Animal Sanctuary, an animal rescue organization.

After arriving on the scene, Happy Home volunteers discovered the life and death severity of the situation and alerted the apartment staff.

“They were trying to cut away the foam, which took hours, because they couldn’t get through it,” said Oliveira, who responded instantly to the volunteers’ phone call. “And then I just started going crazy and sledge hammering the wall to get them out because I could hear them crying.”

Efforts to coax the kittens out through other holes in the wall failed. But it was not because the kittens did not want to come, rather because they could not.

“It wasn’t a case where their feet were in foam and they could run around with foam on their feet and it was really bad,” said Ginger Mundry of Happy Home Animal Sanctuary, who is now fostering eight of the nine trapped cats. “It was a case of the cats (were) literally stuck in foam and the foam was stuck to the ground.”

The foam, in turn, was hardened inside the wall.

Once the kittens were rescued, they were rushed into emergency surgery, with their health and survival in serious jeopardy.

“I don’t think that if we had gotten there on Sunday that they wouldn’t have been able to survive another day,” volunteer Kristina Wood said. “I don’t know how long a five-week-old kitten would have been able to live without food, water or going to the bathroom because the vet actually had to remove (foam) from there because it was all foamed up.”

While the kittens were saved from continued depravation, intestinal and bladder pain from not being able to eat, drink, urinate or defecate for three days, the rescue came in the nick of time for a miracle.

Mundry said it took more than 55 hours of delicate cutting to free eight kittens from being encased in the hardened foam. But for one little kitten, no amount of cutting could have saved it. The ninth kitten’s body was 100 percent covered in the foam and it had to be euthanized.

The survivors, according to Mundry, have fully recovered from the ordeal and are bouncing around her home like happy, normal kittens. While some of the kittens have been slow to pick up weight, all are healthy.

Those who will be first up for adoption around July 20 are Ranger, Floyd, Grace, Victoria and Twitch, who got his name because his tail would always twitch as Mundry and her husband cut away his foam.

But their siblings, Butterfly, Lucky, Sierra and Feebie, who are weighing in at about two pounds, will need more time before adoption.

The story has outraged many in the Las Vegas area, including Richard Carter’s former boss at the apartment complex.

“I know he did it on purpose. I know for a fact that he’s been complaining about those cats forever to me and he was saying he was going to put down a pesticide, broken glass, rat traps, etc. He’s been talking about it forever, and he finally did it.”

Carter, for his part, went on the local NBC newscast to proclaim his innocence.

He also blogged a denial on RichardLeeCarter.com, were he wrote, “I want you to understand that this incident was in no way intentional … This accusation has entirely turned my life upside down in a matter of days. And thanks to the lack of hearing my side of the story … everyone pictures me as this monster-like, cat hating type of guy and it’s unbearable … Again, I am truly, deeply sorry this happened to those poor kittens.”

He added that it would never have been an issue if apartment management had been willing to spend money to replace the wall.

“Due to the company’s lack of willingness to spend the amount necessary to properly and efficiently fix the wall, this was my way of doing this without spending large amounts of money.”

Oliveira says the wall didn’t need filling in. She read the blog and called it “a bunch of crap.” She also said she had driven him to a mental health professional in the past, and labeled him “unstable.”

Others close to the case wouldn’t comment, citing the continuing investigation.

Carter will make his first court appearance this month to be arraigned for five counts of animal cruelty. If convicted, he faces up to two and a half years in jail.

Poor babies. Of course, he did it on purpose. An idiot could understand that. People like him with the capacity to harm another living thing like this need to be in a straight jacket somewhere. What about Moma kitty? My daughter once brought home a kitten she had heard very faintly mewling and discovered buried in the ground (Bubba). It took the vet 30 minutes just to get the dirt out of the poor baby's ears and nose. I don't know how he managed to survive. But this---this is unspeakable, and he should be fired!

Okay, we are all recovered from vomiting now.

We use this foam stuff at the shelter to seal our walls and drains. It is nearly impossible to get off your hands, let alone cat fur. This man is sick and his intent was there, whether he claims it an accident or not. This stuff comes in a can, how could he have not known there were kittens in the wall when he sprayed it!

If indeed this was done intentionally it was a horrific event, to seal a living creature within a wall to die of starvation is an awful way to die. I also can understand the comment regarding rodents and how much anger would we have towards someone who intentionally did this to rats or mice. If you are putting foam on any living creature with the intent of causing a slow and horrible death it is just the same. Having said that I too feel that those sticky rat traps should not be used I think it does cause a lot of suffering.

i wonder how he would like to be covered with insulation foam and sealed into a wall? in these kinds of circumstances i say let the punishment fit the crime.

I agree that what he did was awful but I wonder, would people be so outraged if it had been nine rats sealed into the wall? People kill rats and mice every day but nobody blogs about the incredible cruelty of the individuals who do it. It always seems that pests are fine as long as they are cute. If someone found a dead rat in his washing machine, he'd worry about his washing. If he found a dead kitten in his washing machine, he'd worry about the kitten.

If people want this fellow's sentence raised for cruelty and threatening cruelty, then shouldn't everyone who has trapped a mouse, poisoned a rat, squashed a bug etc. also be imprisoned?

All life is sacred, remember?

What sickens me most about stories like this is that inequality. I don't think something like this should be done to any animal but the fact that it's only if adorable ones are hurt that they get any attention is disgusting.

Along these lines, I've often wondered why glue traps aren't illegal. It seems to me that if we are going to kill "pest" animals, the law ought to dictate that it be done humanely. As a rat fancier, I may be biased. But I agree with you that cuteness should not determine how we treat animals (nor should size). Rats and mice are mammals, and have the same kind of physical make-up that we do. Whatever would hurt us would hurt them. Seems like a no-brainer that we would want to knowingly cause suffering.

He should've checked to make sure there wasn't any animals in the wall before he started spraying the foam. Then when the kittens started crying (which I'm sure they did), he should've stopped and called someone. I hope that whoever was a part of this gets trown in jail for a few years.

"WHAT" else he has killed should be "WHOM" as living beings are not objects; and it's so sad that some people think human beings, who are also animals, have more intrinsic value than members of other species. I don't.

I wouldnt go that far. Humans are here as Stewards of the Planet, and all things therin. So yeah, what this guy did was terrible, and I cant believe it was an accident, but human life is interinsicly more important. I so find it annoying that they will spend thousands of government dollers giving total treatment including surgery for free to an animal with no home, and I can't afford health insurance for my kids. Although that issue is more a thing of bad government budjeting, cause I am sure there are ways to make health care affordable, and available to humans and animals alike. This is a case of cruelty, and the guy should face his crime, but I would indeed think it far worse if he had sealed up a human child in that wall. Also, the human child would have had less of a chance of survival, as we are far more helpless at that age then cats. As for sticky traps and other such things, I use sticky spider traps to catch and elimanate brown recluse spiders in my home. They prove a danger, and I would prefer they stay out of my home. I would not go hunting down spiders and rats in nature, but I'll tell you, if there is a bear that is sleeping soundly in his cave or wherever, and I walk up to him in his homeand thump him on the nose, what's going to happen? He's gonna maul the heck out of me! So if there are rats or spiders or such in my home, I have the right to remove the threat of poison and disease from my children and myself, just as that bear has the right to remove the threat of me from his den. That is where the equality lies. If there were a feral violent cat in my home, I would do what is nessesary to remove the threat. However, thoes poor kittens were not disease ridden, they were not feral, they were not anything that would qualify them as a threat, so they did not warrent such terrible behavior. But the bottom line is, not all creatures warrent the same treatment. If something is a threat to the health of me or my family, or anyone, I feel there is a right to remove that threat. As I mentioned before, animals have that same right. We should never abuse our position as stewards and caretakers of this plane, but we should not confuse our station out of an over exagerated sense of pity. We are not animals. There are definitive differences. They are innocent, we are not. They are natural, we are not ment to be. We have the potential for much greater things, they do not. We are their stewards. We are not them. Times have been that they have protected us from others of our species, but rarely do we protect them from anyone other then ourselves, (meaning humans). Everyone and everything has a place in this world. When we realize our place in relation to everything else, then things work out. When we abuse our power and authority, that's when chaos reigns and other species become endangered or worse. We are humans. Our place is to protect and improve this world. There are resources here for us to use. It's up to us to find ways to use the resources while doing the least harm. We can have our technology and protect ourselves, but we need to understand not to abuse that power. While man's best friend may be dog, cat, horse, or any other of natures creatures, (my friend has a turtle) we should not confuse our station with thiers. We are not equal, but we can be friends.

i would like to point out that if you read the article OR watch the video, you really dont need to do the other, because they are BASICALLY WORD FOR WORD.

i would ALSO like to point out that sydney oliviera does not sound very reliable, her exact words include "put down pesticides, rat traps and da da da." she doesn't sound old enough to be an apartment manager, she sounds like a college student who is describing why she is angry at her roommate. i get the feeling that she is saying what she's saying because she wants this guy to be blamed without question. and if this guy is so unstable, why was he hired/kept on staff? huh?

i am not inclined to believe her without seeing some sort of proof that this guy said these things -- she could be any chick in the world who is angry at this guy for what happened. unless she has some way of backing up what she is saying, i can hardly consider her a reliable witness.

She's not. This coming from a girl that thinks her job is so hard she has to leave work 2 hours after "starting" and go to the bar everyday- still collecting 40 plus hours worth of pay each week. One thing he did do was put out mouse traps. He had a bird that he didn't want anymore so he put it outside his door knowing someone would steal it (and they did). But he put mouse traps on top and around it just so it wouldn't get eaten in the middle of the night. Cats came around but none were snapped or even got close to the bird. And, she's twisting his words. He was made because the cats kept pooping in the bush below his window so when a breeze came in that;s all you can smell. He complained about it alot. He put out moth balls but when the lawnmowers came they kept bowing them away. That's gay she says he's unstable. He has depression and anxiety. When she says she had to drive him to see somebody isn't true in the way she says it. He was already seeing someone. One day she did drive him because he truck was broken down and he needed to get to his appointment for a refill. She doesn't say in there she told him to or that the only time she was there when she was trying to have a relationship with him. If she was that bad then why would she continually call him on the company phone and say how badly she wanted to be with him. All someone would have to do is pull the phone records from the beginning when she took over there and you would have all kinds of proof of that. It sucks though that she feels she has to get revenge in this way. It sucks even more that people I know know very well what happened and were witnesses to alot won't speak up because they still have a lease there or work there. I mean, don't get me wrong, this guy is an ahole but not in the way he's being accused. She thinks its funny and if he goes down I hope she gets the same thing. This girl thinks shes getting him back. She thought it was so funny too that she posted a picture of his mugshot on her wall for over a week just so she could laugh about it.

This is horrible!It is diguisting that people have such a disregard for a life,whether it be human or animal...it is still a life.This man should be punished to the full extent of the law,accident my but!!You don't accidentally do something like this!it is just horrible.Those poor kittens.

everyone needs to SHUT UP and let this guy get tried in a court of law. everyone who saw the title of this article already decided whether or not this guy was guilty without actually stopping to consider whether or not he was guilty. maybe he really didnt do it intentionally. ever think of that? maybe the people in the community really were taking the traps away and feeding the cats, thus prolonging the existence of a feral colony in the area and preventing the occurrence of fixing them. maybe animal control WASN'T helping. maybe the guy DIDN'T know the cats were there.

my next door neighbors boyfriend got mad one night and ended up BEATING THEIR DOG TO THE EXTENT THAT IT HAD TO BE EUTHANIZED. he ended up only getting 6 months in jail. its true that animal cruelty does not get the justice deserved.

BUT the speculation of this incident does not mean that this guy is cruel to animals. it just means you people all want to believe he is.

I, for one, think he is guilty. The manager or w/e of that place has many reports of him threatening to kill the cats. Then this "accident" happens? If it was actually an accident, bet he laughed. Eather way, it was his fault and I doubt he feels remors. He's guilty.

yes, because you reading about this on the internet means that you know SO much about all sides of the situation and are the VERY BEST judge for this mans guilt or innocence. and all the many things that may or may not have occurred prior to this event. i'm so glad that YOU are here to declare that yes, you think he's guilty!

all im saying is think for a goddamn second that perhaps theres more to the story than what you're reading here, and even more than whats posted on richardleecarter.com. think for a second that maybe, MAYBE, its a bit more complicated than "this jerk who hates cats who tried to kill them and laughed about it." i'm the world's BIGGEST cat lover and i'm giving the guy a second of reasonable doubt because all i know of the situation is this news article and the guy's blog, and thats not enough to make an accurate judgement.

and you know what? how about...YOUR opinion doesn't matter? how's that? how about go smack yourself in the groin with a sledgehammer, mr government? (shouldn't "thegovernment" be committed to justice and fairness through judicial means, not petty and uninformed slander on the internet?)

I find it hard to believe he did not know 9 cats were in the wall. 1, maybe. Possibly could be an accident. But 9?
If the feral cat problem is SO bad that he did not know 9 cats had climbed into the wall, the entire building along with every other one built would have cats entombed in every wall.
I don't believe for a second that he had no idea. Whether he did it with intention or not remains to be seen. I can see one climbing in and accidentally getting 'foamed', then one coming in after it and so on, but I don't believe he did not know about it. He had to have known, and he should have called someone for help as soon as he found out.
Anyone who would knowingly allow that kind of treatment, to any animal, is a worthless excuse for a human being. It's cases like this that I agree with someone from above, an eye for an eye. Entomb him in a wall of foam for a few days and see how he likes it. No food, no water, no way to use the restroom, no response to your cries for help.
Depression and anxiety are NOT a scapegoat. Plenty of people in this world have mental health issues, they don't go around hurting or killing people or animals alike and just blame it on their poor mental health. If that were true, half of the people out there would go around beating and hurting animals just for the hell of it. Stop blaming it on his mental health, it's a crock of shit.

I feel he is guilty, because of the reasons above. I feel it is impossible to not know there was at least one cat in the wall.

You do a good job of defending this guy. Maybe you are right and the people in the community were taking the traps away. I'm sure they guy could get the number to his local animal control office or shelter? Have you ever done construction or applied this foam? If so, tell us how you could do it without knowing there were 9 kittens in the wall.

Wait, there were nine kittens to begin with. One died in the foam, leaving eight kittens.

So why are there nine kittens up for adoption? Five are ready to be adopted, four are underweight.

Where did the ninth kitten come from?

While I'd love to be outraged about this story, it can't be as simple as they're making it seem, if they can't even count the cats.

exactly. this article is so quick to crucify this guy, but its very one sided and not even consistent. they had to jump and point every finger at this guy so fast that they couldnt even stop and check their facts -- not the facts about what happened, but just the fact of how many CATS there are!

Sadly I would say that this act was intentional. Almost everyone knows that they can call Animal Control and within a few hours they will come around and rescue feral animals. If they wanted the cats gone it would just take a phone call.

The thing is, you can't just remove feral cats. Cats are territorial and as long as the feral colony is there, the population will level off at a certain point and no strange cats will move into the area. But if you trap them all and remove them it creates sort of a territorial vacuum and more cats will move in where they had not been previously.

For anyone reading this who might be interested, look around to see if there is a trap-neuter-release program for feral cats in your area. Neutering or spaying a feral colony and then releasing it back into its original territory is a lot more reasonable and humane than treating them like roaches that need to be killed off.

I don't get people who think ferals are so dangerous. They aren't any worse than dealing with possums or raccoons in a city and in fact they're a lot *easier* to deal with because they are more likely to either be friendly to humans or to run away without confrontation. Coons and possums are bigger, meaner and wilder and can't be vaccinated against things like rabies, unlike cats. And they leave waste lying around too--guess what, it's the outdoors and nature, and animals do that. But nobody seriously suggests coons and possums should be wiped out, and that is the way it should be.

So we need to rethink our relationship to feral cats. I lived next door to a large colony for four years without incident and I tell ya, I would rather have had them around than some of the human neighbors I had to put up with. We need to get out of this mindset of "OMG! Four-footed critter that I do not own! KILL IT! Get it away from me!", because this is how cats get hurt, and sometimes people too.

THANK YOU for having more patience than I did and for speaking truth and wisdom to absolute ignorance and callousness. TNR is the only proven method of compassionate feral cat colony management and, as there are laws in all 50 states against cruelty to cats, it's the only LEGAL method, if people actually read the laws and adhere to them. www.alleycat.org

Unfortunately this isn't true, although I wish it was. There are about 50 feral cats living in and around my apt complex and I've complained to management a hundred times about them--they attack my dogs as I'm walking them, and I worry about my kids getting rabies or something from them. Apt mgmt said animal control told them they wouldn't pick up cats from private property unless they were humanely trapped first. I didn't believe that so I called animal control myself--same answer.

There are humane traps all over the place here, and those cats are smart enough to avoid them. It's frustrating as hell! And for every cat they do manage to capture, it seems like one or two of the females has a new litter of kittens to take its place. Talk about fighting a losing battle. Luckily my apt manager and maintenance man are humane people and don't put out poison or anything like that. These cats may annoy me, but I still don't want them hurt or killed.

There's no excuse for this kind of cruelty. I hope that it was an accident because I don't want to believe anyone could be so cold and cruel to living beings, but I've known enough sick people in my day to doubt his explanation. I'm glad most of the kittens survived and I sure hope they get good, loving homes that will spoil them rotten for the rest of their lives. They've earned it.

Please visitwww.alleycat.org and follow the links to contact them and they may be able to direct you to local rescuers who will come out and help to humanely trap them and remove them from what is obviously a hostile and dangerous neighborhood they do not belong in. And fyi, the incidence of rabies in cats is infinitessimally small.

Not exactly a good idea to help advocate MORE cruelty.

fyi, there are laws in all fifty states against cruelty to cats. That would constitute extreme cruelty.

Actually, people who are cruel and callous have probably had far too much violence and neglect in their own backgrounds. This society panders to it and rewards it. Time for a BIG change.

wow and he tried to say it was an accident! those poor kittens im glad they were ok though. too bad for that one. my question is how can anyone be so cruel to kittens? why not bring them to an animal shelter if they were bothering you? duh common sense.

In other responses, yes, I was, like many people, quite close to the situation. One thing I need to add in here, it was 6 kittens, not 9. Anyway, if you pay close attention to the pictures and video of the actual wall you will notice that there is a piece of carboard upon which the foam was placed. So ultimately, either the cats knocked it over while running through or someone had punched it through like they had many atimes. Many attempts were placed on capturing the cats and many phone calls to the animal control were made. None of the calls were helpful and people only removed the traps. The carboard was placed within the holes to reduce to amount of foam used. As for the holes themselves, they were filled in sections, not at once. So if this had indeed been intentional, the carboard would not have been placed and ALL holes would have been filled as to "trap" them as the accusations were placed. Any more questions. As a person, would you like to be accused of something and pay the price for something you in fact didn't do?

Funny, you say it's six kittens, but the story in fact lists nine and quotes Ginger Mundry of Happy Home Animal Sanctuary, who is now fostering eight of the nine trapped cats. She also includes their names and when she expects to offer them for adoption. Pray tell, what else are you hating yourself as you lie about?

It was 6 kittens. The maintenance worker that pulled them out along with ms ginger pulled out 6! If you look at the original newscast on channel 3, it too says 6. Maybe they decided to add a couple to the number so they could make people feel bad and take more of their cats. Who knows because when I called them they requested a $250.00 "donation" per cat. $250! So that means I have to pay them to take a freaking cat. What if ?I had 6 cats I had no home for? That's $1500.00 they want me to pay for cats they love so much. Its bull. Anyway, it was 6.

my boss (veterinarian) "asks" (charges) a donation when adopting out kittens, ranging from $30 if they're just started on vaccines to a lot more if they have already been spayed. i dont know who performed the surgeries on these kittens, etc, if it was a non profit organization or not, but if these kittens had to go through extensive surgery, i can see them asking for a large donation because the process of saving the cats lives was costly (in time and resources.)

You sound way to close to the situation. Frankly, it does sound to me like an "intentional" as 5 week old kittens are pretty active and can be quite noisy and you would think that the retard would hear the kittens in the wall. No, I think this guy needs to spend some time foamed into a jail cell. Actaully, sounds like it would be a good think if all the tenants did up and leave, as it would make the owner reconsider the management.

Your misogyny and slut-shaming have done more than anything else to convince me you hurt those kittens on purpose. See, you almost had me. I was almost at the point of "oh well, it's one side's word against the other and accidents happen, those poor cats, I'm glad most of them survived." Then I saw this rant of yours. You're all but throwing everyone else under the train to keep it from hitting you. That is not the behavior of an innocent person.

If by some chance you *are* innocent and are just a jerk as well, you're doing the exact opposite of making your case. So take a deep breath, gather your thoughts and try again. Try to sound like an actually decent human being this time. It's not that difficult.

You say you don't get how we all jump to one side of the story, yet, you're doing th exact same thing, hypocrite. If his boss said he heard the guy threaten to kill them, then it is so. What would he stand to gain by lying? Also, what's more plausible - the guy was "fixing a wall" with REALLY expensive binary expanding foam, or trying to get rid of the cats that he couldn't reach? His story doesn't hold water. Drywall and some 2"x4"s are much cheaper than polyurethane foam. Look it up.

Initially I was an avid supporter of this site, but after stories such as these it just broke my heart and sent me into a deep depression. How can people be so heartless?
I now spend more of my time doing instead of talking about helping these helpless animals and am proud to say the last female ferral in my area has been captured and fixed.

I read the RichardLeeCarter.com blog and I think that guy is full of it. I almost left a comment, but he'd probably just remove it since it wouldn't be supportive of the situation he is in. He's just another example of what some mean people will do to poor defenseless animals.

With his former employer's comments: "“I know he did it on purpose. I know for a fact that he’s been complaining about those cats forever to me and he was saying he was going to put down a pesticide, broken glass, rat traps, etc. He’s been talking about it forever, and he finally did it.” It seems to me that Mr. Carter not only KNEW the kitties were there, he probably put them in there himself.

you are basing this comment on his FORMER EMPLOYER'S comment? did this guy go on record saying these things before the act was committed, before this guy was being crucified for this act? no, he said it afterwards, i bet. here's a reason he could be lying: maybe mr. carter DID try really hard to help all these cats and the employer/management whatever wouldnt do anything, and now that this has happened they don't want any fingers pointed at them so they hang mr. carter for it.

you can't make a decision of a mans guilt or innocence on one person's comments! thats why we have legal trials!

Hmmm, this is very interesting I want to hear more about it before I make any calls. I am very interested to know what he will say in his defense...I mean You would think it would be difficult not to see 9 kittens, and if he truly had made threats before... But if he had made threats like that to his boss before wouldn't she have seen that as a warning and sacked him? I don't it sounds like we def. aren't gettingthe full story...I hope there is an update on this soon.

This is absolutely cruel and he is a Monster, he had options one would be to call animal rescue / humane society or someone to help get the kittens and find a home , that is so terrible for those kittens to be sealed like that and no water food and even having foam stuck in their bottoms where they were unable to use the bathroom. This sick person should also have to pay for the medical care and nourishment that the kittens will need . So sad a human being could be so cruel .

For him to say that he did not know the kittens were there is bull. You can see 9 kittens move around and make noises. Humans are the only species that are capable of harming for pleasure. I cant stand people like that. Since we know right from wrong we should use out energy to help the ones in need. Poor kittens, I am glad that 8 made it, and feel so bad that one poor baby had to die because of human stupidity, and cruelty.
Well the only thing I can say to the guy is to keep the BS to him self, because not to many people will believe it. Karma - one day this guy will get his.

How awful! I feel so sorry for the kitten that couldn't be saved, but am glad that 8 of them survived. If it wasn't for someone speaking up, they all probably would have died. I hope they are adopted into loving homes.
