Fla. ‘Spay or Pay’ Law to Control Animal Pop.

PALM BEACH CO., Fla. - Overwhelming populations in the animal shelters of one Florida county have prompted officials to make some major changes. Palm Beach County just enacted a mandatory spay or neuter ordinance for dogs and cats.

It’s one of the first ordinances of its kind in Florida. But across the nation last year, 32 other counties or cities considered similar “spay or pay” policies.

The new rules are being met with resistance from some pet owners and breeders.

The kennels at the Tri County Humane Society in Boca Raton Florida are often filled to the max.

“When we come in the morning, there are pregnant dogs tied to our fence, boxes of puppies, boxes of kittens on our driveway, on our laws,” said Jeanette Christos, Founder of the Tri County Humane Society in Boca Raton. “It’s very, very sad.”

TCHC is a no-kill shelter, but having to turn away pets because there’s no room often means they’ll end up in the hands of the Palm Beach County animal services; an agency that routinely has no option but to euthanize animals. Official statistics show the agency is destroying more than 16,000 animals each year.

“For instance, you will see a staff member taking the dog down the hall, it’s wagging its tail thinking it’s going on a walk, we’ll it’s going to the euthanasia room, and it’s going to be dead,” said Christos.

The new rules require all dog and cat owners in the county to sterilize their animals. If they choose not to, they will be charged, annually, for a $75 dollar permit and be required to sign an affidavit, a legal document, stating they will not breed their animals.

Owners like Judit Espina don’t agree with the county telling her she now must spay her dog.

“It should be private, especially if I take care of my dog properly,” said Espina. “If I don’t do it well, I have to do something about it or they have to do something about it. Because maybe later on I change my mind and I want to have dogs or something. What are they gonna do about it?”

The ordinance also places more restrictions on breeders. Many dog breeders and their national tried to stop the change, which commissioners voted on Tuesday. Through a statement on its Web site, the American Kennel Club urged its members to write the commissioners and voice their opposition.

The AKC believes the answer to overpopulation is strict enforcement of leash laws and other nuisance laws, saying that would prevent the accidental breeding of unwanted animals.

The mandatory sterilization ordinance will be accompanied by several free spay and neuter clinics in Palm Beach County. And a "Citizens Animal Patrol" would be created to help educate the public on the benefits of sterilizing their pets.

“I think it’s a great idea. I think there’s too many animals in animal hospitals that don’t have homes,” said Lisa LeVerrier, cat owner in Palm Beach Co. “And they needlessly get killed every year for no reason and the reason for it is that we have overpopulation due to not spaying and neutering early on.”

If the changes save one animal from falling to euthanasia in Palm Beach County; for people like Jeanette Christos, that’s a step in the right direction.

“I think it’s progress, if we can save one litter of puppies, one litter of kittens,” said Christos.

In the last year, lawmakers in 4 states considered state-wide mandatory sterilization laws. None passed. But similar legislation is expected to go before those 4 states again soon.

Something needs to be done in this country to help control the unwanted pet population. If it takes extreame actions such as this story, then so be it. There are way too many unwanted pets, it is sad and unfair. Too many irresponsible pet owners. Got to draw the line somewhere.

I just feel bad for the puppies and kitties that are being put down to "sleep". Really its the only choice though. I think this is a great idea. All the animals that I have ever had have been sprayed and it really isnt that bad. You dont have to worry about then going off to have "fun" then coming back with kittens or puppies that you either have to keep, sell, or send to the shelter. :)

So many unwanted animals and too few homes, at least in the southern part of the US. I wonder, though, if this ordinance is enforceable? Who will be checking on all the pets in that county?

The trouble is, not everyone licenses their dogs, and it's hard to check up on, unless animal control comes knocking at your door.
 
i'm sure, especially at first, that some animals will slip through the cracks, or owners will try to find loopholes. most importantly, they're trying to do something. it will start to make a difference, at least.

This is one law that needs to be passed everywhere!! I for one, am not very happy about the government making another law for us, but unfortunately there are so many ignorant people that these laws have to be put into effect.

This type of law needs to be inacted EVERYWHERE! Anyone that opposes needs to go to their local animal shelter and volunteer for a few days; perhaps that will change their mind!

These laws are the only way we are going to be able to stop killing so many animals year after year. I'll bet that the people that are opposed haven't spent much time at an animal shelter.

I like the idea of a mandatory s/n law.Their should be strong penalties for those that don't s/n.

This is a great idea! In my county in Michigan, a dog license costs $5 per year for a spayed or neutered dog with proof of rabies vaccine. The cost is $35 per year for dogs that have not been fixed. So it's a similar law, only Florida charges more. Great idea since we have so many unwanted animals.

We have similar rules for our licenses too, but it's $15 vs. $100.
They recently raised the price from $10 to $15 and the extra money goes to fund spay/neuter programs.
 
there's a similar policy on the outer banks, where i used to live.

It's a good idea. If the lady quoted above later decides to let her animal have offspring, that's just so many more that will be put out of homes one way or another.

If that's what it takes to make people responsible, do it!!!! I get sick of hearing about and thinking about animals having to be put down because of their irresponsibility.

Hip, hip, horay! I have been pushing for laws like this one for a long time. What's wrong with a breeder purchasing a breeding license. They sale pets for money so why not pay out a little money? The pets who are tossed aside would greatly appreciate it. If people can't take the responsibility on their own, then the law has to do it for them. Hasn't that proven to be the American way? Think about it.

Because this law does not allow for any breeders. Because good breeders LOOSE money on each puppy they produce. Good breeders do take responsibility for each puppy they produce. Good breeders will always take that pup back.

It DOES allow for those who are reputable breeders; they simply must pay a small 75.00 annual fee. What exactly happens to those pups they take back, anyway? You know, the ones that they cannot sell for some reason-maybe a minor defect, some other health issue-or, maybe they just can't sell him/her again for whatever reason?
What do these breeders do with them?

The good breeders will either keep them or resell them to someone else. They do NOT end up in the shelter system. The good breeders also spay/neuter all pet quality pups BEFORE they place them. Good breeders will NEVER place a pup in the shelter system. Depending on the problem they may take them to a vet to have them put to sleep because that specific dog may not have a good quality of life.

I think this is a wonderful idea. If it is so important to have a litter of puppies, the owner shouldn't mind paying for the privilage. They would have the puppies as soon as possible, to save money. I hope It works, some how we have to think out of the box to solve this pet over population problem. This is a fair start.

That's the problem. This law does NOT allow for any breeding at all. It makes you state if your pet is not fixed you will NOT breed it.

It says they place more restrictions on breeders, not that they outlaw them all together. I'm sure there is some kind of permit or license necessary to be a breeder.

Opps, I did miss that part when I read it. As long as there is a way to allow for good breeders to continue to breed then it alright. I would also think that good breeders are already doing what this new restrictions will state.

I think this legislation is AWESOME and am so glad to hear that it passed. I am keeping my fingers crossed that other states are soon to follow. This is a great step for pet over population.

I see Espina's point. However, I think that this a great idea! It would be great if this could spread to many other areas. If you really didn't want to get your animal fixed the fee is not all that high. I hope it works!!

THIS IS A VERY GOOD THING. I HAVE 5 DOGS AND THEY ARE ALL FIXED 3 CAM FROM FRIENDS THAT GET THEM THEM WHEN THEY ARE PUPPIES AND THEN WHEN THEY GROW UP THEY DO NOT WANT THEM AND THEY GET RIDE OF THEM NOT ALL PEAPLE NEED PETS AT ALL. THIS IS A VERY GOOD THING AND WE NEED IT ALL OVER.

I think it's a great law. It bothers me when I hear of someone's cat having umpteen litters of kittens because they say it costs too much to have their cats fixed, even though there are low income spay and neuter programs out there. As far as the dogs go, I honestly think the problem with them multiplying is not as bad as with cats, probably because there are so many places with leash laws and the fact that people tend to keep their dogs in the house. There aren't many places where you have to keep your cat indoors. Feral cats are rarely caught and just keep multiplying. As to the dog breeders, I think that any decent, caring, well run breeding business could afford to pay the $75 fee. Maybe this law will cut down on the horrible puppy mills and the people only out to make a quick buck at the expense of the dogs.

But the problem with this law is that it does NOT allow for the good breeders. It makes you sign a paper that says you will NOT breed at all, ever even if you keep an animal that is not fixed.

I like this law. I agree with exemptions for honest and ethical breeders and show dogs. NOT for backyard breeders out to make a quick buck.

I think it's a good idea, but will be hard to enforce. Spay/neuter programs are wonderful, but again, hard to enforce because there are too many people and often too few shelter workers.

I think it's a great idea in theory. They would have to figure out how to enforce the law and would also need to provide convenient and free or low-cost spay and neutering service. Those items would also be expensive, but would be worth the investment.

Great idea in concept, but what about rare or AKC certified animal owners who bought an animal to breed? If there were no breeders at all, where would the animals go. If they want to breed the animal, I say double the fee and let it go.

I would support this law for the regular pet owner, but I also think that there should be special concessions for those who honeslty and ethically breed animals, as well as for those who show their dogs.

I think that there should be a law on spaying and neutering dogs and cats that are ment to be house pets, because those are the ones that are being droped off the most.

This is wonderful! I wish every county in the country would follow suit. The millions of healthy adoptable animals killed in this country every year is a national disgrace. It's time to get serious about "fixing" the problem.

This is a great rule! I wish spaying/neutering rabbits was less expensive! They multiply, well, like rabbits, and too many unwanted litters are set free and end up dead. Florida is making a great choice!

Yes, actually Florida does have that right, since it is publicly funded(ie-tax dollars and state funding)shelters that are killing thousands upon thousands of abandoned animals each year here in this state alone, and it is time to end this madness NOW.

I say to those who don't want this law-go spend just one week in your local public kill shelter and assist with euthanizing all the dogs and cats that the staff are forced to kill because no one wants them-just so they can make room for more they'll be forced to kill in a few days again- and then come back and tell me you think it's a stupid or unnecessary law. Good and REPUTABLE breeders simply must pay $75.00 a yr-surely they can afford that.
Too many people think it's so cute to let their animal have at least one litter, or to "educate their children on the gift of life"....BS! Unless they keep every single one from that litter for LIFE, chances are at least one will end up in a kill shelter. Some gift of life.

It's time to educate, enforce spay/neuter and start saving lives instead of killing them.

Way to go Kathy, Couldn't agree with you more! Anyone who thinks this is a problem needs to spend some time in a pound or shelter and see the helpless faces and the rotating door of dogs being dropped off and of dogs be taken back to be gassed.

If this law is enacted everywhere there will be NO more companion animals. Is that what you want dogs and cats to cease to exist? This law states that NO ONE can breed for any reason. That is wrong. Good breeders must be allowed to continue breeding. It's BYB's and Mills that need shut down. Not the good breeders and this law does not differentiate between them. This law needs some work first.

According to this law, good breeders CAN continue to breed, they will just have to pay $75 per dog to do so. What's so bad about that? The price of purebreds isn't cheap. In fact, the breeders can just raise the price of their puppies by a little to offset the fee.
