Fla. ‘Spay or Pay’ Law to Control Animal Pop.

PALM BEACH CO., Fla. - Overwhelming populations in the animal shelters of one Florida county have prompted officials to make some major changes. Palm Beach County just enacted a mandatory spay or neuter ordinance for dogs and cats.

It’s one of the first ordinances of its kind in Florida. But across the nation last year, 32 other counties or cities considered similar “spay or pay” policies.

The new rules are being met with resistance from some pet owners and breeders.

The kennels at the Tri County Humane Society in Boca Raton Florida are often filled to the max.

“When we come in the morning, there are pregnant dogs tied to our fence, boxes of puppies, boxes of kittens on our driveway, on our laws,” said Jeanette Christos, Founder of the Tri County Humane Society in Boca Raton. “It’s very, very sad.”

TCHC is a no-kill shelter, but having to turn away pets because there’s no room often means they’ll end up in the hands of the Palm Beach County animal services; an agency that routinely has no option but to euthanize animals. Official statistics show the agency is destroying more than 16,000 animals each year.

“For instance, you will see a staff member taking the dog down the hall, it’s wagging its tail thinking it’s going on a walk, we’ll it’s going to the euthanasia room, and it’s going to be dead,” said Christos.

The new rules require all dog and cat owners in the county to sterilize their animals. If they choose not to, they will be charged, annually, for a $75 dollar permit and be required to sign an affidavit, a legal document, stating they will not breed their animals.

Owners like Judit Espina don’t agree with the county telling her she now must spay her dog.

“It should be private, especially if I take care of my dog properly,” said Espina. “If I don’t do it well, I have to do something about it or they have to do something about it. Because maybe later on I change my mind and I want to have dogs or something. What are they gonna do about it?”

The ordinance also places more restrictions on breeders. Many dog breeders and their national tried to stop the change, which commissioners voted on Tuesday. Through a statement on its Web site, the American Kennel Club urged its members to write the commissioners and voice their opposition.

The AKC believes the answer to overpopulation is strict enforcement of leash laws and other nuisance laws, saying that would prevent the accidental breeding of unwanted animals.

The mandatory sterilization ordinance will be accompanied by several free spay and neuter clinics in Palm Beach County. And a "Citizens Animal Patrol" would be created to help educate the public on the benefits of sterilizing their pets.

“I think it’s a great idea. I think there’s too many animals in animal hospitals that don’t have homes,” said Lisa LeVerrier, cat owner in Palm Beach Co. “And they needlessly get killed every year for no reason and the reason for it is that we have overpopulation due to not spaying and neutering early on.”

If the changes save one animal from falling to euthanasia in Palm Beach County; for people like Jeanette Christos, that’s a step in the right direction.

“I think it’s progress, if we can save one litter of puppies, one litter of kittens,” said Christos.

In the last year, lawmakers in 4 states considered state-wide mandatory sterilization laws. None passed. But similar legislation is expected to go before those 4 states again soon.

This is definitely a very controversial issue; unfortunately something needs to be done to help control the overpopulation and needless euthanasia of unwanted and discarded pets.

Pet overpopulation is definately out of hand & needs attention. I personally agree with spaying & neutering because so many animals die needlessly every year.

It's a good try but I doubt it will solve the problem of overpopulation. We need to come up with a really good method somehow.

I think anyone getting caught selling an animal without "show" rights and proof they are "show" material and not having them fixed EVERY WHERE in the U.S.A. should get a HEFTY FINE!!!! It's one way to control this over population of unwanted animals. I believe that all animals also need to be registered with some government agency!

I think that trying to register all animals with a government agency would be impossible due to the large numbers...that just won't help anyting.

It sounds like a great law, but how will it be enforced? It's a super idea, but I'm afraid it just won't work. I guess if even a few people spayed their pets because of it, though, that would be better than nothing.

Hope they get it fixed soon. Spay or neutered is the only way to go if you are not properly breeding.

There are too many animals being bred for the wrong reasons and are not ideal for breed standards. The idea of breeding is for the betterment of the breed not a quick buck. Many think their breeding stock is up to par but in reality they are blind.

Every state should have this same law! It's 2008 and people still treat their animals as yesterday's garbage. If people won't do what is right, spay and neuter, then they should be compelled. If they can't abide by the law, then they can get a stuffed toy.

i think that people should be forced to spay or neuter there animals then shelters wouldn`t be over crowded and dogs wouldn`t have to be euthanised.

An unspayed female dog or cat and her offspring can produce 67,000 puppies or kittens over a six year period (source: SPAY/USA)
That can be 67,000 euthanated animals. Wake up people you don't have the "right" to overpopulate your community with unwanted pets that are going to have to die, because you are too irresponsible

I think that everyone should get their pets spayed or nuetered. THe only reason there is shelters is because people breed too many dogs and there is not enough people willing to adopt them.

there is no reason that anyone's pet shouldn't be spayed or neutered! I think legislation and stricter laws are the only way to get people to really pay attention to pet overpopulaiton. Every state should adopt this policy.

GREAT IDEA!!! There are enough pets currently available for people to adopt without bringing more animals into the world to suffer. Hope this law passes in all 50 states.

i think spaying/neutering is a good thing it is healthier for your pet i had a female cockapoo i got her because she was my roommates and she never took her to the vet for anything which included to be spayed so when my roommate moved out she left Suzie and within a couple years she wound up with uterine cancer and i had to put her down if she had been spayed we wouldn't have that problem my sister had a male cockapoo who was never neutered and he got testicular cancer and died if he had been neutered he would not have had such a thing so it is much healthier for your animal to fix them but i also understand that some people don't like to be told that they have to do something or not so it is prinnciples

I agree 100% with mandatory sterlization of pets. There are way too many unwanted animals in this country and something has to be done about it. There are already a ton of discounted or free clinics that will help those that are unable to pay for the cost- even though if you can't afford a routine vet bill for an animal, you shouldn't own it. Hopefully this will help cut down on number of animals that end up homeless.

I really feel the AKC is countradicting themselves and their beliefs by being unsupportive of this bill. The AKC is all about preserving a breed and keeping it pure. Most unwanted litters are mutts (BTW, I hate that term).

If the AKC truely cared about preserving the breed then they wouldn't give papers to all of the puppies coming out of puppy mills thatallow dogs to breed with known genetic abnormalities. The AKC only cares about the money they get by giving papers to people that don't have to prove they are a responsible breeder.

Every state needs to do this, my friend and I are going to propose a spay and neuter law for Ohio. Its not the end of the world for these people they can still breed their dogs or leave the unaltered, they just have to pay. The AKC don't want this happening because they won't get as much money to register puppies because they think they will have a drop, they don't care about the pet population at all they just want some money. Shame on the AKC.

I think the intent of the law is good, but I think there will be big problems and cost with enforcement. I agree that a lot of irresponsible people that cause this problem will continue to ignore the law. How will you tell if someone's pet has been spayed or neutered? How much money is going to be spent hiring more people to enforce this law or handle the paperwork? Could that money be better spent? What about a pet registry system where resident buy color-coded tags for their pets with the fee based on whether the pet is spayed/neutered or intact? I hate the government enacting more and more laws restricting our rights, but I don't know what the answer is. I know that low or no-cost spay/neuter clinics help those pet owners who have a hard time affording pet care, but who love their animals.

The role of the goverment is to enact laws. What makes you think you have the right to allow your pet to contribute to the pet overpopulation problem. Stray un-altered dogs have been known to have aggression problems when there are female dogs in heat. You loose the "right" when your rights infringe on mine and others.

It's ridiculous that some owners and breeders don't want to comply with this law! If they don't want to spay or neuter, they should be prepared to pay the fees associated.

I very much agree on spay and neutering. When I got my 2 cats from the humane society I had to sign an agreement to have it done to my cats. I am not sorry either even though they do not go outside.I have neighbors who have 4 dogs and 3 cats and they leave 2 of the cats out all the time to roam all day and night no matter the weather. I wake up many mornings and they are sleeping on my porch. I believe if you have an animal I think you should treat them the way you want to be treated.

I wish more counties would do the same thing to control the pet population! People who have a problem with it should spend more time volunteering at their local shelters so they can better understand the problem.

There are always going to be people complaining about their rights, but so many do not care for the animals the way they should. I don't like the idea of the government interfering in our lives, but when there are stupid, irresponsible people, sometimes others have to step in. I say do it. Maybe if nothing else, those that can't afford or don't want to, will not become pet owners.

their shouldn't be one citizen that hasn't heard to spay/neuter their pets or is unaware that the shelters are overwrought with unwanted animals. people need to be more responsible for their own actions. sadly that isn't happening and now government has to intervene once again.

I don't think a law should be set for this. I understand its a problem but I think that only people who DON'T want baby animals should do it and that their vet should remind them each visit.

Otherwise its unfair.
