Fla. ‘Spay or Pay’ Law to Control Animal Pop.

PALM BEACH CO., Fla. - Overwhelming populations in the animal shelters of one Florida county have prompted officials to make some major changes. Palm Beach County just enacted a mandatory spay or neuter ordinance for dogs and cats.

It’s one of the first ordinances of its kind in Florida. But across the nation last year, 32 other counties or cities considered similar “spay or pay” policies.

The new rules are being met with resistance from some pet owners and breeders.

The kennels at the Tri County Humane Society in Boca Raton Florida are often filled to the max.

“When we come in the morning, there are pregnant dogs tied to our fence, boxes of puppies, boxes of kittens on our driveway, on our laws,” said Jeanette Christos, Founder of the Tri County Humane Society in Boca Raton. “It’s very, very sad.”

TCHC is a no-kill shelter, but having to turn away pets because there’s no room often means they’ll end up in the hands of the Palm Beach County animal services; an agency that routinely has no option but to euthanize animals. Official statistics show the agency is destroying more than 16,000 animals each year.

“For instance, you will see a staff member taking the dog down the hall, it’s wagging its tail thinking it’s going on a walk, we’ll it’s going to the euthanasia room, and it’s going to be dead,” said Christos.

The new rules require all dog and cat owners in the county to sterilize their animals. If they choose not to, they will be charged, annually, for a $75 dollar permit and be required to sign an affidavit, a legal document, stating they will not breed their animals.

Owners like Judit Espina don’t agree with the county telling her she now must spay her dog.

“It should be private, especially if I take care of my dog properly,” said Espina. “If I don’t do it well, I have to do something about it or they have to do something about it. Because maybe later on I change my mind and I want to have dogs or something. What are they gonna do about it?”

The ordinance also places more restrictions on breeders. Many dog breeders and their national tried to stop the change, which commissioners voted on Tuesday. Through a statement on its Web site, the American Kennel Club urged its members to write the commissioners and voice their opposition.

The AKC believes the answer to overpopulation is strict enforcement of leash laws and other nuisance laws, saying that would prevent the accidental breeding of unwanted animals.

The mandatory sterilization ordinance will be accompanied by several free spay and neuter clinics in Palm Beach County. And a "Citizens Animal Patrol" would be created to help educate the public on the benefits of sterilizing their pets.

“I think it’s a great idea. I think there’s too many animals in animal hospitals that don’t have homes,” said Lisa LeVerrier, cat owner in Palm Beach Co. “And they needlessly get killed every year for no reason and the reason for it is that we have overpopulation due to not spaying and neutering early on.”

If the changes save one animal from falling to euthanasia in Palm Beach County; for people like Jeanette Christos, that’s a step in the right direction.

“I think it’s progress, if we can save one litter of puppies, one litter of kittens,” said Christos.

In the last year, lawmakers in 4 states considered state-wide mandatory sterilization laws. None passed. But similar legislation is expected to go before those 4 states again soon.

Animal owners should be jumping at the chance to get there pets fixed. They are offering free spay and neuter clinics! It wont cost them, there pets will be happier and the population will be controlled. Its the GREEDY breeders with dollar signs in there eyes that is the problem!

It really is down to only two choices - force people to spay and neuter or build more shelters. The critters are just being critters.

I agree with this. I lived in california and we had to pay more for a dog or cat that was not spayed. if you are a breeder, you can afford to pay a price for being a breeder. breeders tend to make a lot on their pups. this will help keep numerous unwanted pets being put down in the shelters that are already overcrowded.

The breeders will scream about this and it most likely will not happen. I believe breeders should most definitely pay a LARGE fee, since they profit. It is unfortunate that the public at large needs a law to get them to spay and neuter, however it seems necessary. All people who object need to spend a day watching euthanasia., over and over.

This law is needed nationwide. No one wants to be responsible. If a cat or dog could decide for themselves, they would not want to have litter after litter, year after year. Its too bad we can't "fix" the idiot owners at the same time.

It is sad that it has come to this, government enforcing it, however, since people refuse to spay and neuter, I am in favor of this law. I agree with another poster, the people who object should spend one day in a shelter euthanizing healhty but unwanted animals. Breeders profit from puppies, they should have to pay and quit whining.

Great idea, but who or what agency is going to be responsible to follow up and see that the law is being carried out, in all instances.

i volenteer at the local humane society at least once a week. one day i will go in there and see the cutest puppy. then the next week it had to be put to sleep because the shelter was over populated. i wish kentucky had this law too. its a great idea!

I support this law because it is needed. However, the people that are knowledgeable would already have their pets spayed/neutered. Those that are willing and able to follow the letter of the law, will also do so. It is those folks that refuse to cooperate or do not have the funds to pay for a spay/neuter that will continue to be a problem. So, having the law on the books is just a start that needs to be followed with enforcement and assistance for those that can't afford the cost of a spay/neuter.

I would usually take the stand of less gov't involved in our personal lives, but this law protects innocent animals. I think it is a move in the right direction.

I just don't know if I agree totally with this. What if it is made mandatory for humans to be sterilized? Education is the key word for people.

It only would be mandatory to spay/neuter people when we started killing people because there were too many. After years of killing millions of people a year, someone would suggest sterilization. Sound familiar?

Okay, I'm getting near the end. But if those that are so upset about having to pay to breed their dog would just spend 1 day in a shelter...a kill shelter nonetheless....I would then have some slight respect for their opinion in this matter. Get educated and then express an opinion. Sorry, I had to get that out.

Still on the box. AND the responsible breeders who do it for the quality of the breed shouldn't be deterred by $75 or $500 for that matter. Wouldn't that be worth it to them to maintain the quality and reduce the number of "money" breeders from destroying the breed thru wreckless breeding.

Sorry fellow zootooers, but I've had a few more minutes to think about this and I'm about to climb up on my soapbox...again. So the breeders are angry about this. Why, because they have to pay to be able to breed their animals. Well, so what! They are the only ones making money from overpopulation. If the breeders were smart about this they would recognize that this will help them in the long run as it will reduce the number of backyard breeders who don't breed for quality but only for money.

Good for them! I guess the breeders will have to move to a different county or something. Something has to be done about the amount of animals being euthanized...opponents of the law should be required to be in the room when perfectly healthy, friendly animals are being put to sleep. I bet they'd change their minds really quickly.

its peoples own fault and its a great idea. my daughter works at a no kill shelter and have found people just throwing pets inside the door and running, boxes kittens and puppies thrown over the fence or just sat there, dogs tied to the fence and most of the older animals they get in a pregnant. we have fostered many animals, from mothers ready to give birth, to momma cats and the kittens who need care till they are ready to find a home, to animals that are young and found abondoned. if people would control their pets this wouldnt have to happen but so many innocent animals die because people dont think. those who breed for fun or just let the animal get pregnant because they dont want to fix the animal should not be allowed to have one. if you cant pay to have your animals fixed you shouldnt have them.

I think this is a wonderful law that I hope will be incorporated in more areas nationwide. I work with a group that tries to help spay and neuter stray and feral cats, as well as cats owned by low income people. It is great to make the law, but you also have to provide the resources, such as free spay/neuter clinics to help the poorer people get their animals fixed. It is often the people with the least resources who have the most animals and they will need help with this law. I think this is a step in the right direction, because it makes people realize how many animals are killed each day because there are too many. Spay and neuter laws could help prevent needless destruction of healthy, happy pets.

Absolutely, you have to make it affordable to those who want to do the right thing but can't afford it. Some clinics are charging upwards of $300 for the surgeries. It's almore becoming cost prohibitive for some and that will only increase our issues.

It is always so sad to hear that any animal must be euthanized because of human neglect, irresponsibility and ignorance. Obviously those who care for their pets properly know the importance of spaying/neutering their furry companions but those who don't often fail to do so because of the cost or worse yet because of some stupid myth about how the surgery will affect the pet.

...or they do it for money and don't sell to families who will keep their commitments. Irresponsible breeders should have to pay something too in order to deter those folks. Agreed.

You should spay or neuter your pet. It's a shame that this is what it's going to take to get pet owners to comply. You have to enact a law to make them responsible

If everyone kept their unaltered animals confined when in heat and kept the males under control then we wouldn't have any reproduction except for breeders who specifically wanted to have puppies and kittens. HOWEVER, that is not the case now is it.

I just don't think we need unaltered dogs around, secure or not. What's the point? Breeders is such a vague term and can include anyone from the responsible to the backyard variety.

PEople need to realize that these rules aren't being made because of responsible breeders and responsible pet owners. They are made and have to be made because there are so many pet owners who aren't responsible and are creating the problems that land in the lap of shelters to resolve....through killing.

I think this is a good idea... too many dogs and cats are PTS b/c there are just not enough homes for them all. Maybe that $75 fee can go towards building another shelter, or make s/n more affordable for those who can't do it, maybe use $$$ for humane education programs...

all states should require the pets to be spayed without a breeder licsence. it helps control the mass amounts of pet going to shelters and some dying!! help them out.

I think this is a good thing. The arguments people are presenting against it would only shift costs to other forms of enforcement, which themselves would cost more. We have seen that people are not responsible enough prevent this problem, so the authorities need to step in, and this seems to be an efficient way to do that.

the problem with this is government involvement and only the honest are punished. the ones causing the problems are not prosecuted to it is not effective, so punish everyone, america is getting kind of messed up

I agree. This is a very hard law to enforce, and those who are honest will be punished...But it is not hard to get your dog spayed/neutered. There are soooo many low cost/free services.

Wonderful!! I think this is a good start. $75.00 for the breeders is not bad either. But who is going to enforce it>> But this will help alot. Good job maybe some more states will follow

I agree we need to get dogs and cats neutered or spayed. There are far to many put down only because they are not adopted. The story goes on for every state, county and city. If an owner does not choose to spay or neuter their pets--they should pay a fine. We have owned several dogs over the years amd all have been fixed. In fact four of our dogs would have been euthanized had not we or a no kill shelter took them from county pounds. The killing of these loving pets must stop. Far too many people do not practice leash laws. Lets educate the general public and pass ordinances now!!!

"I feel so bad for the animals they'll have to be enthenized just because some idut breeder kept puttin boxes of pupieskittend etc. what if we said there going to be euthenized because animals kept breeding and setting boxes of people in front of there homes HOW WOULD THEY FEEL!~"

They aren't ignorant, they know what they are doing. Leaving the dirty deed to someone else and walking away. Cowards! Let them be someone elses problem and they don't have to think about it anymore. Some places have cameras and law enforcement gets their license plates and go after them for abandonment!

Unfortunately 16,000 is only one teeny tiny portion of the nationwide issues. If this scares you, don't go searching for the numbers of animals euthanized nationwide on just a daily basis!

I feel it comes down to, AGAIN, the owners responsibility. I don't believe in mandatory altering if the owner is caring properly for the animal. There should be more containment laws that the owner must follow otherwise pay a fine.

I think this is great! If the laws stop one dog or one cat from being brought into the world just to be disposed of like garbage then it is a success! The problem is too big and let's face it....poeple won't do the right thing on their own!

I don't find anything wrong with this law at all. I never thought twice about having my dog neutered. I hope it helps prevent healthy animals from being killed.
