Fla. ‘Spay or Pay’ Law to Control Animal Pop.

PALM BEACH CO., Fla. - Overwhelming populations in the animal shelters of one Florida county have prompted officials to make some major changes. Palm Beach County just enacted a mandatory spay or neuter ordinance for dogs and cats.

It’s one of the first ordinances of its kind in Florida. But across the nation last year, 32 other counties or cities considered similar “spay or pay” policies.

The new rules are being met with resistance from some pet owners and breeders.

The kennels at the Tri County Humane Society in Boca Raton Florida are often filled to the max.

“When we come in the morning, there are pregnant dogs tied to our fence, boxes of puppies, boxes of kittens on our driveway, on our laws,” said Jeanette Christos, Founder of the Tri County Humane Society in Boca Raton. “It’s very, very sad.”

TCHC is a no-kill shelter, but having to turn away pets because there’s no room often means they’ll end up in the hands of the Palm Beach County animal services; an agency that routinely has no option but to euthanize animals. Official statistics show the agency is destroying more than 16,000 animals each year.

“For instance, you will see a staff member taking the dog down the hall, it’s wagging its tail thinking it’s going on a walk, we’ll it’s going to the euthanasia room, and it’s going to be dead,” said Christos.

The new rules require all dog and cat owners in the county to sterilize their animals. If they choose not to, they will be charged, annually, for a $75 dollar permit and be required to sign an affidavit, a legal document, stating they will not breed their animals.

Owners like Judit Espina don’t agree with the county telling her she now must spay her dog.

“It should be private, especially if I take care of my dog properly,” said Espina. “If I don’t do it well, I have to do something about it or they have to do something about it. Because maybe later on I change my mind and I want to have dogs or something. What are they gonna do about it?”

The ordinance also places more restrictions on breeders. Many dog breeders and their national tried to stop the change, which commissioners voted on Tuesday. Through a statement on its Web site, the American Kennel Club urged its members to write the commissioners and voice their opposition.

The AKC believes the answer to overpopulation is strict enforcement of leash laws and other nuisance laws, saying that would prevent the accidental breeding of unwanted animals.

The mandatory sterilization ordinance will be accompanied by several free spay and neuter clinics in Palm Beach County. And a "Citizens Animal Patrol" would be created to help educate the public on the benefits of sterilizing their pets.

“I think it’s a great idea. I think there’s too many animals in animal hospitals that don’t have homes,” said Lisa LeVerrier, cat owner in Palm Beach Co. “And they needlessly get killed every year for no reason and the reason for it is that we have overpopulation due to not spaying and neutering early on.”

If the changes save one animal from falling to euthanasia in Palm Beach County; for people like Jeanette Christos, that’s a step in the right direction.

“I think it’s progress, if we can save one litter of puppies, one litter of kittens,” said Christos.

In the last year, lawmakers in 4 states considered state-wide mandatory sterilization laws. None passed. But similar legislation is expected to go before those 4 states again soon.

I support this fully. Someday I hope that my volunteer services won't be needed at our shelter. Pet owners should be responsible and have these animals fixed.

If theses animals are not of a specific breed and and bred due to bloodline and are show animals, I think they should be spayed or neutered because there are too many irresponsible owners out there.

Sometimes drastic measures are needed. They appear to be in this county. I'm glad to see they are sponsoring free neuter clinics.

I think it's a good idea but I am a little bit worried about laws that exclude purebreds and not mixed breeds. In the future will mix breed dogs become extinct and only purebreeds will remain. Some of the best dogs I ever had were mix breeds and of course they were always spayed or neutered.

I understood the comment that the woman made, that whether or not to spay her pet should be her business, and not the governments......and that would work, if people in general were responsible pet owners who would do the right thing. Unfortunately, that's not the case ~ as the employees of any animal shelter could tell you. Maybe people who feel like that should spend a month or so at an animal shelter ~ it would change their perspective!

What a great law! And they carry it a step further by providing free spay & neuter clinics. I can't get the image out of my mind of a dog walking down a hall with its tail wagging, thinking its going for a walk, but its going to the euthanasia room. Chilling! People hate the concept of "dead man walking" in the prisons. But what crime did the dog commit?? If you don't like mandatory spay/neuter, do you prefer euthanasia for these animals????

Good for these commissioners. I am glad that they are also sponsoring free spay and neuter clinics that will provide owners an option other than expensive veterinary service.

A law like this will help stop agencies from euthanizing animals. I think if there is an exception for licensed breeders only and then the law should apply to everyone else. It is very important for animals to be spayed and neutered so that no-kill shelters will not have to turn away animals.

I do not agree with this. If I had a purebreed animal that I wanted to breed I would not want someone telling me that I could not. This law will roll over to the responsible pet owners I am afraid.

I know an awful lot of people that think puppies and kittens are so cute, but people can forget they grow up to be dogs and cats and then what, no home, no care, no food and more puppies and kittens, begin again?

I think this is a great idea. There are too many animals without homes wandering the streets, starving, etc. The shelters are overcrowded and maxed out. If the no kill facilities are full these animals will end up being euthanized. We must spay and neuter our pets. Too many people think of breeding their dogs as a form of income. Sad.

As I've said on other comments, I have mixed feelings about this. I think it is a great idea to cut down the population & having an owner pay an annual fee to not spay their pet is a good idea too. But to make the owner sign an affidavit stating they will never breed the animal is ridiculous. I believe they should drop the affidavit & when & if we decide to breed our pets we should be required to let them know. If the same decision is made about the new litter then make us pay an annual fee for each individual animal. If something happens to one of them then we let them know.

couldn't agree more.......I think most people probably do agree but are too selfish because they know there are people willing to pay big bucks for animals....yet then there is a problem with all these animals in shelters....I think dog shows also play a role in the situation...people don't spay or neuter so that they can breed to make pure breeds but animals have a tendency to get out and mate and make mixed breeds too..then noone wants the mixed breeds..it's just a mess and people want animals for the wrong reason a lot of the time.

It is an excellent idea. The more that spay/neuter becomes viewed as "normal" the less people will object. Those who pay (and I believe it should be more) are breeding out of their own interest and the fee should go to efforts to help homeless animals.

We all know that spay/neuter is one of the two important answers for the over-population problem ~ along with education. Palm Beach is taking a very important step to help solve the problem.

Excellent idea. I hope that more states will follow. I am disappointed that the mandatory sterilization laws are meeting with so much resistence elsewhere.

It's so incredibly sad to hear what's going on with the unwanted animals and overpopulation...but this idea to encourage spay/neuter is excellent and I hope to see more areas of the country working to do the same!

More and more states, counties and communities are realizing the importance of spay/neuter to control over-population. That bodes well for the future. I wish Palm Beach luck with their new program, and hope that other counties follow suit.

The annual cost should equal the cost of spaying/neutering the animal and should be expanded to include rabbits...and should be collected if the animal is purchased at a pet store at the time of purchase also. Reimbursable if the pet is proven to be fixed in that case.

Palm Beach Florida has the right idea in enacting a mandatory "spay or neuter" ordinance. All cities should follow up with this idea "Spay or Pay".

I think this is good idea. However, I hope the county intends to provide a low cost spay/neuter clinic for people who cannot afford it. Otherwise, they will see many more animals in the shelters.

thank gosh! however, threatening their pocket book might not even work...many people don't spay because it is expensive for them at $70---but then again, why have a pet if you can't afford to care for it!!!
