Fla. ‘Spay or Pay’ Law to Control Animal Pop.

PALM BEACH CO., Fla. - Overwhelming populations in the animal shelters of one Florida county have prompted officials to make some major changes. Palm Beach County just enacted a mandatory spay or neuter ordinance for dogs and cats.

It’s one of the first ordinances of its kind in Florida. But across the nation last year, 32 other counties or cities considered similar “spay or pay” policies.

The new rules are being met with resistance from some pet owners and breeders.

The kennels at the Tri County Humane Society in Boca Raton Florida are often filled to the max.

“When we come in the morning, there are pregnant dogs tied to our fence, boxes of puppies, boxes of kittens on our driveway, on our laws,” said Jeanette Christos, Founder of the Tri County Humane Society in Boca Raton. “It’s very, very sad.”

TCHC is a no-kill shelter, but having to turn away pets because there’s no room often means they’ll end up in the hands of the Palm Beach County animal services; an agency that routinely has no option but to euthanize animals. Official statistics show the agency is destroying more than 16,000 animals each year.

“For instance, you will see a staff member taking the dog down the hall, it’s wagging its tail thinking it’s going on a walk, we’ll it’s going to the euthanasia room, and it’s going to be dead,” said Christos.

The new rules require all dog and cat owners in the county to sterilize their animals. If they choose not to, they will be charged, annually, for a $75 dollar permit and be required to sign an affidavit, a legal document, stating they will not breed their animals.

Owners like Judit Espina don’t agree with the county telling her she now must spay her dog.

“It should be private, especially if I take care of my dog properly,” said Espina. “If I don’t do it well, I have to do something about it or they have to do something about it. Because maybe later on I change my mind and I want to have dogs or something. What are they gonna do about it?”

The ordinance also places more restrictions on breeders. Many dog breeders and their national tried to stop the change, which commissioners voted on Tuesday. Through a statement on its Web site, the American Kennel Club urged its members to write the commissioners and voice their opposition.

The AKC believes the answer to overpopulation is strict enforcement of leash laws and other nuisance laws, saying that would prevent the accidental breeding of unwanted animals.

The mandatory sterilization ordinance will be accompanied by several free spay and neuter clinics in Palm Beach County. And a "Citizens Animal Patrol" would be created to help educate the public on the benefits of sterilizing their pets.

“I think it’s a great idea. I think there’s too many animals in animal hospitals that don’t have homes,” said Lisa LeVerrier, cat owner in Palm Beach Co. “And they needlessly get killed every year for no reason and the reason for it is that we have overpopulation due to not spaying and neutering early on.”

If the changes save one animal from falling to euthanasia in Palm Beach County; for people like Jeanette Christos, that’s a step in the right direction.

“I think it’s progress, if we can save one litter of puppies, one litter of kittens,” said Christos.

In the last year, lawmakers in 4 states considered state-wide mandatory sterilization laws. None passed. But similar legislation is expected to go before those 4 states again soon.

We must recognize we have way too many animals and not enough homes. This is a great plan. It bothered me that the owner said she may want to change her mind about breeding her dog. I bet she would change her mind about keeping the pups as well.

We always spay and neuter our dogs.

All pets should be spayed or neutered. More than a quarter of the animals in animal shelters and rescue groups are purebred. Ensuring that your pet is spayed or neutered is better for their health. It also curbs behavioral problems, particularly in male dogs. I am all for this.

I think every state needs this. It would do away with puppy mills and over crowded shelters. Since the number one reason dogs end up in the shelter is because owners are moving, then there will still be dogs to rescue so people aren't forced to go to breeders to obtain puppies.

This is a great idea, this should be done everywhere. There are to many pets being euthanized. If all pet owners were responsible it would be different.

I understand the overwhelming situation that the animal shelters are facing. It is truly a sad world when the government has to step in and tell us how to take care of our Pets. Spaying and neutering is a must for all responsible pet owners.

I personally think that there shouldn't be a choice in the matter of spaying/neutering your pet. Being a veterinary assistant this is a must. this will prevent the over population of the and prevention of so many unwanted and unplaned litters of felines and canines. just think there are well over a thousand animals all over the united states that have to be euthanized each year due to this over population problem that so many people cant seem to control.

This is both good and bad. All animal lovers should have theie pets spayed or neutered, but it should be their choice. Government should not take that choice away from us. But I know some people that have pure bred pets and breed them to sell. Isn't it better to buy a puppy from a local small breeder than from a puppy mill. Not everyone wants a dog from a shelter, not my choice, but some people want pure bred dogs and cats. When I was younger we bred our dog a few times and sold the puppies. And most of them kept them as pets. But I guess we were more responsible than some owners today. I just think you should have to choice to spay or neuter.

If you read the article they are allowing breeders to breed with restrictions and you also have a choice to pay 75.00 a year if you choose not to spay or neuter. I f you can't afford the $75.00 yu shouldn't breed because their are can be many unexpected medical bills with pregnancy.

sbraun, you are right that most owners now a days are not responsible. Some get an AKC from a pet store and think that is wonderful and let's breed it. They don't know it is from a puppy mill. The stores are not going to tell them that. If folks really were responsible breeders, then fine. But most are not.

This is a pretty dumb idea, wouldn't spaying cost more than a fine? And they shouldn't have to enforce this; they should just step up with programs and try to tell people to be better animal owners.

Depends on the area, but cat spay/neuters are cheaper in my area than the fine in this law. Plus there are lots of low cost spay/neuter programs to help out. What's $35 at a low cost clinic versus $75 every single year?

This wouldn’t have to be a law if all pet owners were responsible, but NOT ALL are.
Once again we see the masses paying the price for a few.
I also dislike the interference of the government, but on this issue, & after seeing all the animals that suffer due to irresponsible people I have to go along with it.
I hope the fees or at least part of them are going to shelter groups so as to even further help the animals.

Great Idea. There are way too many dogs and cats euthanized every year because of people who are either uneducated or do not care about the pet population problem. Maybe instead of charging for dogs that are not fixed, people with fixed animals should be rewarded, say charge $60 for the license fee, and $50 discount if you have proof of spay/neuter, and a $500 fine for all dogs that are not licensed. Sometimes if it is felt like a reward instead of a punishment, people respond more positively.

I'm torn between to much legeslation in people's lives and people not having enough sense to do what's right without there being a law. It might be alright if the fee charged those with unspayed or unneutered pets went to help fund shelters. I do think that when a person gets a pet they should have to fill out some king of a form in the city they live and have their pet identified with all the information on one of those implants.

Whether this law is the right way to go, it is quite obvious that something needs to be done.

This is a good thing. So many people just do not spay their pets, and the result is thousands of dogs and cats being killed in shelters that just do not have room.

I am soooooo glad this is happenening. So many pets are euthinized just because people let their pets walk around unfixed and they get other pets pregnant. Most cats will take care of their kittens, but theyll just keep getting pregnant, and owners end up abandoning them because they can't keep caring for all these kittens. Then, those cats get pregnant, and you are left with dead cats in the middle of the road and crowded shelters.

I'm all for it. I think it a great idea and it should be passed as law. I see way too many animals in shelters. I work with feral and stray cats, I try to domesticate feral kittens and then find them loving homes. The problem is that there are so many unwanted pets that there is no way I can place the ones I'm working with in to the shelter, or find loving homes for them. All this because of overpopulation. I see it everyday. Some people are so irresponsible as owners, and let their cats roam and get pregnant. For every kitten or puppy born today, cat or dog at the shelter will be put down. Lets all be responsible pet owners, and think of the poor shelter animals.

It would be a great start. Breeders should be able to have their kennels inspected to make sure they are doing things right to produce healthy, well socialize animals and pay some sort of fee to cover this and that could exempt them from the spay or pay law.
No one else should be exempt though. So when people decide to just open their doors and let their pets out, or move and not take their pets with them, those pets don't reproduce.
With almost everyone in such agreement that this could be a good thing, I wonder why counties and states are having a hard time passing such laws.
I hope this works and becomes wide spread across the country!
A few people not liking the idea is NOT worth thousands of pets suffering and being killed each year.

good concept, but not a reasonable request. i dont think that government should dictate who needs to have their pets steriled, but i do believe in sterilization myself, but ON MY OWN TIME LINE. I have responsibly placed 3 seperate litters of my own pups and made sure that all went to excellent owners and all the pups had the shots that were necessary before placing, checkin vet references on people that i didnt know, but mostly placing the pups with people that i do know. on the other hand i have also rescued 2 litters of kittens that were abandoned and had to provide medical care for them before being able to place them. I think a more acceptable solution would be fining the ones that are not responsible enough to care for the lives they creat instead of punishing everyone that wants to own a pet.

Thats great that you found homes for the puppy's, but for every animal born today another will be put down in a shelter, as there are no enough homes for them.

If you pay $75.00 a year they aren't forcing sterilazation. I think this is a fair exchange for you bring in three more litters of dogs.

Spaying or neutering is being a responsible pet owner. I think it's great that several clinics will do it for no charge. How tragic that so many animals for no reason are put to sleep needlessly.

This is the only way to control the unwanted pet population because most people won't do the responsible thing to spay and neuter their pets.
Where I live people are always trying to give away their pets on the Walmart parking lot. Last Sunday I was coming out of church and a girl was trying to give away 2 puppies. If only her family was bright enough to spay or neuter. The animal always pays the price!

i hope this is a 50 state law real soon. something has to be done and soon. the average class people have their moneys stretched to the limit. of course the pets will have to take the very back seat and they have to make out the best they can. these shelters are having a very hard time making it and donations are getting smaller. this is the only answer we have.

Some things has to be done. How heart wrenching when its the healthy puppies that must be put down. Why are people so irresponsible?

I think there are way to many unwanted animals in the world. Once we get a handle on all the strays and unwanted animals then we can think about breeding. However that is kind of a perfect world scenerio. It seems part of mankind is not responsible enough to have animals so we must enact laws.

I agree with you. The law soesn't say they can't breed they would just have to pay a fee, but I like you think their are enough unwanted dogs, and we need to control this before we bring any more puppies or kittens into the world.

More cities, states and towns need to have laws like this. Too many animals suffer because people don't care enough to get their pets spayed or neutered.

This law should be passed in every state. If all people were responsible there would be no need for the law, but that is not the case. Every law the government passes is because there is a need.

once ahgain a story where i am torn.. i think it would be a good idea in a way and not the mandetory way! but i also think if all states follow we will see a madjor drop in breed's to the point wher ein 30 years there will be no more of a surtan breed becasue mandetory spay and nuter law's. i am sorry but i would like my kid's and there kid's to still see the dog breed's. and if the breeders have to pay a ifine then the dog prices will go up too. and if you have to pay $500 to $1000 to own a dog then who will be abel to afford it?????? i know i would not i would have spend all my money on the dog / cat and not have money left to give them a great life with me.
