Fla. ‘Spay or Pay’ Law to Control Animal Pop.

PALM BEACH CO., Fla. - Overwhelming populations in the animal shelters of one Florida county have prompted officials to make some major changes. Palm Beach County just enacted a mandatory spay or neuter ordinance for dogs and cats.

It’s one of the first ordinances of its kind in Florida. But across the nation last year, 32 other counties or cities considered similar “spay or pay” policies.

The new rules are being met with resistance from some pet owners and breeders.

The kennels at the Tri County Humane Society in Boca Raton Florida are often filled to the max.

“When we come in the morning, there are pregnant dogs tied to our fence, boxes of puppies, boxes of kittens on our driveway, on our laws,” said Jeanette Christos, Founder of the Tri County Humane Society in Boca Raton. “It’s very, very sad.”

TCHC is a no-kill shelter, but having to turn away pets because there’s no room often means they’ll end up in the hands of the Palm Beach County animal services; an agency that routinely has no option but to euthanize animals. Official statistics show the agency is destroying more than 16,000 animals each year.

“For instance, you will see a staff member taking the dog down the hall, it’s wagging its tail thinking it’s going on a walk, we’ll it’s going to the euthanasia room, and it’s going to be dead,” said Christos.

The new rules require all dog and cat owners in the county to sterilize their animals. If they choose not to, they will be charged, annually, for a $75 dollar permit and be required to sign an affidavit, a legal document, stating they will not breed their animals.

Owners like Judit Espina don’t agree with the county telling her she now must spay her dog.

“It should be private, especially if I take care of my dog properly,” said Espina. “If I don’t do it well, I have to do something about it or they have to do something about it. Because maybe later on I change my mind and I want to have dogs or something. What are they gonna do about it?”

The ordinance also places more restrictions on breeders. Many dog breeders and their national tried to stop the change, which commissioners voted on Tuesday. Through a statement on its Web site, the American Kennel Club urged its members to write the commissioners and voice their opposition.

The AKC believes the answer to overpopulation is strict enforcement of leash laws and other nuisance laws, saying that would prevent the accidental breeding of unwanted animals.

The mandatory sterilization ordinance will be accompanied by several free spay and neuter clinics in Palm Beach County. And a "Citizens Animal Patrol" would be created to help educate the public on the benefits of sterilizing their pets.

“I think it’s a great idea. I think there’s too many animals in animal hospitals that don’t have homes,” said Lisa LeVerrier, cat owner in Palm Beach Co. “And they needlessly get killed every year for no reason and the reason for it is that we have overpopulation due to not spaying and neutering early on.”

If the changes save one animal from falling to euthanasia in Palm Beach County; for people like Jeanette Christos, that’s a step in the right direction.

“I think it’s progress, if we can save one litter of puppies, one litter of kittens,” said Christos.

In the last year, lawmakers in 4 states considered state-wide mandatory sterilization laws. None passed. But similar legislation is expected to go before those 4 states again soon.

I think there should be some laws made but I dont think the one they are looking at will help. the people that are taking the animals to the animal control or the puppies left in a box are more or less people that dont even get the animals their yearly shots. so do you really think they would pay the $75 dollars. We first need to stop the puppy mills. then from there go to the back yard breeders. If you tell everyone they have to fix their dog then thats wrong. There are good dog owners in the world still. --Cant punish everone for the stupid mistakes of others-- help stop puppy mills FIRST step

Does anyone have access to this ordinance? I would love to see it. We are trying to get Liberty County to do something similar. It would be great to see a reduction each year because of the responsible owners. oThe problem is there are alot of irresponsible owners that do not take care of their animals, that do not spay/neuter them or protect them from breeding. And then there are the ones that do tie them to the tree. Yes, it happens all the time, with notes in little boxes, and dying.. It is horrible.
I wish they would allow irresponible pet owners to go see the euthanisia process. It is not pretty, it is very sad to know that the only reason the animal is being put to sleep is because there is no room for it. It happens alot more than you could ever begin imagine. Millions of dollars are spent every year to put these abandoned animals to sleep. Let the counties and states start profiting off of the
fines, and licenses. And more than that, let those commissioners, senators, representatives come on out and put the needle in the vein and watch as they fade. And scoop them up and their feces because they in many cases poop as they die during euthanisia.

I think this is a great idea! I just don't understand why people would be against it. There are way too many animals out there already. So why to have more?

Judit Espina needs to walk one of those dogs to the euthanization room just one time and then look in their animal control freezer. Maybe then she will change her mind.

The AKC has one motive and it's MONEY.

Oh how I wish Texas could do this. It is so sad to see the amount of puppies that end up in our shelter. And it is even worse to see the amount of so-called pure bred puppies being sold on the side of the road or from the back of a truck in a parking lot. Impulse buyers are part of our shelter's issue. They see a cute puppy, buy it, and as soon as it chews up your remote, the puppy is turned in. Stopping the amount of irresponsible breeding would free up shelter space and fudning.

Good news. I wish other cities, counties, and states would take a up similar laws. As to the AKC, what idiots. They'd rather see thousands of dogs killed every year?

This is wonderful. Liberty County, Georgia is considering an ordinance of such.

It doesn't surprise me, though, that the AKC is totally against it. How much money do they make per year for litter registrations? The AKC should know that 25-30% of animals that come through US shelters are purebred! But what do they care, they go their money already.

I once again disagree with this previous poster. I think that this is a great idea! It should be a mandatory law nation wide. Since MILLIONS of cats and dogs are put to death every year in our country its obvious as a nation that we just don't get it.

- Who is enforcing this and how? I am sorry - but I see the solution to be public education and mandatory spay/neuter of SHELTER animals before adoption. I do not think the general pet owner or reputable breeder should be penalized.
You are not going to gain support for a problem by shoving fines and threats down people's throats.

Good idea but how is this going to be enforced? I can see a license tag with a symbol indicating spayed/neutered, but will this be issued by the shelter when adopted or by the vet who performs the surgery? Would a vet not treat an animal unless treatment also included the spay/neuter if the pet were intact? Would an owner not take the pet to a vet because the included spay/neuter could not be afforded or they just didn't want it done? My vet will, but does not recommend neutering a cat under 8 mos. of age. When I took my cat in, I knew why 6 mos. for a female, but why the extra 2 mos. for the male. He stated that he sees too many of the problems of early neuters - the male urinary tract is not fully developed. I've seen that "walk down the corridor" into the room, and through to the end of the process, the "storage" until pickup on Animal Planet. Years ago when I adopted 2 cats from a humane society in CA, I was given a certificate to give to my vet at time of spay/neuter. The vets in the county had all agreed to do the surgery for half price. I'd like the idea of the shelter charging for the surgery up front, you'd receive a certificate to give to the vet who in turn would send it to the shelter to get reimbursed. While I can't fault this ordinance for what it's trying to accomplish, I still think it could use some refinement.

This is exactly what my volunteer group is trying to do! I support this law and hope it becomes a law in ALL 50 states.

Shelters in all states in all areas are filled to the max. Yes, this is the right thing to do not only in Florida but in all states. People need to realize that animal over population is a major problem, and is only going to get worse. Spay/neuter is the only humane way that it is going to get under control.

This sounds fair.... if it it that critical to someone that their pet not be spayed or neutered they have the option of paying the extra $75 a year for a permit. So there you go... the right to choose and helps protect against unwanted offspring.

Some people do not want to be a part of the solution, instead prefer to stay in the dark by thinking they are not causing any harm.
Just one unspayed dog or cat can cause thousands of animals to be born.
Then what?????
Should we tell the shelter workers we are sorry they have to kill so many because it is better for the public to have the right to choose spaying.
Those days are over.
If I had a dollar for everytime a pet owner talked about the wonderful thing of witnessing the miracle of birth or for every male owner who didn't like the idea of neutering the families male dog. Then I would ask does the dog ever get loose, they Always reply," Yeah sometimes, but he always comes back"
Exactly what do you think he is out doing? He sure isn't out playing chase the squirrel if ya know what I mean.
