Familys Wins $9K for Dog Shot by Police

NASHVILLE – It was the judgment the Smoak family was hoping for, but not the kind they ever wanted to hear.

A federal jury awarded James Smoak $9,100 and found Sgt. David Bush guilty of using excessive force against Smoak.

The case stemmed from a traffic stop on New Year’s day in 2003, when the Tennessee Highway Patrol stopped the family on Interstate 40.

Mistaken as robbery suspects the Smoaks were forced out of their vehicle as a patrol car video captured the disturbing events that transpired.

The video shows the family’s pleas of protest that they were just vacationing and passing through on their return trip home to North Carolina.

The Smoaks then plead with the officers to close their car door. Their 55-pound mix breed bulldog, General Patton, was still inside.

“I got a dog in the car and I don’t want him to come out,” James Smoak’s voice is heard on the video.

But in the process, Patton escapes the car and can be seen on the side of the road wagging his tail. In a matter of seconds, a Cookville police officer shot the pet with a shot gun at close range.

Smoak tried to help his dog but he’s forced to the ground and injured by highway patrol Sgt. Bush. General Patton died on the spot and Smoak was lead to a waiting patrol car, crying “you shot my dog, you shot my dog! Oh, my God!”

The federal jury’s verdict settles the issue of excessive force used by Bush of the Tennessee Highway Patrol.

The city of Cookeville compensated the family more than $77,000 for their officer’s actions in a separate lawsuit.

Jerry Andrews, a lieutenant at the time of the incident, was also named in the case, but found not responsible, while Bush was the trooper responsible for handcuffing Smoak.

May I ask what you think is cool about this situation. Explain yourself, do you think it is cool to shoot the dog, or are you saying it is cool that the family was awarded money, which will not bring the dog back but they should sue the officer in a separate case. As far as I am concerned he is not an officer. He is a cruel, untrained, idiot wearing a cop uniform and gun happy showing his authority.

This is just such a tragedy, I feel so bad for the family. The money can never change what happened but it goes to show that police need to be held accountable for their actions. I really wish that zoo too would let us know if the responsible police officer was fired or not.

I would like to know also. I do not think he is fit to be on the police force. That gives the intelligent and professonal officers a bad name. Suppose the child had jumped out of the car crying and carrying on would he have shot the child? The dog was only wagging his tail.

I think he should be ordered to undergo some serious psychological assessment and certainly not carry a gun.

Hopefully, those officers will have been fired or reassigned to desk duty. Do we really need this kind of bullying?? I'm glad that the family was compensated.....although I'm sure it doesn't make up for their loss.

This cop should not be allowed to carry a gun, he's a menace. As far as the money, you can't put a price on a family member. I hope this cop gets fired.

Very good point. Obviously he doesn't know when to use it and is dangerous with it. Maybe he has skills that are useful to the police department but not dealing with stressful situations or pressure filled situations that could result in the death of an animal. Next time it could be a person.

This is a case for a citizens arrest. I usually agree with the police officers, but if I were there, I'd probably try to take down the police officer. This gets me angry just thinking about it.

However, most monetary judgments paid are decided by juries of our peers and the jury found that the family suffered emotional distress and excessive force was used against the dog. If it were your child (and I am not comparing the two whatsoever) thelaw entitles you to tremendous compensation from juries. We know animals are family members, and the verdict is quite reasonable. No amount of money can replace these people's pet. I don't care who you are, if a dog it truly not threatening there is no cause for this. These cops are trained better, and if not, do not deserve a badge.

That's what our firm works on every day. Pets are worth more than replacement costs. They are family members and deserve to be treated by everyone as such, even law enforcement, unless the animal is an open and obvious danger. The money awarded by the jury will never bring back the beloved dog, but the jury was trying to show that pets are not just pieces of property as they are defined by every state statute in the United States. I hope that the police officers involved in this disturbing story are fired, or at least are assigned to desk duty. They shouldn't be allowed to carry guns around unarmed citizens.

That doesn't mean that all police officers would do the same thing. I'm sure there are many officers in Nashville especially who are equally appalled as we are and are embarrassed and ashamed of their fellow officer.

This story is so awful. There is no amount of money that will take away the pain of a family watching their pet killed in front of them. I hope that officer was taken off the force. He should have to dig ditches the rest of his life.

Although from and living in New York currently, I lived in Nashville for a while, including at the time during which this happened. It was so sad that it happened, and really shouldn't have in the first place. Nashville has its fair share of hicks, just like the rest of the country, but is not made up of stupid people...the major difference is that they move, speak and act slower than many of us. They have enough common sense to realize when a dog is/isn't a threat, and it is heart breaking that this could have happened anywhere.

I think sometimes the law enforcement gets too caught up in the moment. Not saying they were right though, they should be punished, after all that is what training is for!

In Nashville no less. I would think they are not small town hicks. I hope this officer was removed from law enforcement and has some kind of jail sentence himself for the crime he committed against the dog. Are we supposed to trust officers? This tells me no!

These cops with anger issues along with power and bullying. It was all on camera. The cop should have been prosecuted just like any other person. No question he was guilty.
He should be fired and have it on his record for the next police dept he goes to. There is no excuse for this behavior. He should be made to pay this instead of the city (the taxpayer) Talk about Zero Tolerance..here's an example.

It seems that the police didn't have a real reason to shoot the dog, and they should have to pay, which is still a difficult thing for the family because it doesn't bring the dog back.

This must have been a very frightening time for the family. Sounds to me like the officer is too trigger happy. Thank God he did not shoot any of the people. And why did he pull them over and suspect any illegal doings just because a wallet was seen flying off the vehicle. The officer should have his badge taken away before he ends up hurting some. Does he perhaps just hold a dislike for animals (dogs) in general? A good punishment for him would be community service in his local humane shelter -- not with the animals (we don't need to punish the animals) - instead, he could better spend his time cleaning out their cages!

Money will not bring back the dog.....I think the officer needs to spend some time if not in jail then needs to do community service at a shelter.

This is so sad, money cannot make it better. I understand the police trying to protect, but they really need to make sure they are not harming innocent animals in the process.
