Familys Wins $9K for Dog Shot by Police

NASHVILLE – It was the judgment the Smoak family was hoping for, but not the kind they ever wanted to hear.

A federal jury awarded James Smoak $9,100 and found Sgt. David Bush guilty of using excessive force against Smoak.

The case stemmed from a traffic stop on New Year’s day in 2003, when the Tennessee Highway Patrol stopped the family on Interstate 40.

Mistaken as robbery suspects the Smoaks were forced out of their vehicle as a patrol car video captured the disturbing events that transpired.

The video shows the family’s pleas of protest that they were just vacationing and passing through on their return trip home to North Carolina.

The Smoaks then plead with the officers to close their car door. Their 55-pound mix breed bulldog, General Patton, was still inside.

“I got a dog in the car and I don’t want him to come out,” James Smoak’s voice is heard on the video.

But in the process, Patton escapes the car and can be seen on the side of the road wagging his tail. In a matter of seconds, a Cookville police officer shot the pet with a shot gun at close range.

Smoak tried to help his dog but he’s forced to the ground and injured by highway patrol Sgt. Bush. General Patton died on the spot and Smoak was lead to a waiting patrol car, crying “you shot my dog, you shot my dog! Oh, my God!”

The federal jury’s verdict settles the issue of excessive force used by Bush of the Tennessee Highway Patrol.

The city of Cookeville compensated the family more than $77,000 for their officer’s actions in a separate lawsuit.

Jerry Andrews, a lieutenant at the time of the incident, was also named in the case, but found not responsible, while Bush was the trooper responsible for handcuffing Smoak.

Only 9k? They should have been 9 million. This was beyoud belief and the trooper should have been fired and faced criminal charges. Tennesse should be ashamed and avoided.

The cop should be fired! He had no reason to shoot the dog. It's not like he tried to attack him. All he had to do was close the car door.

I hate to think what I would have done if they shot my dog for no reason. What in the world was wrong with this Police Officer. I am glad the owners won a lawsuit, but it does not bring their dog back.

I could not even begin to imagine what emotional distress the family is still suffering from this horrible event that took the life of their beloved bulldog. I'm glad the court realized that and awarded them money however that will not bring back their pet but it shows they were wrongfully mistreated and what happened to their pet was just cruel and unnecessary!

You are right that money will not bring back the beloved dog. However, most monetary judgments paid are decided by juries of our peers and the jury found that the family suffered emotional distress and excessive force was used against the dog. If it were your child (and I am not comparing the two whatsoever) thelaw entitles you to tremendous compensation from juries. We know animals are family members, and the verdict is quite reasonable. As an Animal Law Attorney, I am so pleased the jury found in favor of the family for their loss and grief. A dog, as most people believe, is a member of the family. The needless and sensless death of a beloved family member should not go unpunished. That dog deserved to live out his days and his family deserved his love and companionship. This is terrible. My brother was a sherriff officer and I never heard of anyone in law enforcement acting this way years ago. Seems like it happens all the time now. Maybe they'll think about doing it again since they have to pay for it now.

i don't know why the cop didn't close the door. these poor people are so traumatized. they deserve whatever money they have coming to them. i don't know why they couldn't so a simple thing like closing the dog

At least they got money for the other police offense. But it sucks that their dog had to die for such a stupid reason. And, after all that, they were innocent.

What a terrible thing to see your dog shot and killed by a Police Officer for no reason what so ever. The money won't bring back the dog but no one can do that. I hope this Police Officer is fired from his job .

It's sad that the dog was shot but we have to remember we weren't there so we don't know the full story. Police often get a bad reputation. But we have to remember that they encounter all sorts of bad people so they usually think the worst and hope for the best. Hopefully the monetary compensation will be of some consolation for the Smoak family.

The police have tough jobs under stressful circumstances, no doubt. But ignoring a family's pleas to close the doors and then shooting a dog who jumped out and was obviously friendly...just pathetic & disgusting. What kind of human being would do that? Power-hungry egomaniac...I'm glad his own cameras caught it all.

Who cares that the family got money. How is money going to get back or heal the loss of their dog. I really hope that those police men aren't in the force any longer. I mean come on...the dog was wagging his tail. They really over reacted. That really makes me mad.

The dog was wagging his tail. That should have shown the dog was being "friendly." These police officers need to learn that because they have a gun, that doesn't mean they can use it excessively. The money will not bring the dog back. The police should be punished. No amount of money could heal my heart if that happened to my dog.

this is so sad - money is not going to bring their dog back - i'm glad that the cop's video was on & working at least the world knows now what happened - it worries me that this cop is on patrol, if he shoots a SITTING dog at point blank what's going to happen when he is REALLY in a stressful situation - nothing would satisfy me though if someone shot my dog at point blank

COPS need to get a grip on reality. They are abusive and jump to conclusions. This is a perfect example.

If this cop had shot my dog no amount of money would help. I would want his badge and see his butt in jail for a long, long time.

I think that cop should be let out of his car wagging his tail and shot........That was no excuse for that at all....also that cop should lose his job over that....i feel so so sorry for the family....hopefully they can find another pet to help ease thier pain.
