Familys Wins $9K for Dog Shot by Police

NASHVILLE – It was the judgment the Smoak family was hoping for, but not the kind they ever wanted to hear.

A federal jury awarded James Smoak $9,100 and found Sgt. David Bush guilty of using excessive force against Smoak.

The case stemmed from a traffic stop on New Year’s day in 2003, when the Tennessee Highway Patrol stopped the family on Interstate 40.

Mistaken as robbery suspects the Smoaks were forced out of their vehicle as a patrol car video captured the disturbing events that transpired.

The video shows the family’s pleas of protest that they were just vacationing and passing through on their return trip home to North Carolina.

The Smoaks then plead with the officers to close their car door. Their 55-pound mix breed bulldog, General Patton, was still inside.

“I got a dog in the car and I don’t want him to come out,” James Smoak’s voice is heard on the video.

But in the process, Patton escapes the car and can be seen on the side of the road wagging his tail. In a matter of seconds, a Cookville police officer shot the pet with a shot gun at close range.

Smoak tried to help his dog but he’s forced to the ground and injured by highway patrol Sgt. Bush. General Patton died on the spot and Smoak was lead to a waiting patrol car, crying “you shot my dog, you shot my dog! Oh, my God!”

The federal jury’s verdict settles the issue of excessive force used by Bush of the Tennessee Highway Patrol.

The city of Cookeville compensated the family more than $77,000 for their officer’s actions in a separate lawsuit.

Jerry Andrews, a lieutenant at the time of the incident, was also named in the case, but found not responsible, while Bush was the trooper responsible for handcuffing Smoak.

my dad said that a dog is a family member and you can't put a price on that, so you would have to live with that for the rest of our life.

I can't comment on the use of force as I wasn't there. However, for the safety of everyone, the car door should have been closed to keep the dog in, even if it wasn't a threat to anyone.

i cant beleive this. a pet is a pet, no amount of money can put the love and care these people had for this dog.

Does indeed sound like excessive force, glad to see the family was compensated. But I wonder if the cop himself was punished at all for his actions? It takes more than just money sometimes to learn a lesson.

well here3 we go again a nother cop and another bad shooting. accept this time and inncoitan animal got hurt. and what does the the officers get? a slap on the hand and told not to do it again. if this was a normale person shooting a dog they would have gotten charges put on them. so why was"nt this officer charged with shooting this poor dog ? well we all know its because hes wearing a badge. i guess if you wear a badge you can get away with any thing. i"m glad the people got some money out of it.but money well never be able to replace thir family pet. i hope this officer gets fired that would get the point across. that just because you wear a badge you can"t do what ever you want.

No excuse for the excessive force used in this situation. A lovely dog shot for no reason at all. Had the dog been vicious or attacked the officer, it may have been different. I am sorry for the loss of this family pet and I hope law officer's will use better reasoning in future situations.

It would have been a whole different story if the dog was at a vicious state but it was only innocent. I am glad that the justice got his dues.

I remember hearing about this story. Unfortunately no amount of money can bring back a much loved pet. It's terrible the family had to see it happen. The policeman needs to be punished to the fullest extent.

These officers are just too happy to have a gun. There needs to be some restraint. I hope they are justly prosecuted.

I heard about this incident when it first happened. Thank you for posting the conclusion. Just unbelievable ! He should have been stripped of his badge and pension !!!!!!!!!!!!!!

What number would be you say is enough for the wrongful senseless death of a beloved faimly pet? $9k. That's noting to the police department's insurance company. Not even a dribble of a drop in a bucket to them.

This seems just a little extreme. How much money do these people want just because their dog got shot? I feel for them. Yes, it is awful that their dog was shot in such a sensless fashion, but over $80,000? Even when you add in the money that they do deserve for being treated with 'excessive force', that's a lot.

The family did not receive $80,000 for the death of their dog. That was the amount paid by the police department to family for excessive force and wrongful detention and infliction of pain and distress for the unlawful arrest that the people went through, not the dog. The dog portion was something entirely different. They onlygot $9,000 for the unnecessary death of their beloved dog. Animal Law Attorneys

OMG...I can't believe what i just read...that poor family!!!! I hope the officer has been prosecuted, he is a poor excuse for a human, let alone an officer of the law!

Unbelieveable! I watched the video and read the story. I just can't believe that this happened. Why on earth would the cop shoot a dog thats obviously good natured and wagging his tail and looks like he is ready to play ball. I think the family deserves more money, because their dog must have been like a family member to them since they took him on vacation with them. I know the money won't replace the dog, but it will make the county thats paying it out pay more attention to what is going on. Hopefully they will make sure it never happens again.

I'm glad for them, not because of the money but because of the POINT. I also think the officer should be fired or at least demoted. It's not like the dog was vicious.

I can't believe the dog got shot. I think that it was both parts fault. The police should of heard them out, but the dog should have stayed in the car. I don't think they deserved the money, but an apology.
