Familys Wins $9K for Dog Shot by Police

NASHVILLE – It was the judgment the Smoak family was hoping for, but not the kind they ever wanted to hear.

A federal jury awarded James Smoak $9,100 and found Sgt. David Bush guilty of using excessive force against Smoak.

The case stemmed from a traffic stop on New Year’s day in 2003, when the Tennessee Highway Patrol stopped the family on Interstate 40.

Mistaken as robbery suspects the Smoaks were forced out of their vehicle as a patrol car video captured the disturbing events that transpired.

The video shows the family’s pleas of protest that they were just vacationing and passing through on their return trip home to North Carolina.

The Smoaks then plead with the officers to close their car door. Their 55-pound mix breed bulldog, General Patton, was still inside.

“I got a dog in the car and I don’t want him to come out,” James Smoak’s voice is heard on the video.

But in the process, Patton escapes the car and can be seen on the side of the road wagging his tail. In a matter of seconds, a Cookville police officer shot the pet with a shot gun at close range.

Smoak tried to help his dog but he’s forced to the ground and injured by highway patrol Sgt. Bush. General Patton died on the spot and Smoak was lead to a waiting patrol car, crying “you shot my dog, you shot my dog! Oh, my God!”

The federal jury’s verdict settles the issue of excessive force used by Bush of the Tennessee Highway Patrol.

The city of Cookeville compensated the family more than $77,000 for their officer’s actions in a separate lawsuit.

Jerry Andrews, a lieutenant at the time of the incident, was also named in the case, but found not responsible, while Bush was the trooper responsible for handcuffing Smoak.

a good reminder that we all need to take a step back and think about what we're doing in stressful situations. I would not want to be in law enforcement, but some of those guys get so amped up so easily. How threatened could they have felt from a family pleading for their dog's life?

This is unbelievable. I think the situation, just escalated way out of control, but that is no excuse to harm an innocent animal. What an awful end to a family vacation.

I don't understand why this dog was shot. I know police are there to protect us, but this seems a bit extreme.

I hope if the people who's cat was shot by the cops decides to go a legal route that this story is used as precedence for excessive force against that policeman.

I think the officer should have ran the license before pulling the car over for an arrest. How terrible. I agree - the force was way excessive!

I think the settlement was fair. I'm sure it doesn't make the family feel better though. The officer could have handled the situation better. He should not be in law enforcement. He seems too gun-happy.

Also we don't know what sort of pressure the cop was under, what his past experiences have been with dogs, what sort of day he was having that might have put him this frame of mind, etc. We just know that we love animals and that this dog didn't act like it deserved to die.

There was no excuse to shoot this dog. Mistaking the family is one thing but shooting the dog is incredulous.

This doesn't say what effect the suit had on the officers career or the departments training policies. The money is one thing but changes need to be made to ensure it doesn't happen again

I don't disagree but also I think we need to remember that these guys are in harms way every single day...every time they put on a uniform and we can't appreciate the pressure that places on them. I find this action inexcusable, but it doesn't make most cops bad cops or bad people.

No amount of money will ever bring the dog back. The officer should have to undergo some psych evaluations. First a dog, then what next... I feel sorry for the family's loss.

Someone above thought there had been no justice but I'm with you that there has been some and I imagine that this didn't go unnoticed by police everywhere. I hope that it will make some think twice before they act or fire upon an animal. IT should.

Another example of the inflated ego of a law enforcement officer. There are some great ones, unfortunately there are some folks who just shouldn't be in positions of authority.

Not nearly enough money. I know there are a lot of wonderful law enforcement officers; however, there are some that should not be carrying a gun, let alone have a license for it. Very tragic.

Creeps! Stupid cop..I want to say more but might get booted! I hear of this kind of thing happening way to much.. Also, putting the family through false arrest..They did get another $77,000.00, maybe they got it for that.... I think this whole thing would cause some serious PTSD and horrible flashbacks.

At least they were able to successfully prosecute. How frustrating would it be to have this happen and then not be able to get any justice at all. At least the courts see the crime too...even if the money is small.

I'm glad that this went to a court of law. Yes, they did win a monetary settlement but the money will not take the place of their dog and you all know it. The victory is that this case went to court. The cop was wrong and needed a judge to tell him that! Some people are slow, you know!
