Familys Wins $9K for Dog Shot by Police

NASHVILLE – It was the judgment the Smoak family was hoping for, but not the kind they ever wanted to hear.

A federal jury awarded James Smoak $9,100 and found Sgt. David Bush guilty of using excessive force against Smoak.

The case stemmed from a traffic stop on New Year’s day in 2003, when the Tennessee Highway Patrol stopped the family on Interstate 40.

Mistaken as robbery suspects the Smoaks were forced out of their vehicle as a patrol car video captured the disturbing events that transpired.

The video shows the family’s pleas of protest that they were just vacationing and passing through on their return trip home to North Carolina.

The Smoaks then plead with the officers to close their car door. Their 55-pound mix breed bulldog, General Patton, was still inside.

“I got a dog in the car and I don’t want him to come out,” James Smoak’s voice is heard on the video.

But in the process, Patton escapes the car and can be seen on the side of the road wagging his tail. In a matter of seconds, a Cookville police officer shot the pet with a shot gun at close range.

Smoak tried to help his dog but he’s forced to the ground and injured by highway patrol Sgt. Bush. General Patton died on the spot and Smoak was lead to a waiting patrol car, crying “you shot my dog, you shot my dog! Oh, my God!”

The federal jury’s verdict settles the issue of excessive force used by Bush of the Tennessee Highway Patrol.

The city of Cookeville compensated the family more than $77,000 for their officer’s actions in a separate lawsuit.

Jerry Andrews, a lieutenant at the time of the incident, was also named in the case, but found not responsible, while Bush was the trooper responsible for handcuffing Smoak.

I don't like reading stories such as this one. People such as this policeman deserve more strict punishments, as animals are more helpless to defend themselves than anyone else and rarely given the respect they so deserve. For me, it wasn't enough!! That cop deserves to serve time for murder!

I know several officers from various levels of departments, and not one can I see being that ignorant as that officer - there was no point at all in shooting the dog! That poor puppy...

For once it's good to see the judicial system working correctly; I just wish it wasn't something so horrific that had to happen for that improvement.

What was this officer thinking? He certainly needs to be relieved of his badge for doing such a thing. Totally senseless & cruel. It could of been easily handled by shutting the car door when the family alerted them to the dog being in the car. I'm glad the family received some compensation for this although it will not bring their dog back. And to have shot the dog (for what reason?) before the owners is just traumatizing for them all. The officer should be fined & do jail time as well. NO ONE is above the law!

I agree with you. If they are this reactive with a family pet I wonder what he would do in a more stressful situation with a person or a child. I realize that the officers do not know most of the time how a particular situation will play out and must take the utmost caution but this was out of line.

I remember this when it was on the news. I usually support the police but in this instance these guys were jerks and didn't use any common sense. I would be very angry if this happened to my dog!

I can't believe this even happened!!! Why did the officers not listen to this family and shut the car door then the dog wouldn't have even been a threat. But to shoot a dog that was wagging it's tail, totally senseless. I am glad the family got justice, but that officer needs to be releaved of his duty, next time it could be an innocent child

What scum. I've heard this story before and really who is that cruel? The dog wasn't a threat. He was happily wagging his tail oblivious to his surroundings. My heart goes out to the family. What a horrid way to lose a friend.

Thank God for the cameras in cop cars...They need to be used more frequently for those cops who are on a bit of a power trip and take matters into their own hands nad use rash judgement...i can't believe theo fficer just shot the dog! why won't they listen to those they are falsley accusing and get a better story before jumping the gun....how awful for that family! Monetary compensation will never bring back their family member. I wonder how, if at all, the officer was disicplined...

You're right. It is so good that they have those cameras. Nothing would have happened if it hadn't been there. It would have been the cop's word in court against that family and all he would have had said was "the dog tried to attack" and he would have gotten off. As it was, he couldn't do that. I sure hope something happened to him.

Very disturbing! As a relative of a police officer, I have to say that cops should be - and usually are - better trained to be able to identify when they should and should not shoot. This officer should be removed from the force, if not charged with animal cruelty. He does not have the restraint required to fulfill his obligation to protect and serve.

This is so sad. No amount of money will make up for what that officer did to that poor dog. It is a shame that the people who are suppose to protect the public sometimes get that out of hand. I've heard of cases where an officer actually shot a dog that was in the owners back yard, completely unnecessary!

Omgoodness, that's horrible. The officers need to be more aware of what is going on in their surroundings and listen to people better. That's very sad that he had to witness his dog to be killed in such a brutal way...that's a very sad ending to a family vacation...

Police cruiser camcorders have proven to be useful. They are usually useful FOR the police, but they were useful AGAINST the police in this case. Police have to make quick decisions, but the decision to shoot the dog was rash--and the court acknowledged this in its judgment. You can't really put a price on a dog's value or compensate for the invaluable loss of companionship, but at least the police were held accountable.

Trigger happy idiot!!! I am glad these people won the money. But this doesn't replace their pet! All the officer had to do was see if it was friendly! he never even spoke to the dog. It is all on video. Not a word the the trooper that shot the animal. NOT ONE!!!!! This type of thing makes me soooo angry! Even if the family had actually been the suspects the police were looking for does not give these officials the right to kill the dog!

How very sad for this family. I am glad that they were compensated for their loss and hope that this will open the eyes of other law enforcement but this will not bring back their dog.

Fortunately this is the exception not the norm for officers. I'm glad justice was done, but it won't bring the dog back.

I would have to guess the officer was uneducated and thought a bulldog looked like a pitt bull.

OMG! Another sick story of excessive abuse of power by the police. How utterly disturbing. Of course, I'm sure that officer kept his job. This makes me sick. My heart goes out to that poor family. I'm so mad now!
