Familys Wins $9K for Dog Shot by Police

NASHVILLE – It was the judgment the Smoak family was hoping for, but not the kind they ever wanted to hear.

A federal jury awarded James Smoak $9,100 and found Sgt. David Bush guilty of using excessive force against Smoak.

The case stemmed from a traffic stop on New Year’s day in 2003, when the Tennessee Highway Patrol stopped the family on Interstate 40.

Mistaken as robbery suspects the Smoaks were forced out of their vehicle as a patrol car video captured the disturbing events that transpired.

The video shows the family’s pleas of protest that they were just vacationing and passing through on their return trip home to North Carolina.

The Smoaks then plead with the officers to close their car door. Their 55-pound mix breed bulldog, General Patton, was still inside.

“I got a dog in the car and I don’t want him to come out,” James Smoak’s voice is heard on the video.

But in the process, Patton escapes the car and can be seen on the side of the road wagging his tail. In a matter of seconds, a Cookville police officer shot the pet with a shot gun at close range.

Smoak tried to help his dog but he’s forced to the ground and injured by highway patrol Sgt. Bush. General Patton died on the spot and Smoak was lead to a waiting patrol car, crying “you shot my dog, you shot my dog! Oh, my God!”

The federal jury’s verdict settles the issue of excessive force used by Bush of the Tennessee Highway Patrol.

The city of Cookeville compensated the family more than $77,000 for their officer’s actions in a separate lawsuit.

Jerry Andrews, a lieutenant at the time of the incident, was also named in the case, but found not responsible, while Bush was the trooper responsible for handcuffing Smoak.

Just horrible to read and then watch the video (which by the way was a good thing they had)--totally excessive force. I can't even begin to comprehend the mental anguish the family must feel.

how outrageous!
I feel terribly sorry for the family.
The amount of money is not the point, the point is that the police officers need to take responsibility for waht they did!
I hope the family was able to handle the incident and is getting over their grief.

My heart goes out to this family. No amount of money can compensate them for the loss of their pet. This trooper should be fired. If this idiot cannot have better judgment to see that this dog was in no way a threat what would he had done if a child suddenly jumped out of the vehicle? Thank goodness there was a video.

How devastated the family must have been. Thank goodness the officer's camera
caught what really happened, otherwise it would have been just the family's word
against the police and they may have said the dog was aggressive. I'm glad that
the award for the family was made. But it will never take away the pain.

That is so tragic! Why in the world would that officer shoot the dog? $9,000 isn't nearly enough. The officer should be facing criminal charges for what he did!

I've heard of too many mistakes by the police in the last year. A family in Houston was victim of mistaken identity by the police during a drug bust. The police were at the wrong house and had the wrong people. The police shot their family dog and wouldn't let them near the dog to help. By the time everything was "cleared up" it was too late and the dog died. This is unexceptable. The article even stated that the dogs tail was wagging. The man told the cops they had a dog in the car. This shouldn't have happend! I know they deal with lifethreatening situations, but this certainly doesn't sound like one. He should have let the family close the car door to keep the dog in, especially since they had all of the people out of the car. This is so sad for the family. To have your dog killed, right in front of you, and to be forced out of your car and treated as criminals, all because of mistaken identity...I just couldn't imagine! I'm glad they have dealt with the officer. There needs to be some safety nets in place to prevent things like this from happening!

I would agree with that. Why just shoot the dog? It is not understandable ... it wasn't even the right family that they were looking for!

OMG! I missed that there was a video of it when I wrote before! That should have NEVER happend! There wasn't anything that I saw in that video that warranted Patton being shot! OMG! Those poor people! That child saw too! I can't stop crying!

I think law enforcement need to trained bette into how to handle an animal in this kind of situation. They need to be able to tell if the dog is showing signs of being agressive or that of being playful. I do think the owners should of gotten alot more money inorder to teach the police department a leason. You have to hit them where it hurts-the wallet.

What was that officer thinking when he shot the dog? Such a mean person and mean act. I am so glad that they were able to get something for all their and the animal's suffering. I know money won't replace the pet, but maybe that officer will learn a lesson

I could not bring myself to watch the video, just read the news story. How sad and disturbing! There's no amount of money that can bring back a loved one, even when it is a pet.

That video actually brought tears to my eyes. That pup looked really cute, and not aggressive. SHAME on those officers.

I would be devastated if someone shot my dog. My heart goes out to this family.

Thank goodness there was video of the incident.... to back up the family's story.

I would bet that this decision opens the gates to suing in civil court. And I think the article indicated they got a good sum from the city, but I bet that was before lawyer's fees.

Shocking & heartbreaking story. No amount of money can compensate for the loss of their beloved dog, it's true, but it goes as a mark against the Highway Patrol. That trooper needs to be fired. You don't want an idiot like that armed with a gun! I couldn't watch the video & can't begin to imagine how traumatic it was for the family. Hope they use a little of the money to adopt a homeless dog from a shelter & make a donation in their deceased pet's memory so that one positive thing comes out of this senseless tragedy. Could happen to any of us!!

Wow-what was the cop thinking? Thank god for video cameras, because I bet he wld have sd the "dog attacked me" and gotten away with it otherwise.

I appreciate that police deal with the scum of humanity and often their lives are in danger, but this seems very excessive. I only hope that the dog died instantly without suffering, and that this will help prevent similar incidents in the future. As for the police officer - suffering might lead to better judgement.

Wow. This is a really sad story. The fellow even warned the police there was a dog in the car. If it has jumped out by completel surpirse, that might be more understandable. My dog was shot by a mean neighbor when I was kid and I still grieve over that wretched act!

How horrible for the family. While no amount of money can compensate them for the loss of a pet, and worse, seeing him shot in front of them, I am glad that the officer has been penalized for his actions. I would hope the authorities take away his gun & badge over that.

My heart goes out to this family. This is a horrible story and no amount of money will ever bring back their beloved family member back. I can only hope that this tragic event might cause others to think twice before taking a pets life if they are in a similar situation.

There are some good honest hard working police officers who put themselves in harm's way on a daily basis. But, there are some people wearing guns that should never be permitted to address humans or animals. I hope the family really wins big for they lost big!

Happy to hear it.. although no amount of money will ever replace their pet. This cop must be some sort of pet hater..idiot! I think he should lose his job as well. The last thing we need are bad cops running around believing they can do whatever they want.

This is a truly heartbreaking story and can happen to any of us at any time. I realize police put their lives on the line every day, but this wasn't an intense situation and the shooting of the dog was more than unnecessary. I'm glad they were given some type of restitution although it will not bring their dog back to them. I feel for the family.

What a horrible thing to happen. The policeman obviously had a case of "big head" and decided to do what ever he wanted. This SHOULD NOT be allowed, I am glad the family sued. No amount of money will bring their pet back and they probably miss him dearly but money talks and lawsuits make things be brought to attention. I would really like to give that officer a piece of my mind, I hope the family finds peace.

I couldn't believe this story when I first heard it years ago. What was that guy thinking? He certainly isn't an animal lover. Hopefully he is not in a position of power anymore. I also think that he should have had to pay wa-a-ay more money to those poor people even though no amount will stop their pain.

This horrible excuse for a cop couldn't have possibly thought this dog was a threat as it sat and wagged its tail...he just was out to destroy something to show that he was a "big man"...and all that it demonstrated was the smallness of his person and lack of soul.

He should not be permitted to ever work as a cop again! How awful to go through something like that. When I have my dog in the car I have a seat belt through his collar to keep him from flying through the windshield incase I'm hit. It might have helped this situation as well.

With the growing number of domestic animals in America, police need to be better trained in how to handle a situation that involves them. My dog is a large breed dog and has a black coat. People often make an assumption that he's aggressive because of how he looks, while really the only danger someone's in is of being licked to death! If the officer in this case knew anything about dogs, he'd know Patton did not intend him any harm.
