Familys Wins $9K for Dog Shot by Police

NASHVILLE – It was the judgment the Smoak family was hoping for, but not the kind they ever wanted to hear.

A federal jury awarded James Smoak $9,100 and found Sgt. David Bush guilty of using excessive force against Smoak.

The case stemmed from a traffic stop on New Year’s day in 2003, when the Tennessee Highway Patrol stopped the family on Interstate 40.

Mistaken as robbery suspects the Smoaks were forced out of their vehicle as a patrol car video captured the disturbing events that transpired.

The video shows the family’s pleas of protest that they were just vacationing and passing through on their return trip home to North Carolina.

The Smoaks then plead with the officers to close their car door. Their 55-pound mix breed bulldog, General Patton, was still inside.

“I got a dog in the car and I don’t want him to come out,” James Smoak’s voice is heard on the video.

But in the process, Patton escapes the car and can be seen on the side of the road wagging his tail. In a matter of seconds, a Cookville police officer shot the pet with a shot gun at close range.

Smoak tried to help his dog but he’s forced to the ground and injured by highway patrol Sgt. Bush. General Patton died on the spot and Smoak was lead to a waiting patrol car, crying “you shot my dog, you shot my dog! Oh, my God!”

The federal jury’s verdict settles the issue of excessive force used by Bush of the Tennessee Highway Patrol.

The city of Cookeville compensated the family more than $77,000 for their officer’s actions in a separate lawsuit.

Jerry Andrews, a lieutenant at the time of the incident, was also named in the case, but found not responsible, while Bush was the trooper responsible for handcuffing Smoak.

I'm not a lawyer, but cops are usually given the benefit of the doubt. So, if they paid even one dime, my guess is that they really messed up.

I think the officer should lose his job for excessive force but that will never happen! I would think that the matter could have been handled in a better matter

I think they deserved the money and more for the horrible way they were treated. And to think the officer shot the dog for no reason at all, that was ludicrous!

Glad to see that some action was taken but unfortunately all the money in the world will not bring back the dog and the officer is still working and carrying a gun?? YIKES!!

I'm so happy that this family won the money.
Even though it was a very sad story, at least the family got some compensation from this horriable act.

I think that this officer was a sick, sick coward and deserves to lose his job and that was just an unnecessary horrible thing that could have been prevented if people would try to learn a little about the common body language of dogs.

That's just so sad, just imagine that you were on vacation with your dog and then all of a sudden a police officer pulls you over and shoots your beloved pet:(

That's horrible. They would never be able to give me enough money for me to feel better about watching a PATHETIC police officer shoot my animal for NO REASON. I'd be absolutely traumatized.

There's not enough money in the world that can compensate for a family member, animal or human. The jerk should be fired since he doesn't have enough brains to do the job.

goodness how horrible. i would have beat up that police officer.lol. not in hand cuffs though. im glad they got the money but i dont think any money could compensate for their loss.

There should have been criminal and civil charges placed. I hope there was. These people should no longer be cops. They should be on the street without pay.

There's not much detail in the story about who the cops thought the Smoaks' actually were. I mean why they were mistaken. It would be good to know that.
But the thing is justice was served in court. The officer clearly overreacted. They couldn't have had probable cause to harrass the Smoak family, or the cops would have won the case.

It would be great if cops got a course in dog behavior. You can tell ( at least I can) what a dog is going to do by watching their body language. That is how dogs communicate with each other. Maybe things like this would be less likely to happen. People react to fear and do stupid things. Some people have a fear of dogs because they only hear bad things and don't really now much about dogs.

I had put a couple of posts about what happened that led up to the dog shot.

Anyways, to recap:

The family was returning from vacation. They were in two cars. Grandma and Grandpa and the two younger kids in one car, the husband, wife, and older son and the dogs in the other car. They stopped at a gas station to get gas, and the husband accidentally left his wallet on the car roof or hood. Then they drove off. The wallet flew off the car on the interstate. A woman saw the money and wallet flying by and assumed that some crime had taken place, and that the car was stolen. She called it into the police. They followed the car for a while, and then finally pulled them over, thinking they were car thieves. It was already dark by that time. There were two dogs in the car. The dog that ran out, he used to play with them and flashlights, and so when he saw the flashlight, he wanted to play. The officer shot the dog. Then after all that commotion, the family had to stay there until some higher up cop figured out what had happened. Not once did they ask for ID from any of the family members.

It's pretty messed up. In the end, there was no crime at all, and the dog ended up dead. The cops really made a big mess of something. Stupidly they didn't even check to see if the people in the car were the owners of the car. I'm sure the wife would have had ID on her someplace. But because they were treated like criminals right from the beginning, they didn't have a chance to set things straight.

That police officer used excessive force against the family- and then to shoot the dog just because it got out of the car is horrible. I am glad the family filed suit against their harassment and the loss of their dog. I hope that police office is relieved of his duty- I wouldn't feel comfortable knowing a police officer like that was out there supposedly looking out for my best interests- which include my pets!

How terrible. Isn't scary to think that this can happen to anyone. I was dropping my car off late one evening to be detailed. I was sitting in the parking lot with my Shepherd in the back set waiting for my hubby to get there to give me a ride home. I local cop came over to my car to see what I was doing in the parking lot that late at night. He came to my window and saw my shepherd in the back seat and before he got any closer, he asked if the dog was friendly. He is the handler of the K-9 officer for our city and he used common sense before evening approching my car. This made it safer for me and him. I'm glad he had a brain. Who knows how it could have turned out if it had been handled like this poor family's situation was handled.

that dog sounded really threatening and dangerous....??? WHY DID THE COP SHOOT THE DOG?! That just sounds like a sadistic abuse of power to me.

What a nightmare for this family..I hope the police dept is planning some training and procedure review as a result of this mistake.

That poor family deserves the money and more for what happened to them. The money will not bring back their dog or take away the memories of what they had to witness though. The cop should face criminal penalties and never have a badge again.

Bush needs to be fired and should never be given a job in the field again. We are taught that police officers are there to help and do the right thing, but this is just another example of another corrupted cop. I am so tired of reading about cops who just want to exercise their power. Absolutely disgusting. The family deserves more money than that, but I know thatall the money in the world will not make up for their loss. I'm so sorry to hear about this, and I really feel empathy for the family.

I remember seeing this video on the news. It was one of the saddest things I've ever seen. Rehashing it brings tears to my eyes. There was no reason for this at all. They deserve more than $9,000.

I can't believe an officer actually did this. What is more disappointing is that pets are still considered "property" by the law. I would have loved to see the family get more then they did. If the officer did that to a person it would be millions. Where is the justice?

This story actually made me sick to my stomach! I can't believe what this family had to go through! I just can't believe it! I hope the compensation helps to ease their pain some, but nothing will erase the terrifying memories or bring back their beloved dog. Those officers should lose their jobs, no doubt about it!

The officer involved was wrong on all counts and I for one am glad that the family was compensated. The money awarded will never bring back their companion nor will it ease their pain or take away the nightmares they will likely suffer, but it will hopefully send a message to law enforcement that there are better, safer ways to handle themselves and the people they are supposed to be protecting.

what's going on with police officers lately? just saw in my local paper a police officer responded to a home regarding a disorderly person and shot the family dog, right in their home, with the family in the same room!!!! in all fairness, the officer said the dog approached him in a vicious manner...right...

That is aweful!! I am glad the family got the money, but it doesnt replace the dog. Obviously the dog was considered part of the family if he went on vacation with them. So sorry for the family. I hope that officer pays for what he did. It was so uncalled for. I would have so been in that officers face and probably arrested for assault on the police officer. That shotgun would have been in my hands after that.

You know... I'm sure the 77k and 9k would help. BUT... the money won't bring back their dog. As everything in life... I put myself in others shoes. In this situation... the COP would have to have shot me too. Why? Well... I would have been in the cops face in a matter of seconds. I didn't watch the video; don't need to. But... if a cop would have shot one of my dogs... for no reason (which it sounds like)... I would have not taken that too lightly. Come on folks... THINK before you do something like that. I hope the cop gets what he deserves. This is NOT called for... and I'm sorry to the family for having to have went through this.

What is wrong with people. If htis article is really the way it happened why in the world did he feel the need to shoot the dog? I think he was just itching to do something like that anyway. Maybe the guy is lucky he wasn't shot too.

I'm a criminal justice student and unfortunately have seen this video multiple times. It is heartbreaking. I am so glad the family was awarded something for their heartache.

How sad for the family to see their pet killed in front of them that way. We all need to be more aware of the police and the stress that they have in their job. The officer had no way of knowing if this really was the suspect that they were looking for, and if it was then his life could have been in danger. However just the pet owner asking for the door to be shut so that the dog could not get out should have been enough for the officer to either close the door, or let someone else do it.
