Familys Wins $9K for Dog Shot by Police

NASHVILLE – It was the judgment the Smoak family was hoping for, but not the kind they ever wanted to hear.

A federal jury awarded James Smoak $9,100 and found Sgt. David Bush guilty of using excessive force against Smoak.

The case stemmed from a traffic stop on New Year’s day in 2003, when the Tennessee Highway Patrol stopped the family on Interstate 40.

Mistaken as robbery suspects the Smoaks were forced out of their vehicle as a patrol car video captured the disturbing events that transpired.

The video shows the family’s pleas of protest that they were just vacationing and passing through on their return trip home to North Carolina.

The Smoaks then plead with the officers to close their car door. Their 55-pound mix breed bulldog, General Patton, was still inside.

“I got a dog in the car and I don’t want him to come out,” James Smoak’s voice is heard on the video.

But in the process, Patton escapes the car and can be seen on the side of the road wagging his tail. In a matter of seconds, a Cookville police officer shot the pet with a shot gun at close range.

Smoak tried to help his dog but he’s forced to the ground and injured by highway patrol Sgt. Bush. General Patton died on the spot and Smoak was lead to a waiting patrol car, crying “you shot my dog, you shot my dog! Oh, my God!”

The federal jury’s verdict settles the issue of excessive force used by Bush of the Tennessee Highway Patrol.

The city of Cookeville compensated the family more than $77,000 for their officer’s actions in a separate lawsuit.

Jerry Andrews, a lieutenant at the time of the incident, was also named in the case, but found not responsible, while Bush was the trooper responsible for handcuffing Smoak.

i'm sorry to say this but I hope something bad happens to this "law enforcement" figure! I have huge respect for what police officers do for us, but this? are you serious? that just pisses me off , i dont know what I wouldve done, grrrrr i feel horrible for the people

OMG! u just dont kill a dog for no reason! in fact u shouldn't kill one at all! I think that the officer should feel so guilty. isn't he suppose to save lives and not take them away!!!!!!!!!

That's terrible. My uncle was in law enforcement so I know its a thankless job, but some of these guys seem to just be on power trips.

How sad, an innocent family and dog...seems to me the officer over- reacted , was he a rookie ? Money can never replace their dog..

I am so glad this incident was caught on the video tape or the Smoaks might never have won their case. I am sure the money will never replace the dog they once had, but I glad that they were compensated. This police officer should lose his badge.

This should never have happened. Glad to hear that they are being compensated for their loss. A loss that didn't need to be. Money can take the place of a loving pet.

This is an outrage. The police officer should be fired, never alowed to be in law enforement, be tried on weapons charges and never be allowed to own a firearm. Their was absolutely no reason for his actions. The monetary settlement these folks reciieved is not enough in my opinon. I hope they sue the officer in a civil lidigation. My heart goes out to this family.

This is such a sad story. The dog wasn't coming the police officer. Losing a pet to old age or illness is traumatic enough, but to watch your beloved pet get murdered is too horrifying to even imagine. The officers involved should be ashamed of themselves and their actions.

Yes, isn't it awful to listen to the sobs of that family after their family member has been shot? After PLEADING with the cops on the behalf of their pet. Unbelievable.

Stories like these are hard to read. Law enforcement must be held to a higher standard than what was described here. Sounds like the court agreed.

This is such a shame. The officer making this stop had no way of knowing that the dog would not instantly attack him upon the command of his owner. He was doing his job, believing he may have stopped criminals. His intention was to keep the public safe and apprehend possible lawbreakers. For that he should be commended. Unfortunately, since he had no immediate backup (2 officers in a patrol car costs $), the situation had to be kept in control and he could not risk his own safety. I am very sad for the family losing their beloved pet.

I can picture this poor family being traumatized for life, replaying the scene of their dog being murdered over and over in their minds. I hope the officers involved have been removed from the force. They obviously do not know how to properly assess a situation.

I totally remember when this was on the news, it was awful. It's one case where the officer was so wrong. I'm glad they got that much money.

This poor family. The behavior of this officer is reprehensible and I am happy that the courts agree. I can't begin to imagine how I would react to such a thing.

Those cops should never be on active duty ever again and I feel so bad for the family. Yes, money is nice but nothing compares to having your best friend by your side.

This is just terrible. I would be devastated if anything like this ever happened to one of my pets. The money means nothing in comparison to loosing the family pet. Tragic!

Once again this present generation of LEO's demonstrates a shocking lack of common sense and restraint. As an old-school ex-LEO- an officer's weapon should not be that quick to clear the holster.

being a law enforcement officer is not an easy job... its even harder when you get bad information telling you that an innocent family is actually criminals. I would have to see the video but unless the dog looked like it was making an advance at either of the officers, i would say the shooting was unjustified.

You could tell the dog was friendly, the officer that shot the dog was immediatly scared of the dog. I am glad they got some money but that does not give them their dog back. I could see how the officers would want to control the situation if they really thought they were robbers but wow sad story

I remember reading about this a few years ago when it happened. It made me mad. It still makes me mad.. I think the officer should have lost his job.. such an abuse of power. These poor people to be treated in such a way and to lose their dog. It was obvious the dog was friendly and I feel the dog shot him just to be mean

I agree with you, Clang. Like others who have posted comments my mouth dropped open when I read the story. It's incredulous that a policeman would shoot the dog! But I'm reading this from my comfy chair in a secure environment. I also understand that police have a very stressful job and this one was under the assumption that this was a Felony stop. You aren't paying any attention to what the people in the car are telling you until you have them all secure in handcuffs. THEN you secure the rest of the scene. I don't agree with the outcome at all! But Clang is right. Until you've been in a policeman's shoes at a time like that, it would be wise to moderate harsh thoughts. Pray for the officer (who probably has kids and a dog, himself!), the family and the dog. It just wasn't a win situation for anyone that day.

What a terrible story! That officer should be fired. And to think that the dog wasn't even being aggressive. I wonder if he would have shot it to death if it was a little dog? The punishment hardly fits the crime here. I guess in this county the police officers can do whatever they want and are above the law. I won't be going there anytime soon.

I feel bad for the family, But I hope the police officer was fired and that he never gets a job as a cop again. The dog was running in the other direction what was wrong with him, I think he just wanted to show his power and maybe he should get stopped and thrown to the ground and get roughed up.

no excuse - cops are paid to show restraint and not gun down everything in their path. and you're right , we don't know what the situation was like. i wonder what it felt like for the INNOCENT family to be pulled over and have their dog murdered right in front of them.

Clang, you are obviously telling the story from a policemans point of view. I can appreciate that. I respect it is a difficult job and high stress especially under those circumstances. it seems unjust. I am sure after he fired the shot he was regretful and remorseful. It is just difficult to think, what if it had been a child on the other side of the gun when he reacted so quickly. The family is tramitized and so is the officer.

I disagree, I see nothing more than a power trip and some major anger managment courses needed! Watch the video before you side with the policeman. It's obvious he is in the wrong field of work if he can't handle the adrenalin rush with out having a quick trigger finger!

OMG! I can't believe a police officer would shoot the dog! It didn't seem, from reading the story, that the dog displayed any aggression towards the police officer, either. I feel so sorry for the Smoaks. $9000 doesn't come close to the value of General Patton in the hearts of his family.

Too often you will hear of these types of tragedies occuring with pets. Maybe someone needs to look into what type of training, if any police officers are receiving in dealing with dogs. I know dogs can be intimidating, especially if they are agitated. Perhaps the dog was excessivly barking? I just feel that police officers should be trained to evaluate dog behavior just as much as human behavior. I hope other police enforcement agencies saw this news report & use this as an example of what not to do.

No, it sounded like the dog was happy as can be, from reading this story and the other comments on this site. I think the police officer jumped the gun (pardon the pun) when he drew fire.

That is awful. The dog wasn't even doing anything, it wasn't like he was attacking the officers. I think the officer should be fired, money can't replace the loss of a family member.

This story makes me so angry I can hardly stand to think about it. Sometimes, sadistic people. bullies, if you will, are attracted to law enforcement for the sense of power they derive from it. The dog's owner deserves every cent that he was awarded, and I wouild like to see the ex-cop punished for such cruelty. A truly sickening story.

This has been such a sad incident for the family. I hope the judgement gives the family closure. I wonder what the sentence will be for the guilty officer who shot the dog? I hope that therapy is part of his sentence-- it sounds as though he needs it!
