Familys Wins $9K for Dog Shot by Police

NASHVILLE – It was the judgment the Smoak family was hoping for, but not the kind they ever wanted to hear.

A federal jury awarded James Smoak $9,100 and found Sgt. David Bush guilty of using excessive force against Smoak.

The case stemmed from a traffic stop on New Year’s day in 2003, when the Tennessee Highway Patrol stopped the family on Interstate 40.

Mistaken as robbery suspects the Smoaks were forced out of their vehicle as a patrol car video captured the disturbing events that transpired.

The video shows the family’s pleas of protest that they were just vacationing and passing through on their return trip home to North Carolina.

The Smoaks then plead with the officers to close their car door. Their 55-pound mix breed bulldog, General Patton, was still inside.

“I got a dog in the car and I don’t want him to come out,” James Smoak’s voice is heard on the video.

But in the process, Patton escapes the car and can be seen on the side of the road wagging his tail. In a matter of seconds, a Cookville police officer shot the pet with a shot gun at close range.

Smoak tried to help his dog but he’s forced to the ground and injured by highway patrol Sgt. Bush. General Patton died on the spot and Smoak was lead to a waiting patrol car, crying “you shot my dog, you shot my dog! Oh, my God!”

The federal jury’s verdict settles the issue of excessive force used by Bush of the Tennessee Highway Patrol.

The city of Cookeville compensated the family more than $77,000 for their officer’s actions in a separate lawsuit.

Jerry Andrews, a lieutenant at the time of the incident, was also named in the case, but found not responsible, while Bush was the trooper responsible for handcuffing Smoak.

That is not enough money to compensate for losing a family member. I don't think the officer should have been aloud to keep his job.

If they did this to one of my dogs, I'm not sure what I would do. I do know that $9k isnt enough for what this family went through losing its dog.

How horrible!!! that jackass should have been fired right then. A video for proof--What more did they want? How sad for the family. That would affect me so badly if it were me.

I can never watch these kinds of videos, it's just so wrong. 9K is not nearly enough compensation for what happened. This officer was way out of line.

This story makes me sick to my stomach! That officer should have lost his job! I couldn't imagine being in this situation and how I would have handled it! I'm almost possitive I would have had some kind of charges brought against me for asulting the jerk who pulled the trigger! Loosing General Patton was like loosing a child I am sure! I don't think any amount of money could replace a family member!

I remember seeing this on TV and there was no way they could have perceived the dog as being aggressive. The officer should have been fired and the settlement should be much higher. The entire incident was mishandled and I feel so sorry for the family and nothing but disgust for the police involved.

I read this news in the paper and thought $9K was a reasonable compenstation. Now I know it is not.

first, each and every office involved in this should have been fired. second, i dont think the award was enough for the improper way that this family and their pet were treated. the officers involved should be paying for the rest of their natural lives to these people out of their pay checks, take their homes and leave them scared for where their next meal, or warm nights sleep is coming from. unforgiveable!

I remember seeing this on the news when it happened. I am glad that Sgt. Bush was found guilty of something. Frankly, after seeing so many Cops Gone Wild through the view from their video cameras perched on their patrol cars, I would be petrified to be pulled over by a cop. How many trigger-happy, abusive incidents do I have to see before it's clearly a pattern of behavior towards the public? That poor family! That poor dog who whose only crime was wagging his tail.

If the events transpired exactly as they're written here, then this is an angering story. The dog wasn't even being aggressive... the cop obviously shot it out of spite.

This is a very disturbing story. They had no reason to shoot the dog. I think the settlement should have been higher and more disciplinary action for the excessive force. There is no reason for this type of behavior.

Oh, that's terrible. The officer didn't listen at all, and the dog wasn't acting in a threatening way. That officer should be relieved of duty: he's not protecting the public, he's a hazard to the public.

I can understand if a cop shoots a dog thats attacking him, or being aggresive to the point where he fears for his personal safety, but shooting a dog wagging his tail??? I'm glad the family had the video recording - I doubt they would have got anywhere without evidence!

No amount of money could ever compensate that family for seeing their dog shot dead in cold blood right in front of them. That officer should be fired and never allowed to own a gun.

This so tragic, why wouldn't he listen to the family. Maybe he needs some R & R and perhaps it should be permanent. He just judged these people and wouldn't give them a chance. I say the money they received wasn't enough. How could you replace a General?????? Heartbreaking story!!!

Here in my hometown a dog was shot and killed by a sheriff a few weeks ago. It was sad, the dog was so old and had bad teeth and only ate canned food. She bit the officers leg and he shot her. There were signs that a dog was present but he didn't pay attention I guess. He didn't even get hurt but the Sheriffs office won't investigate.

This makes no sense to me at all! Why would the officer do such a thing? I'd like to see the tape to see if the dog was upset when they cuffed his person or something. Maybe he was just mean and evil!

Why can people not LISTEN. Mr. Smoak told him his dog was in the car & to please shut the door. If he had done as asked maybe he would not have had to payout the money. You just can't fix stupid!!

How ridiculous that the officer would take such extreme action against an animal that was showing no sign of aggression. I'm glad the family was compensated, though nothing can make up for the loss of their family pet.

I really don't understand why people in law enforcement think they can get away with anything. Do they teach shoot first ask questions later at the training classes they take. There is no reason to kill a dog just because it is wagging it's tail. I think the policeman should be fired and have to work in a shelter for a while.

What happened to inoccent until proven guilty! You hear these stories more and more of cops using excessive force on totally inocent people. I can't imagine watching my own dog being shot over nothing! I hope that cop lost his job!!!

Exactly. Ever since video cameras have been installed on the front of the patrol cars, we hear and see these outrageous incidents more and more. One can only imagine what happened before the cameras were there to record it...

Oh my Poor dog. I guess it was good it was video tapped with sound. I don't see why he would shoot the dog. Didn't sound like it was a threat . This is sad

I know that police face many dangers, however, you hear more and more stories of police doing wrong. The dog was not charging, what was this cop thinking?

This shows that officers should go through counseling and thorough training before they are allowed to protect and serve.
There was no call for this to have happened . I am glad they got the money but, that will never bring back their beloved dog!
I hope that officer is never allowed to work in this type of position again. There was absolutely no reason for shooting the dog, This is a good sample of the bullies that become officers,(they should be weeded out before they get to the public!)

We all know that the job of a police officer is very difficult and they are not paid
nearly enough for the danger they're in every single day. This is every family's
worst nightmare. The dog was standing there wagging his tail, not threatening
the officer at all. Money will never bring the dog back or make this familly forget
this nightmare.

this is terrible..just think this could happen to any of us on the highway. bad news..i feel so bad that the dog had to loss his life. the office needs some more training...or something.

I only wish that the cop that shot the dog, had to pay the award out of his own pocket. What a creep - the shooting was totally unjustified!
