Facing Cruelty Charges, DMX a 'No-Show' in Court

NEW YORK -– Rapper DMX, charged with animal cruelty and drug charges, missed his second scheduled court appearance in Phoenix yesterday, with representatives citing "a fear of a stroke."

Legally known as Earl Simmons, the former Def Jam artist was taken to an Aventura, Fla., hospital, but is expected to show for his rescheduled court appearance in Arizona on Monday.

He faces four felony drug charges and seven misdemeanor animal-cruelty charges, stemming from a house-raid in May, as Pet Pulse previously reported.

Phoenix authorities seized 12 pit bulls and pit bull mixes during the search of his Cave Creek, Ariz., home and uncovered the remains of three partially buried -- and possibly burned -- other dogs.

Authorities say they did not find evidence of dogfighting, but noted that some of the dogs were without water and food.

Marijuana and various weapons were also found in Simmons' home.

The rapper faces additional charges of theft of services and identity theft, after he allegedly used a fake ID at a health clinic in August.

In the early morning May raid, the 37-year-old initially barricaded himself in his bedroom, and only emerged once a SWAT team entered his home.

The search was prompted by reports of dogs being abused on the property.

Since then, the convoluted case has continued to spiral downward.

Simmons missed his initial Arizona court appearance in August, then was spotted -- and arrested -- several days later in Miami.

He was extradited back to an Arizona jail on Aug. 27, but was later freed with a paid $25,000 bond, allowing him to legally travel to Florida, one of Simmons' public defenders said.

In August, Simmons' lawyer, Murray Richman, said his client had been on tour and entrusted his dogs to a caretaker, whom Simmons thought was providing for his pets accordingly.

A Maricopa County Sheriff had a different take on the matter.

"A guy like this DMX character, with all his money and fame, has no excuse for not providing proper care for his animals," Sheriff Joe Arpaio told CNN.

This is not his first brush with the law on animal cruelty charges! He's disgusting!!! I hope he gets the book thrown at him....or maybe a cement block....or 100 cement blocks!

He was having a stroke thinking he was actually getting caught. With all his money I am sure he could have afforded food and water and proper care. I hope he gets the maximum penalty, right after he recovers from his stroke of course!

This guy has been in more trouble with the law than you can shake a stick at. He knew excatly what was going on at his home an if he didn't than he's a bigger dummy than he comes across as. I hope that the court system will make an example of these so called celebrities so that it will send a clear message to those younger people that look up and idolize them!

Rapper DMX is a "no show" in court. So why don't they pick him up. It looks like he has a bad drug problem and had 12 Pit Bull Mix dogs that were not getting proper care. I sure hope he does not get away with it.

I am not too sure how much money and fame he has left .... he's a "former Def Jam artist" being represented by public defenders. Regardless, he should have made sure his animals were being cared for properly. Fortunately for him, he'll receive better treatment than they did.

I just read an article about two people getting attacked by their neighbors dogs. Can't we just merge these two stories...DMX gets attacked by vicious dogs! Sorry, I know two wrongs don't make a right, but it was a nice thought while it lasted!

DMX was talented but now he's a bum. He should get the book thrown at him for the way he treats his dogs, the same dogs that he used to rap about and loving so much. I hope that sheriff out there puts him in pink boxers.

He's responsible - he was at home and should have checked on his pets welfare as soon as he got home. After 3 dogs died, did he keep the same caretaker???
He's now trying to avoid the issues, hope they drag him into court soon.

you would think with all of the media attention he receives that he would want to keep his nose clean. There is no excuse for this and I hope they prosecute to the fullest extent.

DMX has been doing this for years. He use to live in NJ and was charged with animal abuse/neglect in NJ and had to pay fines. I guess nothing has changed. Those poor dogs. He should be banned from owning any animal.

i dont remember reading about this in our local newspaper? think animal rights would get this out and about everywhere? did the caretaker do all this while dmx was away? was dmx involved.......guess before i form an opinion i need more info.

he had to know that some of the dogs were dead and burned. i used to like dmx in his movies but i wont lookover or support any kind of animal abuse and this is a very tragic case.

Seems like another celebrity like Michael Vick that they can hopefully use as an example. The thing that bugs me is that the charges of animal abuse are only a misdemeanor. I can't believe taht animal abuse is not a felony. To me it is worse to abuse an animal than a person, because there is nothing that a pet could have done to deserve getting abused, and thereisnothing htey can do to stop someone that really wants to hurt them. People that abuse animals disgust me

People with money think they can do anything they want. He needs to go to jail for the crimes he has commited. Animal cruelty is animal cruelty no matter the amount of money in their wallet. I would almost bet that the animal charges will be dropped for the drug charges. Hang him, I say. Jail time for a long time.

Can't say that I am surprised that he didn't show up. Unless the court really goes after him for his non compliance I doubt he is going to take it seriously.

Too many dollars and not enough sense(common, that is). Some people think that because they are famous, they are above the law. I hope Arizona shows this guy that he is not. His animals need to come first before his touring and career. He needs to get his head in the right place and his priorities in the right order.

Sometimes I don't understand famous people. I know deep down under the money they are normal people, but come on where is the commen sense? A person with as much money as him should have had the dogs well cared for. It sounds to me like they may have been gaurd dogs. Who was suppose to be his dog care taker that's my question?

The authorities say that there was no evidence of dog fighting, although 12 unfed and unwatered pit bull or pit bull mixes were found on the property AND the remains of 3 "partially buried and possibly burned" dogs were also found there??? Come on! Why was he free to run to Florida and "fear of stroke" my butt. He is as guilty as hell and has to be thrown into jail for a long long time! What an example for children this idiot is....
