NEW YORK – It took a lot of fighting but a Hauppauge family couldn’t be any happier to get their dog back – after he spent fours years on death row.

Their 6-year-old pit bull terrier, Duke was put on death row for the allegedly mauling a neighbor’s dog in 2003. A few months earlier, Duke had been confined to his home after the same neighbor, Dominick Motta said that Duke and another dog chased his horse.

Owner Denise Menendez fought for her dog – she and others protested the court ordered euthanization of Duke since 2003, when he was incarcerated.

Attorney Amy Chaitoff represented the Menendez family telling the courts that state law did not allow euthanization in dog-on-dog attacks at the time of the second incident. They agreed.

Owner Denise Menendez said Duke will be confined to a crate indoors and an outdoor pen to comply with the 2003 court orders.

Menendez said her king of the castle will enjoy a steak dinner for his return home.

I would like a little more information on the suspected mauling of the neighbors dog. Was this Pitt off leash and running the streets - If people kept their pets in a safe, confined area where they can't get out there would be fewer of these headlines. I am happy both dogs are well and this one was not put to death.

I am glad that Duke has owners that love him so much. I just hope Denise Menendez knows how important pet ownership is & responsibility. She needs to keep Duke contained at all times. On a leash when they are outside. Duke got his 2nd chance. After this there are no more chances for him if his Mom can't be responsible I am afraid. No ones dog should have a dangerous dog attack them!

Four years is a long time but I'm glad the dog finally gets to go home. I don't understand why he needs to be confined to a crate indoors.

Glad he gets to go home. All pits are not bad and apparently the owners knew he wasn't bad. I hope they keep him under control.

4 years is a long time to be away from your pet. I applaud the owner for never giving up as many people probably would have. It is up to the owner to properly contain their dog and I hope this is a lesson that has been learned the hard way for the owner. Enjoy your steak Duke!

I'm so glad the owner fought 4 long years for her dog's life. I do however wonder what kind of life Duke would live being crated all the time. He is a big dog and needs his space! I wish there were a better alternative that is safe for everyone and good for him.

That is a long time to sit on death row. I like this story on two different levels. First, that some areas are taking all kinds of animal attacks seriously. We have had several animal attacks here that have been totally ignored even though the animal was a repeat offender. On another level, I love the total dedication that this family had to their dog and their willingness to fight for his life.

It doesn't mention whether they have children or not but they should be very careful if they do. I would not trust that dog at all.

I really dont know what to say about this,cause i dont like to see any animal get put down,but if he has already attacked other animals,then he really needs to be locked up tight where he's not able to get out and run loose!

I'm kind of at odds on this one myself - the dog had two incidents - I pray that the owner will make absolutely sure that the dog has NO way to get out of it's pen and crate.

Not Sure what to say I wouldnt want that dog by me or my pets If your dog is mean what is the point I would take matters in my own hands if he harmed my pets they better watch the pups back!!!!

This dog sounds like a real danger. Hopefully the decision made was the right one, and no other animals or people get hurt in the future.

What about ordering behavioral training and desensitization training for the dog. I don't know that it would necessarily work, but it might give the dog some ability to have a better quality of life eventually than having the live in a crate inside which, by the way, I doubt they will really do anyway.

wow, I'm shocked that this dog has been held since 2003. Now that is a persistent and loyal pet owner. I'm glad that she was finally able to take her dog home. I hope there will be no other incidents.

pitbulls aren't a mean dog at all it depends on how you raise, train and treat your dog! A pitbull can be an aggressive if the owner wants them to be that way! but i seen pitbulls with other dogs and they aren't aggressive to there other dogs i believe its the owner and not the breed honestly! pitbulls can be a loving dog when train, raise, and treated right if treated wrong they can be mean to other dogs! never blame the breed blame the owner that made them that way!

This dog has two strikes against it has been away from this family for years. Whatever bond they had is no longer there even if they have visited on a regular basis. I would be worried about this dog attacking them.

This is such a sad story. When a breed has been trained to do something for hundreds of years, as Pits have been trained to fight other dogs, it needs intense early socialization and supervision, and people do not understand that without this socialization, and with poor breeding,the dog can display aggressive tendencies toward other dogs. It's so sad people make dogs who they are and then blame them for being what they made them.

I just don't know what to think about this story. Ms. Menendez obviously loves Duke. She fought to save his life, even paying for a lawyer to represent him. I wonder where this dog was held for four years, and I am also a little uneasy with the fact the Duke got himself in trouble not once but twice while he was running the streets of Long Island free. Also, life in a crate. He may as well be in "jail", but on the other hand he is home with his family where most dogs long to be.

I think his owner better be very very careful and keep him on her property, its to bad he'll have to be so confined, its better than life in a shelter, but I wouldn't think he's to social after all that time.

This guy has not had a great quality of life for the last 4 years, and I'm not sure it will be much better if he has to be crated indoors all the time. I hope his outside run has lots of room.
