DNA Links Teens to Fatally Burning Cat

NEW YORK -- Two Brooklyn teenagers could spend up to 25 years in jail for setting a cat aflame in October, causing the severely injured tabby to eventually be euthanized.

Angelo Monderoy, 18, and Mathew Cooper, 17, were indicted last week by the King's County District's Attorney's Office; they now face multiple charges, including arson in the second degree, burglary in the second degree, aggravated animal cruelty and animal cruelty. In New York, aggravated animal cruelty is classified as a felony.

The 5-month-old case may well have remained unsolved had the New York ASPCA not utilized advanced forensics, one of its investigators says.

It's the first time the New York City cruelty investigative team relied on DNA testing, which is commonly used in human cases, but not animal-related incidents.

"This type of testing is becoming more and more accessible for our field," said Joseph Pentangelo, a special agent for humane law enforcement at the ASPCA. "In this case, what was done to the cat certainly cried out for a resolution. We figured that it was certainly an appropriate case to try it on."

Cooper and Monderoy are being charged for stalking Scruffy, a young male tabby, inside one of the men's Crown Heights apartment building. The cat was technically a stray, but had befriended some of the building's tenants, who would regularly supply him with food and care.

After catching the cat, the pair allegedly broke into a vacant apartment unit on Oct. 7, 2008, doused him with a flammable liquid and set him on fire. One person appeared to hold the cat down on his left side, as the right portion ofScruffy's body showed the most severe burns.

Later that morning, according to the King County's District Attorney's Office, "the cat was found outside crying, unable to move, but still alive. It was taken to an animal hospital, where it was euthanized, due to the severe burns it had suffered."

Identifying a culprit in an animal abuse case is frequently challenging, according to Deputy District Attorney Carol Moran, since "animals, much like a victim in a young child abuse case, cannot identify the attacker."

"Even if this cat had lived, it couldn't identify its attacker, even if it did know who did it," Moran said. "That means that we are always going to rely on some combination of investigative work, and in this case, forensics."

Elements of the crime were sloppy, Pentangelo said, and revealed several clues.

"The flames not only damaged the cat, but the floor and part of the walls of the apartment as well," he said. "This was a reckless act, which could have resulted in people being harmed, as well."

Investigators' survey of the area led them to the defendants, "who made some admissions to their involvement in burning a cat," Moran said.

Yet questions of Scruffy being the actual cat who was burned remained unanswered. Hoping to connect the pieces, the ASPCA investigative team looked to DNA testing as a viable option.

"To make sure we could prove that the animal, whose horrible injuries had caused this death, was the same animal these young men set on fire, the ASPCA really did something unique here," Moran said. "They used the scrapings of charred flesh from the apartment and then samples from the cat's body and sent it away."

The DNA matched.

"This is a very creative and innovative tool for the ASPCA to use, that gives us multiple ways to prove our case," Moran explained.

Pentangelo says it's the first time the ASPCA has turned to such a technique, though the testing is reasonably affordable, costing approximately $1,000. He said he could think of several previous cases that could have benefited from similar testings.

For instance, several months ago, a few men were walking down a Bronx street and pulled a cat who was sitting near its apartment's open window.

"They threw the cat to their dogs to attack it, and the dogs attacked the cat but not sufficiently, so the suspects beat the cat in an effort to get the dog to go after it,"Pentangelo said. "There was security camera on the street that captured the incident, but the cat was unrecovered [sic]. We never found the cat."

Had the police recovered a body of any dead cat in the neighborhood, they would have been able to potentially trace it back to the pet cat,Pentangelo explained.

"It could really serve a case and provide crucial points of evidence," he said.

Up until now, though, Pentangelo said, there hasn't been a "crime that presented a need" for DNA testing.

"It could have helped, but we really didn't need it before," he said. "The price has also been coming down. Costs in the past have made this more prohibitive."

No court date has been set for Monderoy and Cooper.

Cooper, however, is already in jail, following recent charges of burglary and assault in an unrelated incident, in the same building. In that alleged crime, he and another defendant are charged with beating a tenant with a cane and demanding money.

i cant believe someone would actually commit this insane crime to a animal. he should get charged with attempted murder. everyday animals are dieing or getting hurt from peoples bad decisions and neglect. animals should be treated with care, they are like humans. crimes like this need to stop!

This really broke my heart. And I don't understand why they don't get life in prison for this. I agree with what several people have said before me. Make the laws equal for humans and animals alike. It sickens me that someone could do this. Seriously.
A thought.
I have considered a career as an animal cruelty investigator. Now I know why I wouldn't be able to do it. Cause I would be getting thrown in jail as well.

Throw the book at them! No one wants sick freaks like that to be running around. If they can do that to an animal, what about people? Would you want your kids running around with those freaks running loose? Throw the book at them, or bring back eye for an eye justice. I guarantee if someone who tortured and animal had the same done to them, they would NEVER do it again. Maybe this sounds terrible, but I am sick of people who hurt animals getting slaps on the wrist. Do what they do to the animals to them. They will stop.

On another note, this made me cry and I had to hug my kitty, so please hug your babies. Maybe I am a mean person, but when people can hurt animals in such a horrible way I do think maybe they should have the same thing happen to them. Our laws are not strict enough! They should put animals and people in the same field. If you get life in prison for setting a person on fire, make it the same for an animal. The prison time they are facing is not from the animal abuse, it is the arson and burglary and such. We all need to push for tougher laws, and if we see anything in our areas that is weird, do something. Poor baby kitty. I can not imagine the suffering he went through and the pain. Anyone who knows about burns knows the pain is horrendous and there is NOTHING that helps all the way. Gosh this upset me so badly!

Well if animals do not have feelings or emotions, then why do some similar psychiatric medicines get used in both people and animals and work the same way. I think the animals have no feelings thought is just human's way of undermining other species, and feeling less guilty about what we are doing to them every day.

This is a tragic incident, and it really makes you scared just what those people were thinking. How can someone inflict such pain on another living creature without even blinking, and probably enjoying it. I am glad, however, that they were able to identify the offenders. And hopefully they are punished to the maximum for their atrocious deeds. It would serve as a harsh wake up call for the other animal abusers out there that have not yet been caught.

This is so horrible...the poor kitty...we had something like that happen in Nashville, and I was so mad, as the kids pretty much got a slap on the wrist & had to attend counselling....CAN YOU BELIEVE IT!!! And then they wonder why we have serial killers and such out there....Really makes me sick.

Sick people. I don't understand them. I'm glad they caught the teens. I just wish there were stiffer penalties to actually stop others from doing these kinds of things. Horrible people!!

While stories like this mortify me, I do hope that DNA testing will provide justice to all victims (human and animal). There is a link to people who abuse animals also abusing humans who may not be capable of defending themselves. I think that this case proves this point. Justice needs to be served to all who abuse, regardless of the species.

I certainly hope that justice prevails in this case. This poor animal! The scarey part is--why did these kids do such a hideous act? Was it spontaneous or was it premeditated? Were these kids acting soley alone or was this horrible atrocity part of a ritual or pledging of some group? Scarey thought!

this is sad i wish i could burn them to death to see how they like it

Maybe we should go back to an eye for an eye. Maybe that will be some kind of deterrent. People think they can get away with whatever they do to an animal. "It's just an animal" mentallity. That has to stop. They are living , breathing beings. We need much stiffer penalties!!

I don't like the stories about animal abuse much myself but in some cases it is important for us to know that there will be some justice. This case tells me that they are using Science more to find out who perpetrated the crime against the animal AND it is interesting that the kids involved were already into crime against citizens.
I would hope that law makers who read stories like this see that there is a definite link between animal abuse and abuse on citizens and property.
Animal abuse needs to be taken much more seriously, they should be convicted and do time - This is the only way to show these people that if you abuse any animal you are going to jail and that is exactly where they belong.

The one guy was already in jail for robbing and beating a senoir citizen with a cane? I hope they can introduce that evidence into court - this is not an isolated incident - which they will claim so they get a light sentence or no sentence at all? They will do this again - and have already..... get them and keep them behind bars for a long, long time.....

I HATE HATE HATE these stories. They're very upsetting and what can we say! It's a sick world out there! I'm glad they're using foresenics in animal abuse cases now. People may think twice if they realize that science will be used to investigate when there are no eye witnesses. It's important for them to know that these types of crimes are taken seriously and that animals are not just throw away creatures to be used in whatever manor they wish. It's too bad our country is in such a financial mess right now. I wish we could afford stiffer sentencing as well!!!

I hate these stories too - I heard about it last week at work - BUT - I think the reason Zoo2 puts it on is so that we can follow the court procedeeings and find out what the result was. In this day and age of letting criminals get away with murder and abuse - we need to know about it so we can help the judicial system....... we help them by electing leaders who lead - and put judges into positions to adjudicate and punish the worst among us.

It's good to see a case like this being investigated and resolved. Teen-agers like this need to be prosecuted and punished to the fullest extent. They obviously have no respect or regard for life or property. Where and when, in their lives, did they learn the kind of evil and anger that this kind of behavior stems from? What goes so intrinsically wrong with some people's brains and emotions that they choose to prey on innocent and helpless animals and people?

I agree with you. There are so many people out there that have no respect for life. With these boys doing something like this as teenagers, what would they graduate to 10 years from now? I would hate to imagine what they would come up with. Sure wouldn't want them around young children.

well we already know what they are graduating too - the one guy was already arrested for robbery and assaulting a senoir citizen int he same building the cat was burned in - thats how they caught the guys? I hope they out them away for good? we don't need anymore pets/people getting hurt because of a judge giving them a light sentence?

I had to stop reading this story because it make me have a sick feeling in my stomach. These boys had probably done this type of abuse more than this one time. It makes me sad that their are children that turn violent at a young age because they too were neglected or abused; however, it makes me even sicker at the thought of the poor cat suffering so.

This just pisses me off. I don't understand kids these days. Where are their parents? Obviously not around to teach them any sort of humanity. They say it starts with animals and then next thing you know they are killing and setting people on fire. I hope these kids get severely punished and are checked out by a psychiatrist.
