Congo is Slated for Euthanization After Attacking a Man


NEW JERSEY – A dog named Congo is slated for euthanization after attacking a man. His owners say he was only defending his master.

At 6:40 a.m. on June 5th of this year, Guy James looked out his bedroom window and noticed the landscapers he hired had arrived – albeit an hour early.

From his window, James instructed the workers to remain in their car until he gave further notice. That's because his six German Shepherds – two adults and four puppies – were outside, and he didn't want the dogs to frighten the workers.

Fifteen minutes later, the men got out of the car to begin working. Mrs. Elizabeth James had come outside with her son to look for one of the puppies who had not shown up for the morning feeding.

She noticed the men had exited their car, contrary to her husband's instructions. As Mrs. James neared the workers, the three six month-old puppies approached one of the men, who was holding a five-foot long metal rake.

The dogs began barking at the man, who was a stranger to them, at which point he hit them with a rake. By this point, Congo and Lucia (the adult female) had taken notice of the situation – likely because their pups were yelping in pain.

Another man, Mr. Giovanni Rivera, was standing near Mrs. James and Congo. Afraid of the large male dog, he grabbed Mrs. James' shoulders. She screamed, and that's when Congo jumped at Mr. Rivera's back.

In an attempt to diffuse the situation, Mrs. James led Mr. Rivera to her car, which was nearby, intending to separate the man from the dogs.

Before they got there, Mr. Rivera fell to the ground. In doing so, he grabbed Mrs. James, bringing her down with him.

And that's where it gets cloudy. The dogs began scratching and biting Mr. Rivera, in what the James' call defense of their master. Rivera's lawyer claims it was a mauling.

But neither Mr. Rivera nor Mrs. James could identify which dog inflicted the wounds – wounds that won Mr. Rivera $250,000. Mr. Rivera testified that his hands were covering his face during the attack. Mrs. James was also unable to identify the landscaper's attackers.

The James' defense argues that since no animal could be identified, none should be euthanized. Still, municipal Court Judge Russell Annich ruled that Congo must be put to sleep.

Aside from Congo being put down, the remaining five dogs are to be listed as potentially dangerous.

“But who will want to come to my home, knowing I have five potentially dangerous dogs,” Guy James said.

This story is meant to give background to the issue. Tuesday of this week, Judge Annich ruled that Congo must be put down. Pending appeal, that could happen. We will be posting a follow-up to this story soon, including interviews with the family. Stay tuned.

In the meantime, Guy James says he won't stop fighting for Congo until he's home. He says he'll take it to the White House if he has to – to save his dog Congo, who along with the other dogs, was only trying to save his master.

For now the dog is being kept at a nearby shelter. The James' say the dog won't eat and looks depressed.

Since the owners knew that workers were going to be at their house, they should of got their dogs in the house before they came.also the man should not of hit the pup as that is what I feel triggered him getting bit.
 
First off, what was happening in the 15 minutes between when the man told the workers to stay in the car, and the time they got out of their vehicle? How long were they expected to sit in the car and wait?

Why would anyone decide to hit an animal with a rake, especially when they are trespassing on the animals' property? I hope the family is or has filed suit against the individual who initiated the attack, as well as the landscaping company that employed these workers.

I expect them to wait in the truck until the owners give the okay... Your on someone else's property...maybe if they spoke better ENGLISH, they would have listened!

The men should have stayed in the car. They also should NOT have hit any of the dogs...again, just get back in the car!! Don't grab one of the owners...the dogs didn't really do anything wrong in this case. The dog didn't just pick someone and jump on him...he was protecting his "family"...every person and pup. So sad for the dog and owners.

I agree with Ashlee S! First of all, why punish the dog when the workers clearly did not respect or adhere to the dog owner's request? There was a reason they were told to stay in the car and they arrived early to begin with! What dog would not protect their pups from being beat by a rake? What dog would not protect their owner who was pulled down to the ground by a strange man? This whole thing stinks and I am sickened that this person not only won a bunch of money because he chose not to listen to the owner's instructions and beat puppies with a rake which put the adult dogs in a situation of reacting but now the dogs will pay for his stupidity with their lives. Spare the dogs! Punish the stupid human!

I'm not unfeeling for the man attacked but . . . They should have stayed put until all the dogs had been secured (most workers would have insisted on this); they should have anticipated action when they went after the puppies with a rake; and, most importantly, don't put your hands on the property owners and not expect something to happen. This was not an unprovoked attack - something out of the blue. The dogs were reacting normally. And now, for doing his job, protecting his puppies and his owners, the dog is going to be put down. Doesn't make sense.

This is an unfortunate situation for all involved. But based on the facts it does appear the dogs thought they were protecting their master and also the puppies. This was not a vicious dog attacking a person for no reason. I don't think any of the dogs should be euthanized. I hope Congo gets back home.

The dogs were doing what dogs do. The landscapers should of listened. The one that started hitting a puppy with his rake should be arrested and charged with animals abuse and causing the injuries to the others. That is what started things. He is lucky he wasn't shot by either of the owners.

Okay, this gives clarity to the prior articles I commented on. I don't know where this judge's brain is, but with conflicting stories from the landscapers and the owners, I think his ruling was out on a limb.

I will be watching to see what the appellate court does with this. They can't identify which dog so they seize this one? Landscapers show up early then don't follow instructions after being warned to stay in the truck until they round up the dogs? They hit the puppies with a rake? The owner falls down with a landscaper?

Even disputed facts, this is a mess and the ruling totally out in left field just on the fact that the landscapers and owners could not id the dog that "mauled" them.

If someone took a rake to one of my dogs i would of been on there butt and bit them myself....the dog was doing his/her job....worker was at fault.

First of all, why could the owners not have the dogs put up in 15 minutes. 2nd, if he would have hit my dogs with a rake, it would have been me on him, instead of the dogs. And last but not least, It's very obvious that the dogs were only protecting their owners. What if she would have been getting kidnapped or raped & they just sit their & did nothing, everyone would have had a completely different outlook on it. Why have dogs @ all if the main reason we have them for - PROTECTION - gets them killed.

Of course Congo is going to protect his master and his pups. First of all, they gave instructions to stay in the car. If they would have followed those instructions, none of this would have happened. So it is definitely not Congo's fault.

Congo was just protecting the pups and his family, and the landscapers did not follow directions. I hope Congo doesn't have to pay the price of his life.

Well, who attacked who? The gardener struck the first blow and if someone was hitting my child and then what appeared to be attacking my owner, I'd attack too! I don't think the landscaper should have gotten anything and I don't think the dog did anything wrong! I hope the dog is not put down!

My dog would defend me as well in this situation. It's my right to have personal defense and if the dog was acting to protect rather than just attacking he should be freed.

the landscapers were the only one at fault. they were instructed to stay in the vehicle, shouldnt of hit the puppy and really shouldnt of touched their master. those dogs were doing what they know best- protecting their own

I believe if someone tells me to wait in my car that i would wait until they told me I could get out or else leave. Then to hit the pups with a rake just escalated the whole situation. The landscapers are to blame not the dogs, they thought that someone was threatening their family and hurting them. No way this was unprovoked. Leave the dog alone.

I think the judge is definitely wrong with this one. The men didn't do as they were told and a dogs natural instinct is to protect and defend. That's all they were doing.

it is stupid that they want to kill the dog. first the dogs have a natual instinct to protect their home from stangers. second dogs have a good perception of people. third the guys got out of their van before they were suppose to so they put their lives at risk by doing that. fourth this is the dogs only account of violence, you read about other dogs that have attacked a number of people and they are still at their homes. they need to tell the stupid guy that got attacked to listen to dog owners from now on and they need to give the dog another chance

Agree with the previous comment, if the people had done as Mr. James said, all of this could have been avoided. That said, he knew the landscapers were coming, and it would have been a good idea to secure the dogs earlier in the morning just in case they arrived early.

I think maybe there should have been a discussion about the dogs before they arrived and yes they should have stayed in their car why did it take 15minutes for the owners to round up the dogs. I think they were protecting their owner as well

Why do people not listen to homeowners about waiting a few minutes for them to put up the dogs. I guess he new they were coming, but it really bugs me when people come to my door and want to come in and talk and won't listen about the dogs and saying they can handle the situation. Very annoying.

There are many faults here.
One, if you knew people were coming to your resident, you should be prepared.
Two, 15 minutes is a long time.
Three, Mr. Homeowner you should have told them to come back another day, you were not prepared.
Four, This is not pick a pair of pups for profit.
Have your pets spayed & neutered!!!
Five, The so called injured already got paid, so he could care less.
Six, There must be some evidence for this Judge to blame Congo.
