Colo. Raises the Bar on Animal Abuse Law

DENVER - Colorado is one of only seven sates that require veterinarians to report animal abuse. The law has been on the books less than a year, but already the impact is being felt. The law is so beneficial, that some child and family welfare experts say it could help save human lives, too.

Dr. Jed Rogers has been a veterinarian for 15 years. He's one of a majority of Colorado vets who support the state's mandatory reporting law.

“All of us got into this job because we love working with animals,” he said.

The measure requires vets to report cases of animal abuse and neglect. If they don't, vets face the possibility of being fined themselves.

“When I think we realized that we are mandated to report child abuse, but not animal abuse, it struck us as incorrect,” he said.

For Dr. Rogers and his colleagues, the law has been a learning experience. They have found that in practice, while there are clear cases of abuse, most of what they face is owners who just don't realize that what they're doing to their pets is wrong or dangerous.

“With animals, obviously you can't interview them, so you have to rely a lot on what the owner is telling you,” said Karen Spaulding, training manager with American Humane Association.

And what many vets are hearing is that there is a real need for owner education.

“It's sort of helped us think about where we draw the line,” she said. “Where does it become abuse, neglect, that sort of thing – separate from ignorance, and people just simply not knowing what the right thing to do is.”

Even so, the new guidelines have also revealed that where there is an abused animal there could also be a troubled family.

The Colorado law and others like it may help save human lives. For years, experts have recognized a link between animal and child abuse.

Research shows that 80 percent of families with child abuse cases also have a history of animal abuse.

“If cruelty or animal abuse is going on in that family household, then all the members of that family are in danger,” said Marie Belew, president and CEO of the American Humane Association.

The American Humane Association works to encourage agencies and humane investigators to share information. Citing what's recognized as a very real link between animal, child, elderly and even domestic abuse.

“We hear case after case where the mother would have left that relationship in order to flee for safety, except that the life of the pet was threatened as leverage to keep the human victims from leaving,” Belew said.

Experts see it as a cycle of violence, a problem not just limited to the affected family.

“It's not just an animal problem,” said Belew. “It's a whole family problem -– it's ultimately a community problem,” she said.

And it will take a community to protect those who can't speak for themselves.

The Colorado Must Report law waives doctor –- pet owner privilege in cases of abuse or neglect. And vets can not be held liable if they make a report in good faith.

This is an interesting idea to stop animal abuse. I only fear that the worst abusers aren't likely to take their pets to a vet to begin with and certainly won't get their animals medical care when it could also land them in jail when the abuse is discovered. Overall I am for the law.

This is a good idea and,as noted, will help abused humans as well. The ASPCA in NY has for the last several years worked on an initiative for cross-reporting of domestic violence and animal abuse because they often go together. If police, humane societies, teachers, vets, and doctors work together on abuse reporting the most vulnerable in our society can be better protected and rescued.

It is about time! Unfortunately, I would note that most people that abuse their pets do not have the consideration to actually take them to a vet when something is wrong with them - neglect is one form of abuse. Hopefully these vets in CO are pioneering a new age in animal rights . . .

I'm so glad they are doing this. And there should be a method of tracking this with other abuse so that there can be a legal way to investigate other problems.

I just spoke with a local vet and asked them about our state laws and she said she didn't know for sure what they were but that she would report abuse because that was part of her personal code as a vet.

I would like to see vets work in conjunction with domestic violence shelters. There are many abused spouses that must leave their animals with the abuser.

I just wrote an article for my university newspaper about this law in hopes of spreading more awareness. I sited everyone's concerns with the law and praises as well. Hopefully this will stir up some discussion.

Kudos to Colorado and the other 6 states. BUT, I would hope that all vets in all states would report animal abuse without any law.

I can't believe only 7 states make it a law for Vets to report animal abuse. Only drawback I see is that people may not seek veterinary help for their pet that was injured or whatever through their fault if they fear retribution. I recently learned that a family on my street allowed their outside dog's collar to become embedded in its neck (happened years ago). They did take the dog to the vet & the dog recovered. But I bet if they thought that legal action would be taken against them for the abuse & neglect, that dog would have never gotten medical attention. Don't get me wrong. They deserved punishment. But it makes me wonder. I personally will have nothing to do with these people. I can't forgive animal abuse.

i hope the other 47 states follow-just like the dr said-they are in this business because they care about animals-and reporting abuse is a way to care for animals!

Exactly. Caring for animals is their entire livelihood too and they should be doing everything in their power to ensure that people do just that...not for the money but for the principle of what they do.

Excuse me. Unless veterinarians are cruising around neighborhoods -- like animal control offiers, how are they going to discover true abuse? If someone is knowingly abusing their pet, why would they bother to take them to a vet? The fact that they bring the pet to the vet is a sign that they want to do the right thing by the animal. What I worry about is that good samaritans are going to find and "liberate" an abused pet, take it to a vet for care and wind up getting arrested -- having to prove this wasn't their doing and admitting to "liberating" the abused animal. And then the rotten owner of the abused pet will go after the good samaritan for removing their pet. This is a tricky situation.

Hey Kim D., never thought of that. Good point. But I am glad they are doing this because I do believe animal abuse is related to human abuse. I wish more vets would just do this on their own.
 
I'm very happy that some states make vets report animal abuse immediately. The poor animals don't have a voice and many people take advantage of that. Animals are just like us, but they depend on us so we can't let them down. I think all states should have to report abuse, it's the right thing to do.

I THINK THIS IS A GOOD IDEA BUT YOU DO HAVE TO WORRY THAT PEOPLE MIGHT NOT TAKE THEIR PETS TO THE VET FOR FEAR OF BEING REPORTED. THAT WOULDN'T BE GOOD FOR THE ANIMAL EITHER. HARD CALL.
