Colo. Raises the Bar on Animal Abuse Law

DENVER - Colorado is one of only seven sates that require veterinarians to report animal abuse. The law has been on the books less than a year, but already the impact is being felt. The law is so beneficial, that some child and family welfare experts say it could help save human lives, too.

Dr. Jed Rogers has been a veterinarian for 15 years. He's one of a majority of Colorado vets who support the state's mandatory reporting law.

“All of us got into this job because we love working with animals,” he said.

The measure requires vets to report cases of animal abuse and neglect. If they don't, vets face the possibility of being fined themselves.

“When I think we realized that we are mandated to report child abuse, but not animal abuse, it struck us as incorrect,” he said.

For Dr. Rogers and his colleagues, the law has been a learning experience. They have found that in practice, while there are clear cases of abuse, most of what they face is owners who just don't realize that what they're doing to their pets is wrong or dangerous.

“With animals, obviously you can't interview them, so you have to rely a lot on what the owner is telling you,” said Karen Spaulding, training manager with American Humane Association.

And what many vets are hearing is that there is a real need for owner education.

“It's sort of helped us think about where we draw the line,” she said. “Where does it become abuse, neglect, that sort of thing – separate from ignorance, and people just simply not knowing what the right thing to do is.”

Even so, the new guidelines have also revealed that where there is an abused animal there could also be a troubled family.

The Colorado law and others like it may help save human lives. For years, experts have recognized a link between animal and child abuse.

Research shows that 80 percent of families with child abuse cases also have a history of animal abuse.

“If cruelty or animal abuse is going on in that family household, then all the members of that family are in danger,” said Marie Belew, president and CEO of the American Humane Association.

The American Humane Association works to encourage agencies and humane investigators to share information. Citing what's recognized as a very real link between animal, child, elderly and even domestic abuse.

“We hear case after case where the mother would have left that relationship in order to flee for safety, except that the life of the pet was threatened as leverage to keep the human victims from leaving,” Belew said.

Experts see it as a cycle of violence, a problem not just limited to the affected family.

“It's not just an animal problem,” said Belew. “It's a whole family problem -– it's ultimately a community problem,” she said.

And it will take a community to protect those who can't speak for themselves.

The Colorado Must Report law waives doctor –- pet owner privilege in cases of abuse or neglect. And vets can not be held liable if they make a report in good faith.

This is a start, but many times if they are abused, they won't go to a vet. The court systems need improvement and the local police need to be educated

I hope this helps, but the problem is most abused animals are not taken to the vet. But it is at least a start.

I would think that it would be hard to know for sure what is abuse and what is normal animal behavior that would cause injury.

I commend Colorado for their advances in abuse preventation. My dog was formally abused and has obviously had experience with young children. It chills me to think of what a man who would hit a defensely puppy would do to a child. Colorado's new law will not only help to remove pets from abusive situations, but it will help the children in these households as well.

We need to treat animal abusers with serious consquences. People have to stop thinking of animals as disposable. If we are giving abusers some real punishment it will go a long way to stopping the problem.

I believe that this law should be in effect in all states. In my opinion, a person that abuses or neglects an animal is very likely to do the same to a person.

Im surprized that only 7 states find it mandatory to report animal abuse. Hopefully the states that dont require it, the vets report abuse anyway. You would think that they would because of there love for animals....Also its sad that and true that alot of people dont know how to properly care for there pet. I think that some owners just dont understand what they do is abuse. Education is key here. Treat your pet as you would like to be treated. End of lesson.

Hope this spreads to more states...what a great idea! And it's so true about possibly stopping more child abuse, too. If you can abuse an animal, you'll abuse a chold.

As a social worker, my understanding is that animal abuse laws were on the books before child abuse laws. Children were being abused and there was no law to protect them. Child abuse laws came about from the legislation to protect animals. Even though there are animal abuse laws, most states do not have mandated reporters as in the cases of child abuse. A mandated reported is someone who in their line of profession (with animals) comes into contact with an animal they feel is being abused or neglected, must contact the authorities or risk loosing their professional license and risk prosecution.

A big pat on the back of Colorado law makers and vets. They should be allowed to report cases that they feel need to be looked into for the sske of all involed. As they stated there often is also lack of care or abuse of children or elderly in such homes. Hopefully taking this step to help the animals will also help the humans.

With the link of animal abuse and child abuse, every state should have this law. It won't catch every offender but it does give a starting point.

I would expect any Vet to take action if they suspected abuse. Too bad there are only 7 states that REQUIRE mandatory reporting. Also, there are 7 other states WITHOUT FELONY provisions for cruelty to animals: Alaska, Arkansas, Idaho, Mississippi, North Dakota, South Dakota, and Utah. At least since 2002, Ohio considers animal cruelty a Felony punishable by up to 1 year, and $2,000; with mandatory counseling to be ordered as part of sentencing.

So, who watches the veterinarians for abusive behavior? A rescue I'm involved with tried to get action taken against a veterinarian who was involved in the local 4 H and breeding rabbits. Her rabbits were in horrible condition! Bleeding feet from wire cages. Cages so small the rabbits couldn't turn around or sit up. Wounds were infected and abcessed. But, the local attitude was, "She's a veterinarian. This can't be true!" So, who watches the watchers?

I can't believe a Vet would actually do something like that to rabbits = ( They know full well that wire cages are bad for feet, and that they need a lot of room! I hope their friends or family members will try to help make sure that they themselves set a good example of what not to do! Thanks for sharing that information with us = )

I'm glad that there are already 7 states with this law-and I hope eventually to see it spread to the rest of the states-And its great because if they find its a child in the family thats causing injury to the child-that child will get the help they need. Its just good overall for the dog & the families =)

Honestly, I think the people that truly torture their pets aren't taking them into the vet because they just don't care. I think this will help detect if there is a child abusing the pet in the family~

I think that overall,the law is a good one. Sure,there probably will be a lot of morons guilty of abuse that won't take their pets for treatment when they hear of this law,and that will be a horrible thing .I have a feeling though, that most of those people all ready DO NOT seek treatment any way,because they're involved with illegal activities to begin with-whether that be Drugs, Dog/Cock fighting,etc.
There are so many cases of abuse that it's unreal,so any kind of help is a plus.

I hope more states will address this issue. Research shows that many violent criminals begin their downward spiral by abusing animals before other people. Let's catch these people early and protect our animals!

Every state needs this! Animal abuse should be just as much of a crime as child abuse! And in general people should be punished equally for doing something bad to an animal as if they did it to a human. I heard these 2 kids killed 2 pitbulls by putting weights on them and letting them sink to the bottom of a lake to drown! What did they get? Only 2 years in in jail!!! It's absolutely ridiculous.
