Colo. Raises the Bar on Animal Abuse Law

DENVER - Colorado is one of only seven sates that require veterinarians to report animal abuse. The law has been on the books less than a year, but already the impact is being felt. The law is so beneficial, that some child and family welfare experts say it could help save human lives, too.

Dr. Jed Rogers has been a veterinarian for 15 years. He's one of a majority of Colorado vets who support the state's mandatory reporting law.

“All of us got into this job because we love working with animals,” he said.

The measure requires vets to report cases of animal abuse and neglect. If they don't, vets face the possibility of being fined themselves.

“When I think we realized that we are mandated to report child abuse, but not animal abuse, it struck us as incorrect,” he said.

For Dr. Rogers and his colleagues, the law has been a learning experience. They have found that in practice, while there are clear cases of abuse, most of what they face is owners who just don't realize that what they're doing to their pets is wrong or dangerous.

“With animals, obviously you can't interview them, so you have to rely a lot on what the owner is telling you,” said Karen Spaulding, training manager with American Humane Association.

And what many vets are hearing is that there is a real need for owner education.

“It's sort of helped us think about where we draw the line,” she said. “Where does it become abuse, neglect, that sort of thing – separate from ignorance, and people just simply not knowing what the right thing to do is.”

Even so, the new guidelines have also revealed that where there is an abused animal there could also be a troubled family.

The Colorado law and others like it may help save human lives. For years, experts have recognized a link between animal and child abuse.

Research shows that 80 percent of families with child abuse cases also have a history of animal abuse.

“If cruelty or animal abuse is going on in that family household, then all the members of that family are in danger,” said Marie Belew, president and CEO of the American Humane Association.

The American Humane Association works to encourage agencies and humane investigators to share information. Citing what's recognized as a very real link between animal, child, elderly and even domestic abuse.

“We hear case after case where the mother would have left that relationship in order to flee for safety, except that the life of the pet was threatened as leverage to keep the human victims from leaving,” Belew said.

Experts see it as a cycle of violence, a problem not just limited to the affected family.

“It's not just an animal problem,” said Belew. “It's a whole family problem -– it's ultimately a community problem,” she said.

And it will take a community to protect those who can't speak for themselves.

The Colorado Must Report law waives doctor –- pet owner privilege in cases of abuse or neglect. And vets can not be held liable if they make a report in good faith.

It also depends on the quality of the follow-up to the report. And how the family responds.

I'm astounded. Colorado is ONE of only SEVEN sates that require veterinarians to report animal abuse??? I had no idea this was not a requirement.

This story deserves an update. How are Colorado's and the other states' laws doing after two years or so? I don't doubt they will save some people's lives, as well as pets' lives.

I hope they make a distinction between actual neglect, and just owner ignorance. If there are too many reports and investigations, people might be deterred from using a vet

Great law. I never made the connection between child abuse and animal abuse but it does seem to make sense. The abuser will pick out anyone weaker than him or her and who is a better target than the pet? It's not like the abused dog or cat goes to school and will be seen by his or her classmates.

My wife is a teacher. She must also report any suspicious things with her students (abuse, neglect, etc.) Doctors also must make that report so why not vets? I think this is great.

Gail brings up a very good point. Doctors must report abuse should they see it in children. I also feel veterinarians should do the same. Sadly, we have had cases here in New Jersey where dogs have been abused in the name of training. This is unncessary and basically is right in line with the inhumane treatment of a living being - an innocent dog.

I think it should be manditory that vets report abuse, it is a proven fact that people who abuse animals are also at a high risk of committing crimes against people. Jeffrey Dahlmer started out with animals!

I'm surprised that all states don't already require this. I'm also surprised that any vet wouldn't report animal abuse. Like the article says most likely were there is animal abuse there is most likely child abuse were there is child abuse theer is most likely spousal abuse. Hopefully, very soon all states will put this law on the books and enforce it.

I always hate when more legislation is required. Our country is legislated to death.
It seems to me that you should not have to legislate vets to report cases of abuse, they should WANT to report it.
Just as anyone who sees or suspects child abuse.....

I'm glad that they uped the bar! I agree with everything this video had to say. The less abused animal cases there are, the less abused children cases there are as well. If a person can hit and animal, they can hit a child.

I applaude Colorado for showing us that this law could be beneficial for both humans and animals. I completely agree that there is a link between the type of abuse and animal abuse. If we are ever going to get the animal cruelty issues resolved, it will take the cooperation of our family veterinarians. I consider my dogs my children and I would want them looked after in similar ways. I feel that other states should adopt Colorado's law.

I would like to see how they definr abuse. The guy in New York with the dog that he had for 15 years is being charged. Is it really abuse oe stupidity? While it hurts the pet he might have thought that the paw was bleeding from getting caught in something. How many people bring in their cats to the vet when their two animals get at each other. Experts say leave the alone, they have to settle who's number 1. So getting back to this story let's see how abuse is defined.

Congratulations to the State of Colorado for being forwardthinking enough to realize that yes there is a link between animal abuse/cruelty and human abuse. I'm happy that the new law actually has some teeth to it. Moist laws of this nature are so watered down by the time the Legislature gets it that it is virtually unenforceable. Ihope that ALL the States eventually realize what Colorado did and pass similar measures that make it harder for people to get away with animal abuse. I also hope that when they do pass these measures that they have some teeth and do not get waterd down, we need tougher laws regarding animal abuse, because for too long too many people have gotten away with murder, which is what animal cruelty boils down to. WAY TO GO COLORADO!!!
Without this type of legislation we end up with another Michael Vick, drowning, hanging and/or electrocuting dogs, what's next?!
To the residents of the remaining States, start calling, e-mailing,writing letters or whatever you can to do to get your local and state lawmakers to pass similar measures and make them stick, make them tough, for those who cannot speak for themselves, WE need to be their voices.

All the states should adopt these laws. The only problem is that people who abuse their pets don't usually take the time to take their animal to the vet. Even so, this could save the life of a few pets. If people live in a state that doesn't have this law, they should work hard to get this passed.

All I can say is, I'm proud to be a Coloradan! However, it is a drag that most people who feel it's "Ok" for some reason to abuse their pet's usually don't even bother with a vet!

I think this is a great law and should be put into effect in every state. It is so true that if there is animal abuse either it is happening to children in the family or will be in the near future.

once i had seen on tv a dog with mtted hair.
he even had funggi growing off of him!
he looked like a chia pet lol.

That's what used to be said about the mandatory child abuse reporting. Now that people are required to call it in, many children are saved from having to live through years of abuse an the problems are caught sooner. This is an awareness issue.

I think this is a good law, a lot of times someone who will hurt an animal will also hurt people.

I agree, this needs to be Natiionwide, it also needs to be a FELONY not just a misdemeanor, make it so tough that it will be almost impossible to abuse an animal anymore and get away with it.
Let's see if Wash. D C has the b***s to make it a Federal law!
