Animal Cruelty At Odds with Free Speech

NEW YORK -- The U.S. Supreme Court announced on Monday that it is willing to revisit a case involving animal cruelty and freedom of speech.

The issue at hand is whether it is a crime to sell or own videos displaying acts of animal cruelty, or whether the content -- and the distribution of it -- is protected by the First Amendment.

In 1999, Congress made it illegal to possess photos or videos of animals being tortured and/or killed; the 3rd U.S. Circuit Courts of Appeals in Philadelphia deemed that ruling unconstitutional last year, citing the protection of free speech.

The subject at hand was Robert Stevens, a Virginia man who sold three videos of Pit Bulls fighting each other and other animals.

According to The Associated Press, the appeals court described one video as "a gruesome depiction of a Pit Bull attacking the lower jaw of a domestic farm pig."

Stevens has advertised his videos in Sporting Dog Journal, a reportedly underground publication that reports on illegal dog fights. He also sold the videos to federal agents in 2003, and was subsequently arrested. In 2005, Stevens became the first person to be convicted under the law that makes it a crime to sell dog- or other animal-fighting videos.

The Philadelphia courts declared that ruling unconstitutional, saying that the protection of free speech includes depictions of even illegal, and sometimes gruesome, acts.

Government lawyers then appealed to the Supreme Court, reportedly arguing, "Graphic depictions of torture and maiming of animals ... have little or no expressive content or redeeming societal value, and Congress has compelling reasons for prohibiting them," according to The Los Angeles Times.

Animal cruelty, the lawyers also said, has "no place in a civilized society," and those who engage in it, or profit from it, should be prosecuted.

The Supreme Court voted to hear the government's appeal, which will be argued in October in the U.S. v. Stevens case.

The law has been tempered with one exception -- child pornography -- in the past. In 1982, the Supreme Court ruled that free-speech rights do not apply to certain sexual depictions of child. Come fall, abused animals might join those ranks, as well.

Well, it is silly - one government - the 3rd circuit deemed the law unconstitutional siting the Freedom of Speech - BUT - then another governemnet agency is appealing it - SO, Let's hope the Supreme Court does just that. It is all about checks and balances.... This Issue is so important to all of our pets - LET'S HOPE AND PRAY the Supreme Court's verdict is in line with ours?
What would happen if they came down in the side of the criminals? Ugh - lets hope not?

Actually, child porn is not protected under the Freedom of Speech - this is the only legal argument I think the lawyers have... The Supreme Court did issue that child pornography - the making of it, the possesion of it and the selling of it is not protected under the Freedom of Speech..... so I hope they consider a defenseless dog much the same as a child? Lets pray they come down in favor of that.
I am actually glad that the Supreme will hear the case.... Shame on the 3rd circuit court.... but they may have acted in such a way - helping the Supreme Court take it. Sometimes, a lower court will issue a verdict knowing it's headed up to ladder and will help it along.... since we do not have the actual wording of their ruling - it is hard to know.

If the offending videos were of actual torture, rape, murder, etc. of another human being, it would be called "evidence" and there would be absolutely no question. why is it any different if it's a dog/pig/cat/bull/sheep etc?

this guy is PROFITING off of another creatures absolute pain, possibly death, and the courts are trying to PROTECT HIM?

give me a break... this is just ridiculous.

Free speech is the right to state your opinion and to protest. If animal abusers wanted to march to protest the law, there's nothing we can do about it. However, these videos don't contain a message or opinion. They are depictions of a crime. If a video of a human being tortured was sold, that's not free speech. The sale of videos containing a crime should ALL be illegal, regardless of the crime. These videos should be turned into the police, not sold for "free speech".

He was taping and selling these horrible act's he is guilty, simple,,,, Why is it that sick people can sit on the fence with issues like this ? He is sick !! He was selling this "underground" HELLO !!!!!!!! What judge in their right mind would say "oh- he wasent given his proper right's" WHAT !!! What about the rights of the poor animals that had to suffer so he could get a few laughs and make a few dollars ? This just makes me sick.........

There is no such thing as freedon of speech anymore. We have altered everything so much it doesn't matter-so why is this an issue now?

They altered it to protect children from sexual predators and they should alter it to protect animals. Why would anyone want to see an animal or child get abused and get their jollies off on it?

Why is the government so concerned about protecting the rights of animal abusers? What about the poor animals being abused - who protects them? Animal abuse is a crime and in my opinion making a video of it to sell is a crime. It has nothing to do with their "freedom of speech"

Why should it be unconstitutional? Any kind of cruelty should be outlawed that depicts the outright violence of animals or children. What is this world coming to that you can protect some things under the first ammendment, but you cannot protect other things that present danger to the innocents.

This is a no brainer, Dog Fighting should be illegal and so if there were no dog fights there would be no videos of dog fights hence no need for a court to decide if it is trampling the first amendment. Just my thought on this disgusting topic.

Freedom of Speech issue, my ass! Last time I checked abuse is abuse and murder is murder. Aren't we all God's creatures and aren't we supposed to live by the rules? One of those rules being Thou Shall Not Kill. It seems to me that this Stevens guy is the one acting like a rabid animal. So I wonder if it would be a violation of OUR Freedom of Speech rights if we videotaped him getting the holy hell beat out of him. Let me give a name........Jeffrey Dahmer. He used to enjoy abusing and murdering animals when he was younger and we all see how well he turned out.

How could someone consider animal cruelty freedom of speech? And why aren't all states the same in making animal cruelty a felony & not a civil slap on the hands....I just don't understand it.

How would seeing a video like this be beneficial to anyone other than perhaps the trainer/rehabilitator who is trying to help a recovering fighting dog? To sell this as entertainment seems pretty gross.

This is another example of the ambiguity of the thumbs up/thumbs down voting. Do you thumbs up this being brought to our attention so we can all express our outrage, or do you thumbs down them for even considering decriminalizing this.

I couldn't read past the Pit Bull attacking the pig. I don't understand cruelty to live creatures, filming it, selling it or wanting to to own and view it, yes it should be a crime.

No one should sell vidoes of animal cruelty or even record them! I have plenty of reasons. 1: If someone bought a recording of that, why would they watch it? Maybe to see howto make one of their own. 2: It can encourage others to do the same. Got lots more. And what about Earth Day people? RESPECT MOTHER EARTH AND HER CREATURES!

Why are people more like animals than animals?To me only a sick,mentally unstable,perverted idiot would film things like that.It's just as bad as child pornography.These type of people should be locked away and never let out into the civilized world again. It is a crime what they are involved with, therefore the Court might rule to censor it. It is akin to recording a murder and the selling the video for profit. I would not want this to be a slippery slope for other media, declairing protest videos /speach/writings illegal, even if it is not popular.

HOW can they reverse this? If someone filmed people being murdered it wouldn't be legal. If people filmed child pornography it wouldn't be legal. So how might it be legal to have a film of an illegal activity like dogfighting?

I will look this case up - BUT - as I understand it - the 3rd circuit already late last year deemed the congressional law that made all this illegal was not correct (the freedom of speech garbage) - NOW - the man had been arrested and with the new ruling - his sentence ended - SO - NOW THE SUPREME Court is taking the case up again - hopefully with the rights of animals in mind? I will follow this case closely... there have been many arguments using the Freedom of Speech ammendment that don't hold water in a civilized society - hope they see it that way?

We have a local case of a guy hanging and beating his ex-girlfriends two dogs to death. He video taped it and sent it to her. I honestly forgot what he got sentenced to, but not much.

They would rather waste time on this case when you can obviously see the wrong. Then to spend time on a real matter that needs the time. What is wrong with the judge and courts when you can see how sick and cruel this matter is. Do something NOW dont make it a long process.

What's wrong with that judge?Freedom of speech is one thing,showing vicious acts is another.I hope this gets clarified and those types of videos are banned.The person that sells this garbage is just as sick as the persons involved with the cruelty to dogs and abuse.This garbage needs to be locked up for good because if they enjoy this type of "play",what's to stop them from hurting people.

I agree with you - but pornography is covered under the Freedom of Speech act - as long as its with people who look like their adults? or who are adults.... (sometimes weird sites get young looking 19 yr. olds to fulfill weird mens fantasies?) SO, I hope they side with us - and animal cruelty of any kind is not something that should be condoned - but I am just not sure what the legal arguments will be.... I will follow the case though - I would think they would have to say a pet is like a child in that they are helpless to the adults in charge- so they would over turn the 3rd circuit courts ruling from late last year..... we will have to pray and wait..... Lets see what law teams are taking each side? Terrible decision from the 3rd circuit court? wonder which judge that was?

What does this mean for much of the literature and videos of PETA? There is quite a bit of footage that they have featured that includes material that is just as graphic, if not more so, than dog-fighting. The difference is that PETA's is being used as a tool to stop animal cruelty. I don't think the issue is so black and white, as it might back-fire on animal rights.

I see your point. How can we remedy the situation so this argument can't be made successfully in court. Perhaps the purpose, as you pointed out, can make a difference.

The difference is that PETA does not sell their videos? They use them in advertisments and their literature.... the case the Supreme Court is taking up is the man who was arrested, charged and convicted on having and SELLING animal cruelty movies - The 3rd Circuit overturned Congresses law that made that a crime sighting Freedom of Speech - So, the Supreme Court will decide if someone can create, take, keep and sell books, videos and movies of animal cruelty? Hope they overturn the 3rd circuits ruling?

Interesting point...is the case here someone actually profiting from the illegal action of animal cruelty? Yeah, I guess you're right. That is essentially the problem. I'm still hesitant to believe that the simple possession of a video that contains dog-fighting, or animal cruelty, should be punished. Videos that feature cruelty toward animals are problem more often used as a tool to stop animal abuse than they are some person's sick idea of a fun time.

People who enjoy depicting and viewing animal cruelty are dangerous, perhaps even more dangerous than those who are into kiddie porn. This is obviously not a free speech issue. Shame on those who support these creeps and try to make a constitutional argument.

I agree completely. I can't believe that it is a first amendment right to torture animals, film and distribute this garbage. I hope this guy not only loses the case, but finds himself in jail for cruelty.

I agree. I just read a great book written by Tim Link, a pet communicator titled, "Wagging Tales." The book points out that every animal has a story. Animals realize what is going on around them... they feel pain. It makes me sick that there are people out there who are cruel enough to hurt a poor helpless animal!
