I selected this story to comment on because of something that we went through.
I live in NJ. We had to take our Westie with us to Massachusetts to see my Dad. Nobody else to watch him and we did not have cash for a shelter. It was the longest and loudest trip in history! Coming back was not so bad. I guess because he got used to it. We did not have ear plugs, but the guy in the story should have.

I really don't feel that the state is to blame in this situation. The state didn't knowingly place him at risk, and I am sure plenty of people have worked for years without having any ear damage. The job didn't help matters, but I am guessing he was already at risk for such inner ear trauma. He shouldn't swindle the state out of more money for a job he willingly did.

I'm sorry he has a hearing problem. He should have had protection sooner.

I have no doubt that Mr. Donnelly is suffering from hearing loss and that it is most probably caused by being in a confined space exposed to the less than harmonious cacophony of barking dogs. But he most certainly should have employed protection for his ears years ago. My guess is that he wants to retire a little early.

There have been legitimate studies indicating a higher incidence in people with chronic exposure to dog barking - shelter workers, animal control officers, etc. I don't know why he waited until AFTER the damage was done instead of being proactive and getting earplugs earlier though...

What I don't understand is why, knowing the noise was quite loud, he didn't start using ear protection early on? If worked one day in a factory that was loud, I'd know to use protection the next day.

Had to be something holding this guy to this job, he might have had hearing problems before the job.. A law suit I don't think so.... he could have left the job...

After the first day on the job you would pretty much know this was going to be a loud barking job.....
DOn't ya think.... could have quit.....
