Looks like a Carolina Wren to me. I have one that has been visiting my bird feeders, I was quite suprised. I didn't think they were normally in the Northeast. Your photo looks exactly the same as the ones I've been taking of our visitor - and from the research I've been doing, a Carolina Wren seems to be the answer.

Here's a photo of a Carolina Wren from Stokes Field Guide To Birds. It is NOT a Killdeer!!!!

I THINK that's a Kildeer. They don't build their nests in trees...and they dart around real quickly on the ground to get you away from their nest. Here's a picture of one on our shelter roof although you might not be able to see him on the picture unless you make the photo bigger.
