I personally believe that it is cruel to keep a dog in a crate all day. Is there a way you can put up a fence in the backyard so he can at least be outside and run around during the day?

I can understand keeping your dog in an enclosed area if he is going to be home alone. However, I believe it is very important for the dog to be able to go outside and run around. When people are home, the dog should be able to move around and not be stuck in his crate.
If you are not home during the day, is it possible to have one of your friends or relatives go over and let your dog out once or twice?
I hope this helps. :)
